0556CITYOFMEDINAORDINANCENO556ANORDINANCEOFTHECITYOFMEDINAPROVIDINGGUIDANCEFORPUBLICEMPLOYEESCONCERNINGPOTENTIALCONFLICTSOFINTERESTTHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSSection1DeclarationofPolicyThisChapterisenactedtoestabllshguidelinesforstandardsofconductwhichshallgoverntheperformanceofCityemployeesintheconductofpublicprojectworkandotherCitybusinessandtopreventpotentialconflictofinterestSection2DefinitionsDefinitionsasusedinthisChapterunlessadditionalmeaningclearlyappearsfromthecontentshallhavethemeaningsubscribedAEmployeemeansanypersonholdingaregularlycompensatedpositionofemploymentwiththeCityofMedinabutdoesnotincludemembersoftheCityCouncilandpersonswhoservewithoutcompensationonCityboardsandcounissionsBInterestmeansdirectorindirectmonetaryormaterialbenefitaccruingtoaCityemployeeasaresultofacontractortransactionwhichisormaybethesubjectofanofficialactoractionbyorwiththeCityexceptforsuchcontractsortransactionswhichconfersimilarbenefitstoallotherpersonsandorpropertysimilarlysituatedForthepurposeofthischapteranemployeeshallbedeemedtohaveaninterestintheaffairsofAnypersonoftheemployeesfamilyoranypersonwithwhomtheemployeehasacloseorongoingbusinessorsocialrelationshipAnybusinessentityinwhichtheCityemployeeisanofficerdirectororemployeeAnypersonorbusinessentitywithwhomacontractualrelationshipexistswiththeemployeeprovidedthatacommerciallyreasonableloanmadeintheordinarycourseofbusinessorcontractforacommercialretailsaleshallnotbedeemedtocreateaninterestinviolationofthischapter Section3UseofPublicPropertyNoCityemployeeshallrequestorpermittheuseofCityownedvehiclesequipmentmaterialsorpropertyforpersonalconvenienceorprofitUseistoberestrictedtosuchservicesasareavailabletothepublicgenerallyorfortheauthorizedconductofofficialbusinessandforsuchpurposesasandundersuchconditionsasaredirectedbytheCityManagerSection4ConflictofInterestNoCityemployeeshallengageinanyactwhichisinconflictwithorcreatesanappearanceofconflictwiththeperformanceofofficialdutiesAnemployeeisdeemedtohaveaconflictofinterestiftheemployeeAReceivesorhasanyfinancialinterestinanysaletotheCityofanyserviceorpropertywhensuchfinancialinterestwasreceivedwithpriorknowledgethattheCityintendedtopurchasesuchpropertyorobtainsuchserviceBSolicitsacceptsorseeksanythingofeconomicvalueasagiftgratuityorfavorfromanypersonfirmorcorporationinvolvedinacontractortransactionwhichisormaybethesubjectofofficialactionoftheCityprovidedthattheprohibitionagainstgiftsorfavorsshallnotapplytoAttendanceofanemployeeatahostedmealwhenitisprovidedinconjunctionwithameetingdirectlyrelatedtotheconductofCitybusinessorwhereofficialattendancebytheemployeeasastaffrepresentativeisappropriate2Anawardpubliclypresentedinrecognitionofpublicserviceor3AnygiftwhichwouldhavebeenofferedorgiventotheemployeeifheorshewerenotaCityemployeeCParticipatesinhisorhercapacityasaCityemployeeinthemakingofacontractinwhichheorshehasaprivatepecuniaryinterestdirectorindirectorperformsinregardtosuchacontractsomefunctionrequiringtheexerciseofdiscretiononbehalfoftheCityDInfluencestheCitysseIectionoforitsconductofbusinesswithacorporationpersonorfirmhavingbusinesswiththeCityiftheemployeehasfinancialinterestinorwiththecorporationpersonorfirmEEngagesinacceptsprivateemploymentfromorrendersservicesforprivateinterestwhensuchemploymentorserviceisincompatiblewiththeproperdischargeofofficialdutiesorwouldtendtoimpairindependenceofjudgmentoractionintheperformanceofofficialduties FAppearsonbehalfofaprivatepersonotherthanhisorherselforanimmediatefamilymemberorexceptasawitnessundersubpoenabeforeanyregularcrygovernmentalagencyorcourtoflawinanactionorprecedingtowhichtheCityoraCityofficerinanofficialcapacityisapartoracceptsaretainerorcompensationthatiscontingentuponaspecificactionbytheCityGDisclosesoruseswithoutlegalauthorizationconfidentialinformationconcerningthepropertyoraffairsoftheCitytoadvanceaprivateinterestwithrespecttoanycontractortransactionwhichisermaybethesubjectofofficialactionoftheCityHHasafinancialorpersonalinterestinanylegislationcominbeforetheCityCouncilandparticipatesindiscussionwithorgivesanofficialopiniontotheCityCouncilunlesstheemployeedisclosesontherecordoftheCouncilthenatureandextentofsuchinterestIHoldsdirectlyrindirectlyforpurposesofpersonalfinancialgaininvestmentorspeculationanyinterestinrealpropertysituatedwithintheCityifsuchemployeeinthecourseofhisorherofficialdutiesperformsanyfunctionrequiringtheexerciseofdiscretiononbehalfoftheCityinregardtotheregulationoflanduseordevelopmentprovidedthathisprohibitionshallnotapplytoRealpropertydevotedtothepersonaluseorresidenceoftheemployeeormemberoftheemployeesimmediatefamilySection5GiftsandFavorsAItisthepolicyoftheCitythatnoemployeemaygiveoracceptgiftsorfavorsofvalueinhisbusinessrelationshipswithfirmsorpersonswithwhomtheCitydoesbusinessexceptthatthefollowingshallbepermittedCertainbusinesscourtesiessuchaspaymentforamodestlunchordinnertoothersunderessentiallythesamebusinessrelationshipwiththedonorAdvertisingnoveltiesofnoappreciablevaluewhicharewidelydistributedtoothersunderessentiallythesamebusinessrelationshipwiththedonorBItisthepolicyoftheCityandaruleofpublicemploymentthatnoCityemployeeshallTakeoruseanycitypropertymoneynorthenameorcreditoftheCityforhisownpersonalorprivateuseorbenefitorforthepersonalorprivateuseofany otherpersonwheretodosowouldconstituteagiftorendingofCitypropertycreditornameNocityemployeeshallusehispositionorauthorityasapublicemployeetosecureforhimselfhisspousechildorparentsanyspecialprivilegeorexemptionSection6OutsideEmploYmentEmployeesshallnotengageinacceptprivateemploymentfororrenderservicesforprivateinterestwhensuchactivitymay1occurduringworkinghours2detractfromtheefficiencyoftheemployeewhileperformingCityduties3constituteaconflictofinterestorcreateanappearanceofimproprietyasdeterminedbytheCityManager4stemfrominformationorcontactsmadeduringCityemployment5takepreferenceoverextradutyrequiredbyCityemployment6interferewithemergencycalloutduty7tendtoimpairindependenceofjudgementoractioninperformanceofofficialdutiesorSinvolvetheuseofanyCityresourcessuchascopierstelephonessuppliesotherequipmentortimeIfanemployeeisunsureastothesecriteriaortheeffectofhisheroutsideemploymenthesheshouldcontacttheCityManagerpriortobeginningoutsideemploymentSection7ContractsandPurchasingANoCityemployeeshallmakeanypurchaseorcontractforsuppliesmaterialequipmentorcontractualserviceotherthaninaccordancewiththepurchasingregulationsoftheCityAnyCityemployeemakingsuchpurchaseorcontractcontrarytheretooracceptingfordeliverytotheCityanyitemspurchasedcontrarytheretoshallbepersonallyresponsibleforpaymentofsameTotheextentthattheCitymayberequiredtopayforsametheCityshallbeentitledtorecoverthefullamountofsuchpaymentfromsuchemployeeBNoCityemployeeshallbebeneficiallyinteresteddirectlyorindirectlyinanycontractorpurchasewhichmaybemadebythroughorunderthesupervisionoftheemployeeinwholeorinpartoracceptdirectlyorindirectlyanycompensationgratuityorrewardinconnectionwithsuchcontractorpurchaseCAnycontractmadeinviolationoftheprovisionofthisactshallbevoidandtheperformancethereofinfullorinpartbyacontractingpartyshallnotbethebasisofanyclaimagainsttheCitySection8RCWChapter42NothinginthisordinanceshallbeconstruedtopermitcondoneorallowanyactivityorpracticeprohibitedbyRCWChapter4220orRCWChapter4223relatingtoconflictsofinterestimproperpracticesandcodesofethicsforpublicofficialsandemployees ThisordinanceisnotintendedtoaddressallprohibitedbehaviorsthatmayconstituteconflictsofinterestforemployeesForthosesituationsnotaddressedinthisordinanceemployeesshouldconsultwiththeCityManagertoguidetheiractionsSection9ViolationviolationofanyoftheprovisionsofthisordinancemaybegroundsfordisciplinaryactionincludingdischargeSection10EffectiveDateThisordinanceshalltakeeffectivefive5daysafteritspublicationorthepublicationofasummaryofitsintentandcontentsPASSEDBYTHEMEDINACITYCOUNCILONTHISllthDAYOFMay1992ANDSIGNEDINAUTHENTICATIONOFITSPASSAGEIIDAyOFMay1992CayCoMApprovedastoformAttestaTRDavisCityClerk
