CITYOFMIINAORDINANCENO560ANORDINANCEIDENTIFYINGANDESTABLISHINGPROTECTIVEMEASURESFORENVIRONMENTALLYSENSITIVEAREASASREQUIREDUNDERTHESTATEGROWTHMANAGEMENTACTWHEREAStheCityofMedinaintendstolimittheimpactstothenaturalbeautywithintheCityandWHEREAStheComprehensivePlanoftheCityofMedlnacontainspoliciesthatareaimedatprotectingandenhancingthequalityoftheCitysresidentialenviraunentandWHEREAStheCityofMedinaisanestablishedresidentialcommunitywithawelldefinedpatternofdevelopmentandWHEREAStheStateofWashingtonhasenactedaGrowthManagementActwhichdirectsdriestoidentifyandregulateenvironmentallysensitiveareaswithintheirjurisdictionandWHEREASinordertoimplementthegoalsandpoliciesofMedinasComprehensivePlanandtocomplywiththeWashingtonStateGrowthManagementActitisnecessarytoadoptanordinanceregulatingdevelopmentactivitiesinidentifiedsensitiveareasandtheCityCouncilfindssuchanordinancetobeinthebestinterestsofthepublichealthsafetyandgeneralwelfareNOWTHEREFORFTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFajOWSSection1PurposeThepurposeofthisordinanceistoidentifysensitiveareasandtosupplementthedevelopmentregulationscontainedintheMedinaMunicipalCodebypwvidingforsdditionalcontrolsasrequiredbytheWashingtonStateGrowthManagementActWeftandsareasofsteepslopesstreamcorridorsandpotentialwildlifehabitatsconstitutesensitiveareasthathavebeenidentifiedandareofspecialconcerntotheCityofMedinaThestandardsandmechanismsestablishedinthisordinanceareintendedtoprotecttheseenvironmentallysensitiveareasWhileprovidingpropertyownerswithreasonableuseoftheirpropertyByregulatingdevelopmentandalterationstosensitiveareasthisordinanceseekstoProtectthepublichealthsafetyandwelfarebyminimizingadverseimpactsofdevelopmentPreventadversecumulativeimpactstowaterqualitywetlandsstreamsandpotentialwildlifehabitatsToprotectpropertyownersfrominjurypropertydamageorfinanciallossesduetoerosionlandslidesorsteepslopefailuresAlertappraisersassessorsowneraandpotentialbuyersorlesseestothedevelopmentlimitationsofenvironmentallysensitiveareasImplementthepoliciesoftheStateEnvironmentalPolicyActtheGrowthManagementActchapter4321CRCWtheCityofMedinaComprehensivePlanandallCityfunctionalplansandpolicies Section2DefinitionsAAlterationanyhumaninducedactionwhichimpactstheexistingconditionsofasensitiveareaorbufferAlterationsincludebutarenotlimitedtogradingflingdredgingdiaininchannelizingcuttingoftreesclearingpavingconstructiondumpinganddemolitionBBestManagementPracticesmanagementmaintenanceandconservationpracticesorsystemsofpractlcestbat1controlsoillossminimizelossofnantraiorexistingvegetationandreducewaterqualitydeednfioncausedbynutrientstoxinssedimentanddebrisand2mipimiTeadverseimpactstosurfacewaterandgroundwaterflowcirculationpatternsandtothechemicalphysicalandbiologicalcharacteristicsofthesensitiveareaCBufferadesignatedareaadjacenttoapartofasUunorwetlaudthatisanintegralpartofthesireamorweftandecosystumcradesignatedareaadjacenttosteepslopeswhichprotectsslopestabilityattenfionofsurfacewaterflowandlandslideanderosionhazardsreasonablynecessaryDClearingthecutlingorremovalofvegetationorotherorganicmaterialbyphysicalmecbanicslchemicalorothermeansEDrainageFacilitythesystemofcollectingconveyingandstoringsurfaceandstormrunoffDrainagefacilitiesshallincludebutnothelimitedtoallsurfaceandstormwaterrunoffconveyanceandcontainmentfacilitiesincludingstreamspipelineschannelsditchesinfiltrationfacilitiesretentiondetentionfacilitiesandotherdrainagesUucturesandappurtenancesFErosionHazardAreathoseareascontainingsoilsidentifiedinthe1976KingCountySoilsSurveyashavingseveretoverysevereerosionhazardpotentialGGeologicHazardAreathoseareasthatbecauseoftheirsusceptibilitytoerosionslidingearthqsmleorothergelogicaleventsarenotsuitedtodevelopmentconsistentwithpublichealthorsafetyconcernsHhadinganyexcuvafionfillingremovaloftopsoiloranycombinationthereofIPondsareasofopenwaterfedbyspringsorfedbynaturalandenhanceddrainagewayswhicharesointrinsicallyassociatedwithawetlandstreamornaturalwatercourseastomeritprotectionundertheprovisionsofthisChapterJPotentialHabitatthoseareasidentifiedintheCriticalAreasInventorythathavecharacteristicsofhabitatsnecessarytosupportpriorityspeciesKPrioritySpeciespriorityspeciesincludethreatenedendangeredandsensitivespeciesaswellasspeciesofspecialinterestduetotheirpublicappealorbiologicalqualifiesasidentifiedbytheStateDepartmentsofWildlifeEcologyandFisheriesLSensitiveAreasforthepurposesofthisordinancesteepandhazardousslopeswetlanstreamsandfishandwildlifehabitatareareasidentifiedassensitiveareasundertheprovisionsoftheWashingtonStateGrowthManagementActandidentifiedintheOiticalAreasInventory1StreamanareawheresurfacewatersflowsufficientlytoproduceadefinedchannelorbedThisdefinitionisnotmeanttoincludestormorsurfacerunoffdevicesorotherentirelyartificial2 watercoursesunlesstheywereconstructedwithinorinassociationwithanaturallyoccuringsWeamordrainagecourseNWetlandanareathatisinundatedorsaturatedbysurfacewaterorgroundwateratafrequencyordurationsufficienttosupportandundernormalcircumsmncesdoessupportaprevalenceofplantlifentlnpdforlifeinsaturatedsoilsconditionDelineationofidentifiedweftandswillbebasedontheprodeduresandcriteriaestablishedinthe1989FederalManualforDelineationofRegulatedWeftandsSection3GeneralProvisionsAAbrogationandGreaterRestrictionsItisnotintendedthatthisChapterrepealabrogateorimpairanyexistingregulationsHoweverwherethisChapterimposesgreaterrestrictionstheprovisionsofthisChaptershallprevailBInterpretationTheprovisionsofthisChaptershallbeheldtobeminimumrequirementsintheirinterpretationandapplicationandshallbeliberallyconstruedtoservethepurposesofthisChapterSection4ApplicabilityThisChapterestablishesregulationsfortheprotectionofpropertieswhichcontainorareadjacenttoenvironmentnllysensitiveariasEnvironmentallysensitivelandsarethowhichareormaybeidentifiedinthisChapterandontheSensitiveAreasreapAlldevelopmentpermitsincludingbutnotlimitedtobuildinggradingdrainageshortplatslotlineadjustmentsvariancesconditionalandsjalusesanddereolitionshallbereviewedpursuanttotheprovisionsofthisChapterTheprowmonsofthisChapterapplytoprojectsundertakenbyeitherprivateorpublicentitieseetionSensitiveAreasIdentifiedArssensitivetodevelopmentalterationsandpropertymaintenanceactivitiesareidentifiedintheStormDrainageComprehensiveManandtheCdtiadAreasInventoryTheseareasarelocatedontheSensitiveAreasmapandincludethefollowingASteepSlopesSteepslopesareintheformofbluffsandhillsideshavingslopesgreaterthan40TheseareasarelocatedonthewestsideofMedinafromjustsouthofEvergreenPointtoOvqpeertximatelylIE12thStreetandonthewestsideofMeydenbauerBayoneithersideofakeDriveEastAreasthatareidentifiedassteepslopesmyalsobutnotnecessarilybecharacterizedbysoilsthathavebeenidentifiedintheKingCountySoilsSurveyashavingsevereeweionpotentialBWeftandsandPondsTherearefourweftandsidentifiedinMedinaOneislocatedinthenortheastcomerofFairweatherParkandcoversapproximatelyoneacreAnotherislocatedontheOverlakeGolfCoursecoversabouttwoacresandisassociatedwithFairweatherBayCreekTheothertwoarelocadinMedinaParkcoveringapproximatelyfiveacresandareassociatedwithanunnamedhcamthatflowssouthintoLakeWashingtonInndditiontotheweftandstherearepondsonthegolfcourseandinMedinaParkthatareadjacenttothewetlandsbutaredifferentiatedbythefactthattheyareareasofopenwatercontainingnowetlandvegetationAtleastonepondatthesouthendofthegolfcourseappearstobehydrologicallycouneetedtothepondsinMedinaParkCStreamsTherearethreestreamsinMedinathatprovidenaturaldrainageandsomelimitedhabitatOneisFalnveatherBayCreekwhichoriginatesinClydeHillandmergesonthegoffcoursebeforeflowingnorthintoFairweatherBayAnunnamedstreamoriginatesatthepondsin MedinaParkandflowssouthintoLakeWashingtonTheotherunnamedstreamnearthecitylimitwithBeHevuedrainsanareaonthewestsideofLakeWashingtonBoulevardandemptiesintoIVieydenbauerBayDPotentialFishandWildlifeHabitatUndertheGwwthManagementActfishandwildlifehabitatsarethoseareasimportanttosustaininganaturalgeographicdistributionofpriorityspeciesasdefinedbytheWashingtonStateDepartmentofWildlifeGiventhatMedinaisalreadybuilttourbandensitiestheareislittleinthewayofnaturalhabitatleftFairweatherParkandMedinaParkethetworemainingareasofrelativelyandlstarbedopenspaceinMedinaandhavecharacteristicsofhabitatthatarenecessarytosupportseverallocalpriorityspeciesInadditionthereareportionsoftheMedinashorelinethathavebeenidentifiedassuitableforsockeyesalmonspawningSection6RegulatedandProhibitedActivitiesPermittedUsesOnpropartiessubjecttothisChapterusesshallbethesameasthosepermittedinthezoningdistrictinwhichthepropertyislocatedsubjecttotheprovisionsofthisChapter1PermittedactivitiesshallincludethosenormallyassociatedwithroutinepropertymaintenancechashwnmowinghedgeandtreeWmmingandphysicalremovalofweedsandinvasiveplantsTheuseoffertilizerspesticidesandherbacidesshallbesubjecttotheapplicableprovisionsinSection8ofthisChapterandshallfollowthebestmanagementpracticesavailableBRegulatedActivitiesThefollowingactivitiesshallrequireapprovalbytheCitywhenlocatedwithinidentifiedsensitiveareasandbuffers1Theremovalexcavationandgradingofsoilor2Theconstructionreconstructionremodelexpansionoralterationofanystructureor3Theconstruelionofroadsrightsofwayprivatelanesdrivewaysorparkingapronsor4TheconsreactionofdrainagefacilitiesforthepurposesofsteepslopestabilizationandprotectionandCProhibitedActivitiesThefollowingactivitiesareprohibitedwithinidentifiedsensitiveareas1Thedurapingdischargingorfillingofweftandspondsorstreamswithanymaterialor2Thecompleteremovalofhealthymaturetreesandvegetationor3Theconstructionofswimmingpoolshotmbatspassportscourtsandotherrecreationalfacilitiesassodatedwithasinglefamilyresidenceor4ThestorageofvehiclesconstructionequipmentconswctionmaterialsordemolitionmaterialsDSensitiveAmandBufferAlterationSensitiveareasandassociatedbuffersmybealteredprovidedtha1TheCityapproveamitigationplanconstructiontechniquesandappropriatepermitsbeforeanysiteworkoccursand4 2TheplansandproposalscomplywithallapplicablestateandfederallawsandreulaonsSection7ExemptionsandExistingStructuresExemptionsCertainactivitiesareexemptfromtheprovisionsofthischapterandincludethefollowing1EmergenciesthattlutenthepublichealthsafetyandwelfareasdeterminedbytheCity2Normalandroutinemaintenanceofexistingdrainageditchesculvertsordrainagemtententiodetentionfacilies3NormalandmunemalntenenceofutilitiessuchaswaterandsewerlinesnaturalgaslinestelecommunicationlinescablecommunicationlineselectricallinesandotherappurtenancesassociatedwiththeseutilitiesNewutilitylinesandnormalappurrnencesmaybeconstructedprovideditcanbedemonstratedtothePublicWorksSuperintendenttheywillhavenosignificantadverseeffectonsensitiveareasortheirbuffersBExistingSUuctureshisrecognizedinthisChapterthatMedinaisadevelopedcommunityandthatthereareexistingstructuresthatdonotmeettherequirementsofthisordinanceExistingstructuresmaybemaintainedrepairedandremodeledprovidedthereisnofurtherinUasionintoasensitiveareaoritsbufferNewconstructionorreconstructionmustcodontotherequirementsofthisChapterSection8DevelopmentStandardsAAreasofPotentialGeologicInstabilityorHazard1ClassificationThefollowingareclassifiedasareasofpotenlialgeologicalinstabilityoraSlopesof40ormoreandbLandslidehazardareasandCSeismicbaTardareasanddErosionhazardareasandeOtherareaswhichtheCityhasreasontobelievearegeologicallyunstable2SetbacksDevelopmentproposalsonlotswhichhaveslopesofforty40percentorgreaterorwhichtheCityreasontobelievearegeologicallyunstableshallmaintainthefollowingsefimcksaTwentyfive25feetfromthetopoftheslopebTen10feetfromthetoeoftheMopeForthepurposesofthisSectionaffectedpropertiesarethosethathave40slopesthatareeight8feetinheightorgreaterasmeasuredfromahorizontallinethatintersectsthetoeoftheslope3SetbackReductionTheCitymayallowareductionofasteepslopesetbackunderthefollowingconditionsaForsetbacksfromthetopoftheslope5 1Thesetbackmaybereducedtonotlessthanten10feetuponapprovalbytheCityEngineerofageotechnicalreportsubmittedbytheapplicantwhichdemonsWatesthataTheproposeddevelopmentwillnotcretaMnrdtothesubjectpropertysurroundingpropertieserosionorsedimentationtooffsitepropertiesorboxtiesofbThepwposaladdressestheexistinggeologicalconstraintsofthesiteincludinganassessmentofsoilsandhydrologyandcTheproposedmethodsofconstructionwillminimizeeroonandlandslidepotentialandwillimproveornotadverselyaffectthestabilityoftheslopeanddTheproposalusesconstructiontechniqueshichminimizedisruptionofexistingtopographyandnaturalvegetation2ThesetbackmaybereducedothetopoftheslopeuponreceiptofavariancefromtheBoardofAdjustmentandapprovalofagcotechnicalreportsubmittedbytheapplicantthatdemonstratestheconditionsoutlinedinSection8A3a1bForsetbacksfromthetoeoftheslopethesetbackmaybereducedtothetoeoftheslopeuponapprovalbytheCityEngineerofageotechnicalreportsubmittedbytheapplicantthatdemonstratesthoseconditionsouinedinSection8A3a14IncreasedSetbacksThesetbackrequirementmybeincreasedbytheCitywhennecessarytoprotectpublichealthsafetyandwelfarebaseduponinformationcontainedina5SlopeAlterationAlterationsofsteepSlopesmaybeallowedprovidedtheapplicantreceivesavariancefromtheBoardofAdjustmentanduponaplxovalbytheCityEngineerofageotechnicalreportsubmiRedbytheapplicantthatdemonstratesthoseconditionsoutlinedinSection8A3a16DevelopmentConditionsAspartofanyapprovalofdevelopmentonanareaofsteepAllsignificantadverseimpactsidentifiedinthegeotechniealreportbemitigatedinamannersalisfaclorytotheCityandbAllutilitiesandprivatelanesordrivewaystoandwithinthesitebelocatedsoastorequiretheminimumamountoTmodificationtotheslopeandcTheCitymayretainconsultantsattheapplicantsexpensetoensurethatthemitigationmeasuresareimplementedBHillsideDevelopmentStandardsslopesgreaterthan201HillideDevelopmentWhileslopesoflessthanzl0arenotidentifiedbythisChapterasenvironmentallysensitiveimproperdevelopmentorconstructiononsuchMopescancauseerosionsoftsubsidencepropertydamageanddamagetoenvironmentallysensitiveareasregulatedbythisChapterDevelopmentonhillsideswithslopesof20orgreatershallcomplywiththefollowingrequirementsForpurposesofthisSectiondisturbancesshallincludebutnotbelimitedtoclearinggradingflingexeavalionconstructionpavingorremovalofvegetation6 2SubmittalRequirementsApplicationsforprojectsproposedwithinareasidentifiedbytheCitytohaveslopesinexcessof20orareadjacentotsuchslopesordeterminedbytheCityEngineerbasedonasitespecificanalysistocontainover2slopesshallprovidethefollowinginformationunlesstheCityEngineerwaivesspecificsubmittalrequirementsasunnecessaryforreviewofaspecificapplicationSuchstudiesshallcontainthefollowinginformationandbepreparedbyalicensedprofessionalengineerAdescriptionofhowthepwlsedprojectanditsassociatedgradingplanwillorwillnotimpacteachofthefollowingonthesubjectpropertyandadjoiningproperties1SlopestabilityerosionandlandslidebnTrd2Drainagesurfacandsubsurfacehydrologyandwaterquality3ExistingvegetationasitrelatestosteepslopessoilstabilityandnaturalhabitatvaluebRecommendedmethodsformitigatingidentifiedimpactsandadescriptionofhowthesemitigationmeasuresmayimpactadjacentpropertiescTheCitymayretainconsultantsattheapplicantsexpensetoreviewthemitigaffonplanandtoensurethatthemitigationmeasuresareimplementedCWeftandsPondsandStreams1WaterQualityInasmuchasthewetlandspondsandstreamsinMedinaarerelatedtoexistingnaturalandbuiltchainagewaysdevelopmentconstructionandmaintenanceactivitiesocuninginorneartheseareashavepotentialforeffectingthewaterqualitydownstreamAllofthewetlandspondsandstreamsidentifiedinthisChaptereventuallyemptyintoLakeWashingtonwhichisclassifiedashavingshorelinesofstatewidesignificanceandcontainsseveralspeciesoffishandwildlifeprotectedbythestateDevelopmentandmaintenanceactivitiesshallcomplywiththeregulationssetforthinthisChapter2BuffersAbufferzoneofaminimumoftwentyfive25feetshallberequiredforallregulatedactivitiesadjacenttotheweftandsandstreamsinMedinForwetlandsthisbuffershallbemeasuredfromtheedgeoftheweftandasidentifiedinthefieldForstreamsthebuffershallbemeasuredfromthetopoftheupperbtkofthestreamasidentifiedinthefieldNativevegetationshallbemaintainedwithintherequiredbufferWherethenativevegetationhasbeenremovedorsubstantiallyalteredthebuffershallbereplantedwithnativeplantspeciessuitabletoawetlandorstreamenvironmentThetwentyfive25footbufferispresumedtoprovidethenecessaryandsfficientprotection3DecreasedBufferWidthTheCitymayreducetherequiredbufferwidthonacasebycsebasiswhereitcanbeclearlydemonstratedthatsTheadjacentlandisextensivelyvegetatedandhaslessthantwenty20percmtslopesandthatnoadverseimpacttothestreamorweftandwillresultfromtheproposedreductionorbTheproposalincludesabufferenhancementplanusingnativevegetationthatimprovesthebuffersfunctionalcharacteristicstoprovideadditionalprotectiontOthesUeamorweftandorcTherehaspreviouslybeensubstantialalterationofthebufferareaonthesubjectlotandalesserbufferwillincorporatebufferenhancementmeasureswhichwillimprovethefunctionalcristicsofthebufferinpwtecngthestreamorweftand7 DPotentialWildlifeHabitat1ManagementPracticesFairweatherParkMeclinaParkandtheweftandandpondsonOvertakeGolfCoueareareasintheCitythathavecharacteristicsofhabitatsnecessmytosupportpriorityspeciesMaintenanceactivitiessuchasclearingofunderbrushtreeandlimbremovalandapplicationoffertilizersandinsecticidesshallbekepttotheminimumnecessarytoensurethehealthoftheseareasInallmaintenanceactivitiesthatoccurintheseareastheCityandGolfCourseshallfollowthebestmanagementpracticesavailable2SpawningGroundsTheStateDepartmentofFishcrieshasidentifiedseveralareasalongtheMedinashorelinethatmayprovidespawninggroundsforSockeyeSalmonandotherfishnativetoLakeWashingtonDevelopmentontheshorelineisregulatedbytheMedinaShorelineManagementMasterProgramandtheZoningCodeSection9AppealsAnypersonaggrievedbyadecisionoftheCityregardingapermitissueddeniedorconditionedpmauanttothisChaptermyappealthatdecisiontotheBoardofAdjustmentAnoticeofappealshallbefiledwiththeCitywithinten10calendardaysoftheissuanceofwrittennotificationoftheCitysdecisionUponreceivingnoticeoftheappealahearingshallbesetandallpartiesofinterestshallbenotifiedIfthematterwhichisthesubjectoftheappealrequiresadevelopmentpermitwhichalsorequiresahearingbeforetheBoardofAdjustmentboththeappealandthedevelopmentpermitmaybecombinedinasinglehearingection10NoticeandPerformanceSecuritiesNoticeTheownerofanypropertycontainingsensitiveareasorbuffersonwhichadevelopmentprojectissubmittedshallfileforrecordwithKingCountyanoticeapprovedinformbytheCitySuchnoticeshallprovidenoticeinthepublicrecordofthepresenceofanysensitiveareasorbuffersTheownershallsubmitprooftotheCitythatthenoticehasbeenfriedforrecordwithinthirty30daysaftertheapprovalofadevelopmentpermitThenoticeshallrunwiththelandandfailuretoprovidesuchnoticetoanypurchaserpriortoWansferringanyinterestinthepropertyshallbeaviolationofthisChapterPerformanceSecuritiesTheCitymayrequiretheapplicantofadevelopmentproposaltopostacashperformancebondorotheracceptablesecurityinaformandmountdeterminedsufficienttoguaranteesatisfactoryworkmanshipmatedaisandperformanceofstructuresandimprovementsallowedorrequiredbyapplicationofthisChapterTheCityshallreleasethesecurityupondeterminingthatallstructuresandimprovementshavebeensatisfactorilycompletedSection11EnforcementViolationsandPenaltiesprovisionssetforthinthissectionshallapplytoallviolationsofthisChapterPenaltyandenforcementprovidedhereinshallnotbedeemedexclusiveandtheCitymypursueanyappropriateremedyorreliefFinesAnypersonfirmcorporationorassociationoranyagentthereofwhoviolatestheanyofthevisionsofthisChaptershallbeguiltyofamisdemeanorpunishablebyafreenottoexceedPF0ItshallbeaseparateoffenseforeachandcvelydayorportionthereofduringwhichanyviolationofanyprovisionsofthisChapteriscommittedDamagesAnypersonfirmcoporationorassociationoragentthereofwhoviolatesanyoftheprovisionsofthisChaptershallbeliableforalldamagestopublicorprivateproperty8
