HomeMy WebLinkAboutOrdinance No. 0562CITYOFMEDINAORDINANCENO562ANORDINANCEOftheCityofMedinaWashingtonenablingtheCitytorecoverellcostsassociatedwithpurchasingprovidinganddeliveringradondetectorstosinglefamilyresidencesasmandatedbytheStateofWashingtonWHEREAStheWashingtonStateLegislaturepursuanttoChapter132Lawsof1992amendedtheWashingtonStateBuildingCodeandVentilationandIndoorAirQualityCodetorequirelocalgovernmentsratherthanbuilderstoprovideanddeliverradonmeasuringdevicesatthetimeoffinalinspectionbeginningJuly11992andendingJune301995andWHEREASitisnecessarytorecoverthecostofpurchasingprovidinganddeliveringthedevicestomeetcostrecoveryobjectivesoftheCityCouncilnowthereforeTHECITYCOUNCILOFTHECITYOFMEDINAWASBINGTONDOESORDAINASFOLLOWSSECTION1ThecityshallpurchaseandobtainradonmeasuringdevicesapprovedbytheStateofWashintonandtheBuildingOfficialofthecityshalldeliversaiddevicetoeachsinglefamilyresidenceforwhichitisrequiredbyStateLawatthetimeoffinalinspectionconsistentwiththeprovisionsofChapter132Lawsof1992oftheStateofWashingtonSECTION2TheCityshalladdtothefeechargedforabuildingpermitforanysinglefamilyresidencerequiringsaiddeviceafeeequaltothecostincurredbytheCitytopurchaseprovideanddeliverthedevicetotheownerofthepropertySECTION3FeesshallbecollectedattimeofpermitissuefornewpermitsissuedaftertheeffectivedateofthisordinanceFeesfordetectorsrequiredforpermitsalreadyissuedbutnowrequiredbytheStateofWashingtontobefurnishedbythecityshallbecollectedbeforefinalinspectionismadeSECTION4Thefeeforpurchasingprovidinganddeliveringthedeviceshallbeinitallysetat2000TwentyDollarswhichfeemaybelateradjustedbytheBuildingOfficialwiththeconcurrenceoftheCityManagertomoreaccuratelyreflecttheactualcostsincurredbytheCitySECTION5TheownerofpropertyreceivingaradonmeasuringdeviceshallinstallmaintainandremovethedeviceinaccordancewiththeinstructionsprovidedwiththedeviceandshallbesolelyresponsibleforcompliancewiththeinstructionsfurnishedandfordeliveringthedeviceinatimelymannertothetestingagencyNeitherthecitynoranyofitsofficialsshallbedeemedresponsibleforanyoftheprovisionsofthissectionSECTION6ThisOrdinanceshalltakeeffectfive5daysafteritspublicationorpublicationofasummaryofitscontentsandshallapplytoallapplicablepermitsforwhichfinalinspectionsareperformedafterJuly11992andshallremaininforceforthetotalperiodoftimethatWashingtonStateLawrequiressuchenforcementservicesoftheCity PASSEDBYTHECITYCOUNCILONTHIS14thDAYOFSetember1992ANDSIGNEDINAUTHENTICATIONOFITSPASSAGEHE14thDAYOFSeptember1992RayCoryKayorApprovedastoformirkRWinesCityttorneyAttestvisCityClerk
