CITYOFMEDINAORDINANCENO567ANORDiNANCEPERTAININGTOTHEWEARINGOFBICYCLEHELMETSWHILEOPERATINGORRIDINGONABICYCLEORCYCLENOTPOWEREDBYMOTORONPUBLICROADWAYSBICYCLEPATHSRIGHTSOFWAYORPUBLICLYOWNEDPROPERTIESTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSECTION1PurposeandPolicyDeclaredAThisordinanceisenactedasanexerciseoftheauthorityoftheCityofMedinatoprotectandpreservethepublichealthandwelfareItsprovisionsshallbeliberallyconstruedfortheaccomplishmentofthesepurposesBItistheexpresspurposeofthisordinancetoprovideforandpromotethehealthandwelfareofthegeneralpublicandnottocreateorotherwiseestablishordesignateanyparticularclassorgroupofpersonswhowillorshouldbeespeciallyprotectedorbenefittedbythetermsofthisordinanceCItisthespecificintentofthisordinancetoplacetheobligationofcomplyingwithitsrequirementsuponanypersonfallingwithinitsscopeandnoprovisionofnortermusedinthistitleisintendedtoimposeanydutywhatsoeverupontheCityofMedinaoranyofitsofficersoremployeesforwhomtheimplementationorenforcementofthistitleshallbediscretionaryandnotmandatoryDNothingcontainedinthisordinanceisintendednorshallbeconstruedtocreateorformthebasisforliabilityonthepartoftheCityofMedinaoritsofficersemployeesoragentsforanyinjuryordamageresultingfromthefailureofanypersontocomplywiththisordinanceSECTION2SeverabilityTheprovisionsofthisordinancearedeclaredtobeseparateandseverableTheinvalidityofanyclausesentenceparagraphsubdivisionsectionorportionofthisordinanceortheinvalidityoftheapplicationthereoftoanypersonorcircumstancesshallnotaffectthevalidityoftheremainderofthisordinanceorthevalidityofitsapplicationtootherpersonsorcircumstancesSECTION3FindinGsHeadinjuriesareamajorcauseofdeathanddisabilityassociatedwiththeoperationofa bicycleonpublicroadwaysandbikepathsEachyearapproximatelyonethousandAmericansdieofbicyclerelatedinjuriesApproximatelyseventyfivepercentofthosedeathsareduetoheadinjuriesBetweenJanuary11984andJuly11992theKingCountyMedicalExaminersofficereportedtwentytwobicycledeathsrelatedfromheadinjuriesStatisticsfromtheKingCountyEmergencyMedicalServicesDivisionshowthatmedicaltechniciansandparamedicsrespondedtofivehundredtwentynineinjuriesinvolvingbicyclistsinKingCountyoutsideofSeattlein1991AsignificantnumberofthoseindividualswhosurviveheadinjuriesdonotreturntoanormallifeTheyareoftenleftwithprofounddisablingandlonglastingsequelaeChildrenbetweentheagesofeightandtwelvearemostatriskStatisticsfromtheHarborviewMedicalCenterandChildrensHospitalandMedicalCentershowthatin1986seventypercentoftheonehundredseventysixpeopletreatedforbicyclerelatedtraumawereundertheageofthirteenAlmosthalfsufferedheadinjuriesOftheonehundredeightyninechildrenundertheageofthirteentreatedbymedicaltechniciansandparamedicsinKingCountyoutsideofSeattlefortyfivepercentsufferedheadinjuriesAstudyrecentlycompletedbytheHarborviewInjuryPreventionandResearchCentershowsthatbicyclehelmetsareaneffectivedeterrenttoheadinjuriessufferedbybicycleridersduringacrashTheHarborviewinvestigationfoundthatseventyeightpercentoftheseheadinjuriescouldhavebeenpreventediftheinjuredridershadbeenwearinghelmetsWhileeducationalandpromotionaleffortsinKingCountyhaveincreasedhelmetusefromfivepercentin1985tothirtyeightpercentin1991regulationsrequiringtheuseofbicyclehelmetswouldbeamoreeffectiveapproachtoreducingthenumberandseverityofheadinjuriesresultingfrombicyclecrashesTheCityofMedinathereforefindsthatbicyclehelmetsarerequiredforthesafeoperationofbicyclesorcyclesnotpoweredbymotoronpublicroadwaysbicyclepathsrightsofwayorpubliclyownedpropertiesSECTION4DefinitionsThefollowingdefinitionsareadoptedforthisordinanceAGuardianGuardianmeansaparentlegalguardianortemporaryguardianwhomaintainsresponsibilitywhethervoluntaryorotherwiseforthesafetyandwelfareofapersonundertheageofeighteenyearsBBicycleorCycleNotPoweredbyMotorBicycleorcyclenotpoweredbymotorisherebydefinedtospecificallyexcludetricyclesSECTION5GeneralRequirementsReaardinBicycleHelmets AAnypersonoperatingorridingonabicycleorcyclenotpoweredbymotoronapublicroadwaybicyclepathrightofwayorpubliclyownedpropertywithinthecitylimitsofMedinashallwearaprotectivehelmetdesignedforbicyclesafetySuchhelmetshallmeetorexceedtherequirementsofstandardZ904setbytheAmericanNationalStandardsInstituteorthestandardsoftheSnellFoundationorsuchsubsequentnationallyrecognizedstandardforbicyclehelmetperformanceasmaybeadoptedbyMedinaKingCountyortheStateofWashingtonThehelmetmustbeequippedwithaneckorchinstrapthatshallbefastenedsecurelywhilethebicycleisinmotionBTheguardianofapersonundertheageofeighteenyearsshallnotknowinglyalloworfailtotakereasonablestepstopreventthatpersonfromoperatingorridingonabicycleoranyothercyclenotpoweredbymotoronapublicroadwaybicyclepathrightofwayorpubliclyownedpropertyunlessthatpersoniswearingahelmetthatmeetstherequirementsofSection5ACNopersonshalltransportanotherpersonuponabicycleoranyothercyclenotpoweredbymotoronapublicroadwaybicyclepathrightofwayorpubliclyownedpropertyunlessthatotherpersoniswearingahelmetthatmeetstherequirementsofSection5ADNopersonshallrentlendorotherwiseallowanothertouseabicycleorcyclenotpoweredbymotoronapublicroadwaybicyclepathrightofwayorpubliclyownedfacilityunlessthatotherpersonpossessesahelmetthatmeetstherequirementsofSection5ASECTION6EnforcementAAviolationofthisregulationisdesignatedacivilinfractiontowhichtheprovisionsofRCW780shallapplyexceptassetforthhereafterBAnydulycommissionedlawenforcementofficerhavinglawenforcementauthorityattheplacewhereaviolationofthisregulationoccursisauthorizedtoenforcetheprovisionsofthisrequlationCAnypersonfoundtohavecommittedaviolationofthisregulationshallbeassessedamonetarypenaltyof30foreachsuchviolationnotincludingapplicablecourtcostsDThefirsttimeapersonhasbeenissuedanoticeofinfractionforviolationofthisordinanceifsuchpersonappearsinpersonbeforethePoliceDepartmentandsuppliesthePoliceDepartmentwithproofthatbetweenthedateofthenoticeofinfractionandtheappearancedatescheduledincourtthepersonpurchasedorshowsevidenceofpossessionof ahelmetthatmeetstherequirementsofthisordinancethecourtshalldismissthenoticeofinfractionwithoutcostsSECTION7EffectiveDateThisordinanceshalltakeeffectfive5daysafteritspublicationorthepublicationofasummaryofitsintentandcontentsPASSEDBYTHECITYCOUNCILONTHISIwDAYOF1993ANDSIGNEDINAuTENTICATIONOFITSPASSAGETHEDAYOFLc21993CRayCoryMayorApprovedastoformAttestXargaetRDavisCityClerk
