ISignificantTreesmeansanyevergreentreeofeightinchesindiameterorgreaterandanydeciduoustreeotherthanredalderwillowpoplarandcottonwoodtreesteninchesindiameterorgreatermeasuredonefourfcasixinchesfootabovetherootcrownLStreetdesignstandardmeansthetreedesignstandardsadoptedaspartofthecityscomprehensiveplanKMajorremodeladditionmeansaremodeloforanadditiontoanexistingresidencewhichconstitutesareconstructionundertheprovisionsofSection1760010Ord52131990MSensitiveAreasasdefinedinOrdinance560coveringsteepslopespondsandwetlandsstreamsandpotentialhabitat1228040PreservationofsignificanttreesThissectiondefinesthestandardsforthepreservationofsignificanttreeswithinthestreetarterialrightsofwaytherequiredsetbackareasandthebuildableareaAWithinStreetRightofwayandWithinFrctFirstFifteenFeetofRequiredFrontYardSetbackAdjoiningStreetRightofWayWherethepropertyabutsastreetrightofwaytheownershallretainallsignificanttreeswithinthestreetrightofwayandwithinthefrontfifteenfeetofthepropertywhichdonotconstituteasafetyhazardorinterferewithvehicularaccesstothepropertyTheareadevotedtovehicularaccesssightlinesatintersectionsandtheinstallationofutilitiesorstormdrainageshallbeminimizedUndergroundutilitiesshallbeplacedinthesameareaastheaccessdrivewhereverpossibleLandscapingforthestreetrightofwayandthefrontfifteenfootofthepropertyshallbeconsitrtontwiththecitysstreetdesignstandardsandanyreplacementplantingoradditionalplantingwithintheseareasshallbethespecieslistedonthecityslistofpreferredtreesshrubsandgroundcoversSignificanttreeswithintheadjoiningstreetrightofwayandthefrontfirstfifteenfeetofthepropertywhicharetoberemovedwillbereplacedwithintheseareasconsistentwiththerequirementsofSection1228050BWithinRequiredSetbackAreasOtherThanFrontFirstFifteenFeetofFrontYardSetbackSignificanttreesmayberemovedexceptinasensitiveareawithintheseportionsoftherequiredsetbackareasprovidedtheyarereplacedconsistentwiththerequirementsofSection1228050TheownerisencouragedtoretainallsignificanttreeswithintheremainingportionsofthefroutyardsetbackandotherrequiredsetbackareasthesideandrearyardsetbackareasTheportionoftheseareasdevotedtoaccessparkingutilitiesorstormdrainageshallbeminimizedUndergroundutilitiesaretobeplacedwithintheaccessdrivewhereverpossibleCWithintheAllowableBuildingAreaWithintheallowablebuildingareatheownerisencouragedtolocatestructuresdrivewaysparkingandotherimprovementstominimizetheremovalofsignificanttreesandothervegetationSpecialattentionshallbegiventopreservationofthefollowing1Healthysignificanttreesoversixtyfeetinheight2Significanttreeswhichformacontinuouscanopy3Significanttreeswhichcontributetothecharacteroftheenvironmentanddonotconstituteasafetyhazard4Significanttreeswhichprovidewinterwindprotectionorsummershade5Groupsofsignificanttreeswhichcreateadistinctiveskylinefeatureand6Treeswhichhaveahistoricalsignificancetothecommunity SignificanttreesinsensitiveareasofsuchassteepslopesoradjacenttowatercoursesorwetlandsmustmeettherequirementsofOrdinance560DReplacementofSignificantTreesRemovedPriortoDevelopmentorConstructionApplicationIfsignificanttreesareremovedfromabuttingstreetrightsofwayandortheregulatedrequiredportionsofthepropertyduringthetwentyfourmonthperiodimmediatelyprecedinganapplicationforapermitofthetypesreferencedinSection1228080theownershallberequiredtoreplaceallsuchsignificanttreesaspartofthetreeretentionreplacementplanconsistentwiththerequirementsofthischapterSetiora1228050and1228070Ord521419901228050ReplacementofsignificanttreesifremovedAAllsignificanttreestoberemovedfromtherequiredsetbackareasoronstreetrightsofwayshallbereplacedThenumberoftreestobereplacedshallequalhalfthetotalofthediametersofthetreestoberemovedieifonetwelveinchdiametertreeistoberemovedtherequiredreplacementwouldconsistoffourthreetwothreeinchtreesprovidedhoweverthatallreplacementtreesthataredeciduousmustbeatleastthreetwoinchesindiametermeasuredatfouronefeetfootabovetherootcrownandreplacementtreesthatareevergreenmustbeatleast12inheightReplacementtreesshallconsistofspecieslistedonthecityslistofpreferredtreesshrubsandFoundcoversBIftheplacementofthenumberoftreesrequiredbythisSectionAonasitewouldbeinconsistentwithacceptablelandscapepracticesasdeterminedbytheCitvsLandscapeArchitectafterareviewoftheapplicantsplansthepropertyownermayplanttheextratreesinthecitysstreetrightofwayorthecityspublicparksasdirectedbythedesignatedofficialorpayafeebasedontheeouivalentnumberoftreesbasedonaninstalledcostof250pertreewitha2Hcaliperandd0Opertreewitha3calipcrThesefundsshallbeutilizedforrightofwayorparkorlandscapingdonebytheCityCIftreesareremovedfromthecitystreetrightofwayorregulatedportionsofthepropertywithoutapprovaltheresponsiblepartyshallbesubjecttocivildamagesasstatedinSection12281001228060ReplacementofHistoricTreesifremovedAAlltreesdesignatedasbeinghistoricontheMedinaLandscapePlantoberemovedfromtherequiredsetbackareasoronstreetrightsofwayshallbereplacedwiththesamespeciesoftreeoranapprovedsubstituteonaoneforonebasisAllreplacementtreesmustbeatleastthreeinchesindiametermeasuredatonefootabovetherootcrownBIftreesdesignatedasbeinghistoricareremovedwithoutapprovaltheresponsiblepartyshallbesubjecttocivildamagesasstatedinSection12281001228070StandardsforlandscapingarterialstreetfightsofwayUnlessotherwisespecifiedintheeitvsMedinaLandscapePlanandstreetdesignstandardsthefollowingstandardswinapplytolandscapingwithintheplantableareaasdefinedinSection1228030ofthecitysarterialstreetrightsofwayabuttingthepropertyATreesPerLotThereshallbeaminimumofonetreeforeachthreehundredsquarefeetoftheplantableareawithinthestreetrightofwayabuttingthepropertyInnoeventhowevershalltherebefewerthantwotreeswithintheplantableareaofthestreetrightofwayabuttingthepropertyTherequirementsofthissectionmaybesatisfiedwithexistingtreesNewdeciduoustreeswillhaveaminimumcaliperoftwo2inchesnewevermeentreesshallbeaminimumofheightofeight8feet
