0576CITYOFMEDINAORDINANCENO576ANORDINANCETOREDUCETHENUMBEROFFALSEALARMSFROMBURGLARAiJRMSFOLLOWSTHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASSECTION1purposeItistheintentofthisordinancetoreducethenumberoffalsealarmsoccurringwithintheCityandtheresultantwasteofCityresourcesbyprovidingforcorrectiveadministrativeactionincludingfeesandpotentialdisconnectandorcriminalpenaltiesSECTION2DefinitionsInthisordinanceunlessadifferentmeaningplainlyisrequiredthedefinitionscontainedinthisordinanceshallapplyAAlarmBusinessmeansthebusinessbyanyindividualpartnershipcorporationorotherentityofsellingleasingmaintainingservicingrepairingalteringreplacingmovingorinstallinganyalarmsystemorcausingtobesoldleasedmaintainedservicedrepairedalteredreplacedmovedorinstalledanyalarmsysteminoronanybuildingstructureorfacilityBAlarmSystemmeansanyassemblyofequipmentmechanicalorelectricalarrangedtosignaltheoccurrenceofanunauthorizedorillegalentryorotheractivityrequiringurgentattentionandtowhichpoliceareexpectedtorespondCAlarmUsermeansthepersonfirmpartnershipassociationcorporationcompanyororganizationofanykindofcontrolofanybuildingstructureorfacilitywhereinanalarmsystemismaintainedDAutomaticDialingDevicemeansadevicewhichis interconnectedandisprogrammedtoselectapredeterminedtelephonenumberandtransmitbyvoicemessageorcodesignalanemergencymessageindicatinganeedforemergencyresponseEChiefofPoliceincludeshisdesigneeFFalseAlarmmeansanalarmsignalelicitingaresponsebypolicewhenasituationrequiringaresponsebythepolicedoesnotinfactexistItdoesnotincludeanalarmsignalcausedbyviolentconditionsofnatureorotherextraordinarycircumstancesnotreasonablysubjecttocontrolbythealarmbusinessoperatororalarmuserGInterconnectmeanstoconnectanalarmsystemincludinganautomaticdialingservicetoatelephonelineeitherdirectlyorthroughamechanicaldevicethatutilizesatelephoneforthepurposeofusingthetelephonelinetotransmitamessageuponactivationofthealarmsystemHResponseshallbedeemedtohaveoccurredwhenthepolicedepartmentbeginstoproceedtowardsthepremisesasaresultoftheactivationofthealarmSECTION3EmeruencvResponseCardItisunlawfultohaveormaintainonanypremisesanalarmsystemunlessthereisonfilewiththePoliceDepartmentanemergencyresponsecardcontainingthenameornamesandcurrenttelephonenumberornumbersofthepersonsauthorizedtoentersuchpremisesandturnofforresetanyalarmatallhoursofthedayandnightCardsforalarmsexistingasoftheeffectivedateofthisordinancemustbefiledwiththePoliceDepartmentwithinninety90daysofthedateuponwhichthisordinancebecomeseffectiveSECTION4FeesCorrectiveActionDisconnectionForpoliceresponsetoanyfalsealarmthecityshallchargeandcollectfromthealarmusersuchfeesasestablishedhereinXnadditiontotheimpositionoffeestheChiefofPoliceisauthorizedtoconductthefollowinginvestigationAForaresponsetopremisesatwhichnootherfalsealarmhasoccurredwithintheprecedingsixmonthperiodhereinafterreferredtoasafirstresponsenocivilpenaltyshallbechargedUponfirstresponsenoticeofconditionsandrequirementsofthischaptershallbegiventothealarmuseroroccupantofthepremisesonwhichthefalsealarmoccurredanduponwhichthealarmsystemislocatedBForasecondresponsetopremiseswithinsixmonths2 afterthefirstresponseacivilpenaltyofSeventyFiveDollars7500shallbechargedThealarmusershallwithinfiveworkingdaysafternoticetodosomakeawrittenreporttotheChiefofPoliceonprescribedformssettingforth1Thecauseofsuchfalsealarm2Thecorrectiveactiontaken3WhetherandwhensuchalarmhasbeeninspectedbyauthorizedservicepersonnelSuchotherinformationastheChiefofPolicemayreasonablyrequiretodeterminethecauseofsuchfalsealarmandanymitigatingcircumstancesandcorrectiveactionnecessaryTheChiefofPolicemaydirectthealarmusertohaveauthorizedservicepersonnelinspectthealarmatsuchpremisesandtotakeothercorrectiveactionasprescribedlbytheChiefofPoliceAllcostsofinspectionandcorrectiveactionshallbebornebythealarmuserhavingormaintainingthealarmonsaidpremisesCForathirdresponsetopremiseswithinsixmonthsafterasecondresponseandforallsucceedingresponseswithinsixmonthsofthelastresponseacivilpenaltyofOneHundredFiftyDollars15000shallbechargedandifsuchthirdfalsealarmoranysuchsucceedingfalsealarmoccursasaresultoffailuretotakenecessarycorrectiveactionprescribedUndersubsectionBofthissectiontheChiefofPolicemayorderthealarmusertodisconnectsuchalarmuntiltheprescribedcorrectiveactionistakenandcertificationofsuchcorrectiveactionisprovidedtothePoliceDepartmentprovidedthatnodisconnectionshallbeorderedrelativetoanypremisesrequiredbylawtohaveanalarmsysteminoperationSECTION5AdministrativeDecisionsNoticeANoticeofimpositionofanyadministrativesanctionincludingtheimpositionofacivilpenaltyororderofdisconnectionundertheprovisionsOfthisordinanceshallbesentbymailordeliveredpersonallytothealarmuserorapersonofsuitableaganddiscretionatthepremisesprovidedthatwithrespecttobusinesspremisesschoolsorchurchesmailingorpersonaldeliverytothemanagerorchiefadministrativeagentregularlyassignedandemployedonthepremisesatthetimeoftheoccurrenceofafalsealarmshallbepresumedtobedeliverytOthealarmuser BThenoticeshallspecifythesanctionsimposedandshalladvisethealarmuserthatunlessahearingisrequestedwiththeCityManagerassetforthinSection6thesanctionswillbedeemedfinalandnonappealableSECTION6ADDealfromAdministrativeDecisionFinalitYAAnypersonsubjecttotheimpositionofacivilpenaltyandoranorderofdisconnectionorotheradministrativesanctionunderthetermsofthisordinanceshallhavearightofappealtherefromtotheCityManageruponfilingatimelywrittennoticeBThenoticeofappealmustbemadeinwritingandfiledwiththeCityManagerwithinfifteen15daysofthedateofthenoticeofadministrativedecisionprovidedforinSection5orthedecisionsshallbedeemedfinalThenoticeshalldescribeallfactsrelieduponinsupportoftheappealUponreceiptofatimelywrittennoticetheCityManagershallconsidertherecordofpastfalsealarmsanycorrectiveactiontakenandanyinspectionreportsonthecauseofthefalsealarmIftheCityManagerdeterminesthatthefalsealarmuseroralarmusereemployeesoragentshaveestablishedthecauseofthefalsealarmandthatreasonablestepshavebeentakentocorrecttheproblemthecivilpenaltyorothersanctionmaybesuspendedinwholeorinpartTheCityManagershallkeepawrittenreportofthehearingincludingastatementofreasonsforwhateveractionistakenAnyappealfromtheCityManagersdecisionshallbetoacourthavingjurisdictionandmustbeperfectedbyfilingthesamewithinten10daysoftheissuancedateoftheCityManagersdecisionorbebarredSECTION7PavmentofCivilPenaltiesRequiredTheCityManagermayauthorizetheCityAttorneytocollectthefeesbyappropriatelegalactionThepersonresponsibleforpaymentofthecivilpenaltiesshallalsoberesponsibleforpaymentofallcostsincurredbytheCityincludingreasonableattorneysfeesSECTION8AutomaticDialinDeviseCertainInterconnectionsProhibitedItisunlawfulforanypersontoprogramanautomaticdialingdevicetoselectanytelephonelineassignedtotheCityItisunlawfulforanypersontofailtodisconnectorreprogramsuchdevicewithintwelve12hoursofreceiptofwrittennoticefromtheChiefofPolicetodisconnectorreprogramtheautomaticdialingdeviceAnypersonviolatingthissectionshallbeguiltyofamisdemeanor4
