communitythat08isanappropriatealcoholimpairmentstandardtheCouncilfindsthatthisstandardshouldbeadoptedintheCityofMedinaandWHEREAStheMedinaCityCouncilfindsthatadoptingalawconsistentwiththegreatweightofprofessionalandscientificadviceisintheinterestofthepublichealthsafetyandwelfareNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSSection1NewChapterAdded1014isherebyaddedtoTitle10AnewchapterChapteroftheMedinaMunicipalCodeChapter1014shallreadasfollows1014010DrivingWhileUnderInfluenceofIntoxicatingLiquororDrugWhatConstitutesApersonisguiltyofdrivingwhileundertheinfluenceofintoxicatingliquororanydrugifthepersondrivesavehiclewithintheCitywhileaThepersonhas008gramsormoreofalcoholpertwohundredtenlitersofbreathasshownbyanalysisofthepersonsbreathmadeunderMedinaMunicipalCodeMMC1014030orbThepersonhas008percentormorebyweightofalcoholinthepersonsbloodasshownbyanalysisofthepersonsbloodmadeunderMMC1004030orcThepersonisundertheinfluenceoforaffectedbyintoxicatingliquororanydrugordThepersonisunderthecombinedinfluenceofor2 affectedbyintoxicatingliquorandanydrugThefactthatanypersonchargedwithaviolationofthissectionisorhasbeenentitledtousesuchdrugunderthelawsofthisstateshallnotconstituteadefenseagainstanychargeofviolatingthissection1014020ActualWhileUnderInfluenceofConstitutesDefensesPhysicalControlofIntoxicatingLiquorMotorVehicleorDrugWhatApersonisguiltyofbeinginactualphysicalcontrolofamotorvehiclewhileundertheinfluenceofintoxicatingliquororanydrugifthepersonhasactualphysicalcontrolofavehiclewithintheCitywhileaThepersonhas008gramsormoreofalcoholpertwohundredtenlitersofbreathasshownbyanalysisofthepersonsbreathmadeunderMMC1004030orbThepersonhas008percentormorebyweightofalcoholinthepersonsbloodasshownbyanalysisofthepersonsbloodmadeunderMMC104030orcThepersonisundertheinfluenceoforaffectedbyintoxicatingliquororanydrugordThepersonisunderthecombinedinfluenceoforaffectedbyintoxicatingliquorandanydrugThefactthatanypersonchargedwithaviolationofthissectionisorhasbeenentitledtousesuchdrugunderthelawsofthisstateshallnotconstituteadefenseagainstanychargeofviolatingthissectionNopersonmaybeconvicted3 underthissectionifpriortobeingpursuedbyalawenforcementofficerthepersonhasmovedthevehiclesafelyofftheroadway1014030PersonsUnderInfluenceofIntoxicatingLiquororDrugEvidenceTestsInformationConcerningTestsaUponthetrialofanycivilorcriminalactionorproceedingarisingoutofactsallegedtohavebeencommittedwithintheCitybyanypersonwhiledrivingorinactualphysicalcontrolofavehiclewhileundertheinfluenceofintoxicatingliquororanydrugiftheamountofalcoholinthepersonsbloodorbreathatthetimeallegedasshownbyanalysisofthepersonsbloodorbreathislessthan008percentbyweightofalcoholinhisorherbloodor008gramsofalcoholpertwohundredtenlitersofthepersonsbreathitisevidencethatmaybeconsideredwithothercompetentevidenceindeterminingwhetherthepersonwasundertheinfluenceofintoxicatingliquororanydrugbThebreathanalysisshallbebasedupongramsofalcoholpertwohundredtenlitersofbreathTheforegoingprovisionsofthissectionshallnotbeconstruedaslimitingtheintroductionofanyothercompetentevidencebearinguponthequestionwhetherthepersonwasundertheinfluenceofintoxicatingliquororanydrugcAnalysisofthepersonsbloodorbreathtobeconsideredvalidundertheprovisionsofthissectionorMMC4 1014010OrMMC1014020shallhavebeenperformedaccordingtomethodsapprovedbythestatetoxicologistandbyanindividualpossessingavalidpermitissuedbythestatetoxicologistforthispurposePursuanttoRCW4661506thestatetoxicologistisdirectedbytheStatetoapprovesatisfactorytechniquesormethodstosupervisetheexaminationofindividualstoascertaintheirqualificationsandcompetencetoconductsuchanalysesandtoissuepermitswhichshallbesubjecttoterminationorrevocationatthediscretionofthestatetoxicologistdWhenabloodtestisadministeredundertheprovisionsofRCW4620308thewithdrawalofbloodforthepurposeofdeterminingitsalcoholiccontentmaybeperformedonlybyaphysicianaregisterednurseoraqualifiedtechnicianThislimitationshallnotapplytothetakingofbreathspecimenseThepersontestedmayhaveaphysicianoraqualifiedtechnicianchemistregisterednurseorotherqualifiedpersonofhisorherchoosingadministeroneormoretestsinadditiontoanyadministeredatthedirectionofalawenforcementofficerThefailureorinabilitytoobtainanadditionaltestbyapersonshallnotprecludetheadmissionofevidencerelatingtothetestortesttakenatthedirectionofalawenforcementofficerfUpontherequestofthepersonwhoshallsubmittoatestortestsattherequestofalawenforcementofficer5
