siteconditionsincludingsignificanttreestopographyandsensitiveareasandrelationshipofthepropertytoadjacentpropertiesstructuresprivatelanesandstreetsTheproposedconstructionmitigationplanwillinclude1Lengthofconstructiontime2Methodsofconstxuctiontominimizeimpactsonadjacentproperties3Routesinareaforremovalofexcavatedmaterialsandmaterialdelivery4Parldnglocationsforconstructionworkers5Hoursofoperation6RestorationofCitystreetsifdamaged7Specificmitigationbasedonthespecificsiteorproposedconstruction8Provisionsfornotifyingneighborhoodofsignificantconstructionactivities9ConsiderationofadverseenvironmentalimpactstosensitiveareasassetforthintheCitysSensitiveAreasOrdinanceDesignlionofanindividualtoenforcecompliancewiththeplan10DTheconstructionschedulewillestablishadatecertainforthecompletionofallmajoractivitiesrelatingtothedesignandengineeringandtotheconstractionTheconstructionscheduleshallbeupdatedeverythreemonthsafterthecommencementofanyconstructionorrelatedactivitiesSECTION2REVIEWANDAPPROVALOFCONSTRUCTIONMITIGATIONPLANThefinalconstructionmitigationplanmustbeapprovedbytheMedinaHarmingCommissionpriortotheissuanceofanypermitsforgradingorconstructionPriortosubmittaltothePlanningCommissiontheproposedmitigationplanwillbereviewedbytheCitysRepresentativeasdesignatedbytheCityManagerAttherequestoftheCitysRepresentativetheproposedmitigationplanwillbereviewedbytheBuildingOfficialCityEngineerorsuchotherconsultantsasmaybereasonablynecessaryThefinalconstructionmitigationplanshallincludeaconstructionscheduleandmayincludeprovisionsforanyoftheitemsdescribedinSection4CTheMedinaPlanningCommiqsionshallnotberequiredtoapproveanymitigationplanthatdoesnotprovidereasonablemitigationfortheadverseconsequencesoftheproposedconstructiononadjacentandneighboringpropertiesandupontheCityasawholeSECTION3REVISIONOFMITIGATIONPLANTheMitigationPlanmayberevisedfromtimetotimetomodifymitigationmeasureswhicharenotprovidingadequatemitigationtoeliminatemitigationmeasuresthatarenolongerrequiredortodealwithadverseeffectswhichwerenotmitigatedagainstintheoriginalMitigationPlanModificationsmaybemadebyagreementbetweentheapplicantandtheCitysRepresentativeIntheabsenceofanagreementeitherpartymaysubmitdieproposedrevisionstotheMedinaPlanningCommissionSECTION4APPEALAnyaggrievedpartymayappealadecisionoftheMedinaPlanningCommissionwhichgrantsordeniesappwvalofafinalconstructionmitigationplantotheMedinaCityCouncilNoticeofappealmustbefiledwiththeMedinaCityClerkwithintwo2 weeksoftheltofthemeetingatwhichthedecisiontograntordenythefmalconstructionmitigationplanwasannouncedSECTION5VIOLATIONSANDPENALTIESAViolations1ItisaviolationoffixisordinanceforanypersontousecoustruaorallowanysUucmrewithintheCityofMedinathatviolatesanyoftheprovisionsofthisordinance2ItisaviolationofthisordinanceforanypersontofailtocomplywiththetermsofafinalConstructionMitigationPlanoranyrevisionstheretoincludingtheconstructionscheduleincorporatedinsaidMitigationPlanorrevisionsBNoticeofViolationIfafterinvestigationtheCitysRepresentativedeterminesthatthestandardsorrequirementsofthisordinanceoranyMitigationPlanorrevisionstheretohavebeenviolatedtheCitysRepresentativeshallservenoticeofviolationupontheownercontxactororotherpersonresponsiblefortheconditionThenoticeofviolationshallstatescparatelyeachsmdardorrequirementviolatedshallsmIewhatcorrectiveactionffanyisnecessarytocomplywiththestandardsorrequirementsandshallsetareasonabletimeforcomplianceThenoticeshallbeservedupontheownercontractororotherpersonresponsiblefortheconditionbypersonalserviceorcertifiedmailwithreturnreceiptrequestedaddressedtothelastknownaddressofsuchpersonAcopyofthenoticeshallbepostedataconspicuousplaceonthepropertycontainingthesiteoftheviolationAnoticemaybemendedatanytimetocorrectclericalordersorciteadditionalauthorityforastatedviolationCCivilPenaltyInadditiontoanyothersanctionorremidialprocedurewhichmaybeavailableanypersonviolatingorfailingtocomplywiththeprovisionsofthisordinanceshallbesubjecttoacumulativepenaltyinthemountof500perdayforeachviolationfromthedatesetforcomplianceThepenaltyimposedbythissectionshallbecollectedbycivilactionbroughtinthenameoftheCityDCriminalPenaltiesAnypersonviolatingorfailingtocomplywithanyoftheprovisionsofthisordinanceshallbesubjecttocriminalprosecutionanduponconvictionshallbefreedinasumnotexceeding1000orbeimprisonedforatermnotexceedingthirty30daysorbebothfinedandimprisonedEachdayofnoncompliancewiththepwvisionsofthisordinanceshallconstituteaseparateoffenseEStopWorkOrderWheneveracontinuingviolationofthisordinanceoccurstheCitysRepresentativemayissueaStopWorkOrderwithorwithoutnoticespecifyingtheviolationandprohibitinganyworkorotheractivityatthesiteAfailuretocomplywithaStopWorkOrdershallconstituteaviolationofthisordinance
