HomeMy WebLinkAboutOrdinance No. 0598CITYOFMEDINAORDINANCENO598ANORDINANCERELATINGTOTHEVACATIONOFAPORTIONOF73RDAVENUENORTHEASTINTHECITYOFMEDINAWHEREASapetitionforstreetvacationdatedSeptember261994wasfiledbyWilliamHGatesIIIPetitionerwiththeCityofMedinatheCity0andcontainedthefollowingreasonsforthedesiredvacationaPetitionerwillagreetoconstructanimprovedturnaroundtoCityspecificationstoimprovetheCitysvehicularcirculationon73rdAvenueNortheastinpartialexchangefortheportionof73rdAvenueNortheastsoughttobevacatedbVacationwilllessentheneedfortheCitytorespondtopotentialsecurityandtrafficproblemsalong73rdAvenueNortheastinvolvingcuriouspassersbybyreducingtheamountofPetitionerspropertythatabuts73rdAvenueNortheastandincreasingthedistanceofthelowergatefromtheactualresidencecVacationwillrelievetheCityofresponsibilityandcostsassociatedwiththemaintenanceandadministrationofthevacatedportionoftherightofwayandofliabilityfortherightofwaydVacationwilladdpropertytotheCitystaxrollsandeVacationwillnototherwiseresultinnegativeeffectsontheCitysvehicularbicycleorpedestriancirculationsystemsoronaccesstotheshorelineor neighboringpropertyWHEREASPetitioneristhesoleownerofpropertyabuttingbothsidesoftheportionof73rdAvenueNortheastsoughttobevacatedand73rdAvenueNortheastprovidesnoshorelineaccessandnodestinationaccessbuttoPetitionerspropertyintheportionsoughttobevacatedWHEREASAudreyHousetheonlyownerofpropertyabuttingacornerthesouthwestcorneroftheportionof73rdAvenueNortheastsoughttobevacatedandlyingacrossthestreetfromtheexistingturnaroundon73rdAvenueNortheastindicatedhersupportforthepetitionforastreetlettertotheMedinaCityCouncildatedJulyvacationina191994andWHEREASapublichearingonthestreetvacationtookplacebeforetheMedinaCityCouncilonNovember141994andhavingheardandconstruedalltestimonyanddocumentaryevidenceproducedtheCouncilwassatisfiedthatprovidedcertainconditionsuponthegrantofstreetvacationaremetsaidportionof73rdAvenueNortheastisuselessaspartoftheCitystreetsystemandthattheimmediateneighborhoodandthepublicwillbebenefitedbyitsvacationandabandonmentTHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSSection1GrantofVacationofaPortionof73rdAvenueNortheastThepetitiontovacateaportionof73rdAvenueNortheastshallbegrantedbyfinalorderofvacationuponsatisfactionofthefollowingconditions2 aPaymentbyPetitionerofonehalfoftheassessedvalueofthestreetbeingvacatedbasedupontheassessedvalueonasquarefootagebasisoftheadjacentrealpropertybPaymentbyPetitionerofallreasonableconsultingcostsincurredbytheCitycAgreementbyPetitionertoconstructathissolecostandexpenseanimprovedturnaroundtobelocatedintheCityrightofwayatalocationandinaccordancewithaplanapprovedbymotionoftheCityCouncilsuchlocationandplantakingintoaccounttheconcernsofAudreyHousetheonlyownerofpropertylyingacrossthestreetfromtheexistingturnaroundanddIdentificationandreservationofeasementsforexistingutilitiesinaformacceptabletosaidutilitiesPugetPowerandtheBellevueWaterDepartmentThefinalorderofvacationshalllegallydescribetheportionof73rdAvenUeNortheastbeingvacatedandshallreservetotheCitytherighttograntfutureeasementsforpublicutilitiesandservicesprovidedsucheasementsshallbelocatedbelowgroundiffeasibleSuchvacationshallnothoweverprejudiceprivaterightsprivateeasementsprescriptiverightsrightsofaccessingressegressorpassageSection2EffectiveDateThisordinanceshalltake3 effectfive5daysafteritspublicationorthepublicationofasnmmaryofitsintentandcontentsPASSEDBYTHECITYCOUNCILONTHIS14THDAYOFNOVEMBER1994ANDSIGNEDINAUTHENTICATIONOFITSPASSAGETHEewyTaylrMaorApprovedastoformKirkRWinesCityAttorneyAttestFiledwithCityClerkPublishedEffectiveDatemed59S4
