0604CITYOFMEDINAORDINANCENO604ANORDINANCEALLOWINGACCESSORYDWELLINGUNITSINRESIDENTIALZONESESTABLISHINGDEVELOPMENTDESIGNANDOWNEROCCUPANCYREQUIREMENTSADDINGANEWDEFINITIONTOCHAPTER1712ANDADDINGANEWCHAPTERTOTHEMEDINAMUNICIPALCODEWHEREASthecountywideplanningpoliciesadoptedbyKingCountyrequiremunicipalitiesinKingCountytodemonstratetheirabilitytoaccommodatesufficientaffordablehousingforalleconomicsegmentsofthepopulationandtorevisetheirdevelopmentstandardstoprovideopportunitiesforarangeofhousingtypesforlowandmoderateincomehouseholdsandWHEREAStheCityofMedinaasamunicipalitywithapopulationundertwentythousandisexemptfromheGrowthManagementActrequirementtoadoptaccessorydwellingregulationsandWHEREASeventhoughtheCityisexempttheadoptionofaccessorydwellingunitregulationsisamethodofmeetingtheaffordablehousinggoalsofthecountywideplanninpoliciasandWHEREAStheadoptionofanaccessorydwellingunitordinancewillbenefittheresidentsoftheCitybyallowingseparatebutcloselivingquartersandWHEREAStheadoptionofregulationsXoraccessorydwellingunitswillpreservethecharacterofexistingneighborhoodsinsurethatnewaccessorydwellingunitsaresafelyconstructedaccordingtoallapplicablecodesandallowexistingaccessorydwellingunitsawayinwhichtobecomelegallyconformingnowthereforeTHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSSECTION1DEFINITIONAnewdefinitionisaddedtoMedinaMunicipalCodeSection1712010BtoreadasfollowsAccessoryDwellingUnitmeansadwellingUnitsubordinatetoasinglefamilydwellingunitwhich1islocatedwithinthesinglefamilydwellingunitor2islocatedwithinanaccessory buildingasdefinedinMMC1748010SECTION2AnewchapterisherebyaddedtotheMedinaMunicipalCodetoreadasfollows17010permittedusesAccessorydwellingunitsarepermittedusesinallresidentialzoningdistrictssubjecttotherequirementssetforthinthischapterandtherequirementsoftheindividualdistrict17020ExemptionsAExistingaccessorydwellingunitswhichcompliedwithzoningandlanduseregulationsineffectatthetimeoftheirconstructionaredeclaredtobenonconformingstructuresregulatedbyMMC1760030BExistingaccessorydwellingunitswhichdidnotcomplywithIzoningandlanduseregulationsineffectatthetimeoftheirconstructionmaynotbemaintainedunlesstheownersthereofapplyforallnecessarypermitsandcomplywithalloftherequirementsofthischapterwithineighteenmonthsaftersoapplyingCSeparateresidentialstructuresarenotsubjecttotheprovisionsofthisordinanceSeMMC174801017030GeneralRequirementsACompliancewithApplicableCodesaccessorydwellingunitsshallcomplywiththischapterandallotherapplicablecodesincludingbutnotlimitedtotheBuildingandZoningCodesBCertificationbycitvofBellevueUtilitiesDepartmentAcertificationmustbeprovidedbytheBellevueUtilitiesDepartmentthatthewatersupplyandsewagedisposalfacilitiesfortheaccessorydwellingunitareadequatetoservetheunitcContainedwithinStructureTheaccessorydwellingunitmustbefullycontainedwithinandmadeepartofasinglefamilydwellingoranaccessorybuildingpermittedunderMMC1748010DLimitationonNumberOnlyoneaccessorydwellingunitmaybecreatedperonesinglefamilyl includeatoiletsinkandashowerorbathtuband2KitchenorfoodstorageandpreparationfacilitiesandaSink17040InspectionandReuistrationAReuuirementofReqistrationAnypropertyownerseekingtoestablishalegalaccessorydwellingunitshallapplytoregistertheunitwiththeBuildingOfficialTheapplicationshallprovidethatthepropertyowneragreestooccupyeitherthesinglefamilydwellingortheaccessorydwellingunitandagreestomaintaintheaccessorydwellingunitincompliancewiththestandardssetforthinthischapterBActionsbvBuildinOfficialAfterreceiptofacompleteapplicationtheBuildingOfficialshallobservethepropertytoconfirmthatthestandardsofthischapteraremetpriortoissuingapprovaloftheaccessorydwellingunit1NewconstructionNewconstructionshallbesubjecttoallrequirementsoftheBuildingCode2ExistinConstructionExistingconstructionshallbesubjecttoallrequirementsoftheBuildingCodewhichwasinexistenceatthetimeofconstructionCRecordationAfterapprovalaregistrationformsignedbytherecordholdersofthepropertyshallberecordedwiththeKingCountyDepartmentofRecordsandElectionsSaidregistrationformshallcontainthestreetaddressandlegaldescriptionofthepropertyshalldescribetherequirementofowneroccupancyandshallsetforththerequirementformaintainingtheaccessorydwellingunitincompliancewiththerequirementsofthischapterDCancellationofReaistratioTheregistrationoftheaccessorydwellingunitmaybecancelledbythepropertyownerbyrecordingacertificateofCancellationinaformsatisfactorytotheBuildingOfficialwiththeKingCountyDepartmentofRecordsandElectionsTheBuildingOfficialmayrecordanoticeofcancellationuponfailuretocomplywiththestandardssetforthinthischapterEFeesAnapplicationfeeof10000plusallconsultingcostsshallbepaidThisfeemaybe4
