SECTION5OPENRECORDPUBLICHEARINGSBeforeactingononeoftheprojectpermitapplicationssetforthinSection3thereviewingagencyshallconductanopenrecordpublichearingTheburdenofproofshallbeontheapplicantTheapplicationmustbesupportedbyproofthatitconformstotheapplicableelementsoftheCitysdevelopmentregulationscomprehensiveplanandzoningcodePriortotheopenrecordpublichearingCitystaffshallsubmitasinglereportdescribingalldecisionsorrecommendationsmadeonprojectpermitsthatdonotrequireanopenrecordpublichearingThereportshallstateanymitigationmeasuresrequiredorproposedThereportshallincludeorappendanythresholdenvironmentaldeterminationotherthanadeterminationofsignificanceInadditiontoanyrulesadoptedbythereviewingagencythefollowingrulesofprocedureshallapplyAAmemberofthereviewingagencywhoisdisqualifiedshallbecountedforpurposesofformingaquorumAnymemberwhoisdisqualifiedshallmakefulldisclosuretotheaudienceabstainfromexpressinganyopinionorvotingontheproposalandphysicallyleavethehearingroomIfoneormorealternatemembersoftheBoardofAdjustmentorPlanningCommissionhavebeenappointedbytheCityCouncilThealternatesshallserveinplaceofanyabsentordisqualifiedmembersBIfallmembersofthehearingbodyaredisqualifiedallmemberspresentafterstatingtheirreasonsfordisqualificationshallberequalifiedandshallproceedtoresolvetheissuesCAmemberabsentduringthepresentationofevidenceinahearingmaynotparticipateinthedeliberationsordecisionunlessthememberhasreviewedtheevidencereceivedandshallnotbecountedindeterminingifaquorumispresentDAnymemberofthehearingbodymayviewtheareatowhichtheapplicationpertainswithorwithoutnoticetothepartiesEPriortohearingevidenceontheapplicationeachmemberofthereviewingagencyshallstatethetimemannerandcircumstancesofanyviewoftheareatowhichtheapplicationpertainsandofallexpartscommunicationspertainingtotheapplicationFThepresidingofficershalldescribeallwritten3 reviewingagencyindenyinganapplicationshallbegivenspecialconsideration2Irregularityinthehearingofthereviewingagencypreventingapartyfromhavingafairhearing3Newlydiscoveredmaterialevidencewhichthepartyapplyingforreconsiderationcouldnothavediscoveredandproducedatthehearingwithreasonablediligence4ErrorsinlawobjectedtoatthetimebythepartyfilingtherequestforreconsiderationSECTION6APPEALSAExceptforappealsfromdecisionsrelatingtoSubstantialDevelopmentPermitswhicharegovernedbystatelawandproceduresalldecisionsofthePlanningCommissionmaybeappealedbyanaggrievedpartywhoparticipatedinthedecisiontotheCityCouncilbyfilinganoticeofappealwithinten10daysofthedecisionTheappealshallbeaclosedrecordappealasdefinedinSection402Chapter347Lawsof1995BAlldecisionsoftheBoardofAdjustmentortheCityCouncilmaybeappealedbyfilingalandusepetitioninKingCountySuperiorCourtSuchpetitionmustbefiledwithintwentyone21daysofnotificationofissuanceofthedecisionCUponthefilingofamotionforreconsiderationthetimeforappealshallnotcommencetorununtilsuchrequestisdeniedoruntilnotificationoftheissuanceofadecisionfollowingthegrantofarequestforreconsiderationSECTION7JOINTPUBLICHFRINGSAAttherequestoftheapplicanttheCitymaycombineanypublichearingonaprojectpermitapplicationrequiringreviewbyareviewingagencywithanyhearingthatmaybeheldbyanotherlocalstateregionalfederalorotheragencyontheproposedactionaslongas1thehearingisheldwithintheCitylimits2thehearingcanbeheldwithinthetimeperiodsfordecidingtheapplicationortheapplicantagreestoadifferentscheduleand3therequirementsofsubsectionBbelowaremetBAjointpublichearingmaybeheldwithanotherlocalstateregionalfederalorotheragencyandaCityreviewingagencyaslongas1theotheragencyisnotexpresslyprohibitedbystatutefromdoingso2sufficient5 noticeofthehearingisgiventomeeteachoftheagencysadoptednoticerequirementsand3theotheragencyhasreceivedthenecessaryinformationabouttheproposedprojectinenoughtimetoholditshearingatthesametimeastheCityreviewingagencySECTION8NOTICEOFAPPLICATIONAGenerallyallprojectpermitreviewingagencyAnoticeofapplicationshallissueonapplicationsrequiringreviewbyaBContentsThenoticeofapplicationshallinclude1Thedateofapplicationthedateofnoticeofcompletionfortheapplicationandthedateofthenoticeofapplication2AdescriptionoftheproposedprojectactionalistoftheprojectpermitsincludedintheapplicationandifapplicablealistofanystudiesrequestedbytheCityinthenoticeofcompletion3TheidentificationofotherpermitsnotincludedintheapplicationtotheextentknownbytheCity4Theidentificationofexistingenvironmentaldocumentsthatevaluatetheproposedprojectandthelocationwheretheapplicationandanystudiescanbereviewed5Astatementofthelimitsofthepubliccommentperiodwhichshallbenotlessthanfourteen14normorethanthirty30daysfollowingthedateofnoticeofapplicationandstatementsoftherightofanypersontocommentontheapplicationreceivenoticeofandparticipateinanyhearingsrequestacopyofthedecisiononcemadeandanyappealrights6Thedatetimeplaceandtypeofhearingifapplicubleandscheduledatthedateofthenoticeofapplication7AstatementofthepreliminarydeterminationifonehasbeenmadeatthetimeofnoticeofconsistencywithdevelopmentregulationsandofthosedevelopmentregulationsthatwillbeusedforprojectmitigationandtodetermineiftheprojectisconsistentwithCitydevelopmentregulationsorintheabsenceofspecificregulationstheCityscomprehensiveplan8Anyotherinformationdeterminedappropriatebythe
