CITYOFMBDINAORDINANCENO609THECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSANORDINANCEESTABLISHINGAPPROPRIATELOCATIONSREGULATIONSANDDEVELOPMENTSTANDARDSFORWIRELESSCOMMUNICATIONFACILITIESPROVIDINGFORPERIODICREVIEWESTABLISHINGPERMITLIMITATIONSREPEALINGMEDINAMUNICIPALCODESECTION1752070ANDRESOLUTIONSNO236AND237ANDPROVIDINGFORREINSTATEMENTOFAMORATORIUMONTHEISSUANCEOFPERMITSIFANYSECTIONOFTHISORDINANCEISFOUNDTOBEVOIDSECTION1PURPOSEThepurposeofthisordinanceistoestablishappropriatelocationssitedevelopmentstandardsandpermitrequirementstoallowforwirelesscommunicationservicestotheresidentsoftheCityinamannerwhichwillfacilitatethelocationofvarioustypesOfwirelesscommunicationfacilitiesinpermittedlocationssotheyareconsistentwiththeresidentialcharacteroftheCityThenatureofresidencestheirscaleheightandmasstheirproximitytoeachotherandthestreetandtheextensivenaturalinformallandscapingallcontributetothisdistinctivesettingMinimizingtheadversevisualimpactofthesefacilitieswithinthisvirtuallydevelopedresidentialareaisoneoftheprimaryobjectivesofthisordinanceLimitationsoftheheightofantennasareintendedtoconformtheantennastotheexistinglimitationsofheightofresidentialbuildingsTheordinanceisintendedtoallowwirelesscommunicationfacilitieswhicharesufficienttoallowadequateservicetocitizensthetravelingpublicandotherswithintheCityandtoaccommodatetheneedforconnectionofsuchservicestowirelessfacilitiesinadjacentandsurroundingcommunitiesSECTION2DEFINITIONSAntennameansthespecificdevicethesurfaceofwhichisusedtocaptureanincomingandortotransmitanoutgoingradiofrequencysignalAntennasincludethefollowingtypes OmniDirectionalorwhipAntennareceivesandtransmitssignalsina360degreepatternandwhichisupto15feetinheightandupto4inchesindiameterDirectionalorpanelAntennareceivesandtransmitssignalsinadirectionalpatterntypicallyencompassinganarcof120degreesParabolicordishAntennaabowlshapeddevicethatreceivesandtransmitssignalsinaspecificdirectionalpatternAncillaryAntennaanantennathatislessthan12inchesinitslargestdimensionandthatisnotdirectlyusedtoprovidepersonalwirelesscommunicationsservicesAnexamplewouldbeaglobalpositioningsatelliteGPSantennaOtherAllothertransmittingorreceivingequipmentnotspecificallydescribedhereinshallberegulatedinconformitywiththetypeofantennadescribedhereinwhichmostcloselyresemblessuchequipmentColocationmeanstheuseofasinglesupportstructureandorsitebymorethanonewirelesscommunicationsproriderEquipmentEnclosuremeansasmallstructuresheltercabinetorvaultusedtohouseandprotecttheelectronicequipmentnecessaryforprocessingwirelesscommunicationssignalsAssociatedequipmentmayincludeairconditioningandemergencygeneratorsSupportStructuremeansthestructuretowhichantennaandothernecessaryassociatedhardwareismountedSupportstructuresincludebutarenotlimitedtothefollowingLatticeTowerasupportstructurewhichconsistsofanetworkofcrossedmetalbracesformingatowerwhichisusuallytriangularorsquareincrosssectionMonopoleasupportstructurewhichconsistsofasinglepolesunkintothegroundandorattachedtoafoundation2 ExistingNonresidentialStructureexistingstructuresasspecifiedinSection3towhichantennasmaybeattachedwhichconformtotherequirementsofSection3WirelessCommunicationsFacilityWCFmeansanunstaffedfacilityforthetransmissionandreceptionofradioormicrowavesignalsusedforcommercialcommunicationsWCFsarecomposedoftwoormoreofthefollowingcomponentsabcdAntennaSupportStructureEquipmentEnclosureSecurityBarrierSECTION3PERMITTEDLOCATIONSAWCFsmaybemountedIonallcurrentlyexistingnonresidentialbuildingsexceptasfollowsTheMedinaCityHallandtheMedinaStorewhichareexceptedbecauseoftheirhistoricarchitecturalsignificanceAnybuildingwhichisanaccessorystructuretoaresidenceBuildingswhichduetotheirsmallsizewouldbedominatedbythefacilitysuchastherestroomsatMedinaParkBBuildingMountedWCFsmustmeetthefollowingconditionsandcriteriaAbuildingmountedWCFmayconsistofoneofthefollowingaUptofournonreflectivepanelantennasNooneantennashallexceed480squareinchesandthetotalofthecombinedantennasshallnotexceed1440squareinchesofsurfaceareaorbOnewhipantennaorcOnenonreflectiveparabolicdish1orlessindiameterdIntheeventofcolocationmorethanoneofthefacilitiesdescribedabovemaybeincluded3 InadditiontotheoverallheightlimitationsinSection4theantennasmustconformtothefollowingheightrestrictionsrelatingtotheexistingbuilding5measuredtothetopofapanelantennaabovetheroofproperoftheexistingbuildingatthepointofattachment10measuredtothetipofawhipantennaabovetheroofproperoftheexistingbuildingatthepointofattachment5measuredtothetopofaparabolicdishabovetheroofproperoftheexistingbuildingatthepointofattachmentWhipantennasshallbecamouflagedandlocatedtominimizeviewsfromresidentialstructuresandrightsofwayPanelandparabolicantennasshallbecompletelyscreenedfromresidentialviewsandpublicrightsofwayinamannerthatisarchitecturallycompatiblewiththebuildingonwhichitislocatedEquipmentenclosuresshallbelocatedwithinthebuildinginwhichthefacilityisplacedorlocatedundergroundifsiteconditionspermitOtherwiseequipmentenclosuresshallbescreenedfromviewbycompatiblewallfencesorlandscapingCWCFsrequiringconstructionofasupportstructuremaybelocatedonthesiteofexistingnonresidentialusesexceptthefollowingAllportionsofallcityparksexceptthatportionofMedinaParkwhichissubstantiallyshelteredfrompublicviewbytheCityShopandthePugetPowerSubstationAreaswheresupportstructuresmaynotbeeffectivelyscreenedfromviewbyexistingstructures4 Areaswheresupportstructurescannotbelocatedatleast50feetfromthenearestresidentialusepropertylineorthenearestvacantpropertyzonedforresidentialusemeasuredfromthepropertylineWCFsrequiringconstructionofasupportstructuremustbelocatedonaportionofthesitethatiseffectivelyisolatedfromviewofresidentialareasbystructuresorterrainfeaturesunlesstheyareintegratedoractasanarchitecturalelementofthestructuresuchasaflagpoleWCFsarenotallowedonresidentialpropertiesoronCityrightsofwaySECTION4PERMITTEDHEIGHTWCFsutilizingafreestandingsupportstructureshallbelimitedto35inheightaboveoriginalgradeincludingtheheightofattacheddirectionalparabolicandancillaryantennasOmnidirectionalantennasandsupportingstructuresshallbelimitedto40inheightaboveoriginalgradeSECTION5SITEDEVELOPMENTSTANDARDSFreestandingWCFsshallconformtothefollowingsitedevelopmentstandardsSupportstructuresshallbesetbackfromallresidentialpropertylinesadistanceequaltotheheightofthesupportstructureplustheheightofanyantennasandshallcomplywithallrequiredsetbacksofthezoningdistrictinwhichitislocatedSupportstructuresshallbedesignedandplacedonthesiteinamannerthattakesmaximumadvantageofexistingtreesmaturevegetationandstructuressoastoUseexistingsitefeaturestoscreenasmuchofthetotalWCFaspossiblefromprevalentviewsandor UseexistingsitefeaturesasabackgroundsothatthetotalWCFblendsintothebackgroundwithincreasedsightdistancesRelocationofaproposedfacilityonthesiteandinfilllandscapingofmatureplantmaterialsconsistentwithlandscapingoftheCitymayberequiredbythePlanningCommissiontomakethebestuseofortosupplementexistingtreesandvegetationtomoreeffectivelyscreenthefacilitySupportstructurespanelandparabolicantennasandanyassociatedhardwareshallbepaintedanonreflectivecolorUrcolorschemeappropriatetothebackgroundagainstwhichtheWCFwouldbeviewedfromamajorityofpointswithinitsviewshedNaturalcolorsonlymaybeemployedandthefinalcolorsandcolorschememustmeettheapprovalofthePlanningCommissionEquipmentenclosuresshallconformtothefollowingEquipmentenclosureswillbeplacedundergroundifsiteconditionspermitandiftechnicallyfeasibleEquipmentenclosuresshallbescreenedfromviewexceptasprovidedincbelowWalkinequipmentenclosures1Maynotbeconstructedwithexposedmetalsurfaces2MaynotberequiredtobetotallyscreenedfromviewprovidedthePlanningCommissionfindsthataThewalkinequipmentenclosurehasbeendesignedusingmaterialscolorsanddetailingthatproducesastructurewhichemulatestheresidentialcharacteroftheCitySecurityfencingifusedshallconformtothefollowingaNofenceshallexceedsixfeetinheight bSecurityfencingshallbeeffectivelyscreenedfromviewthroughtheuseofappropriatelandscapingmaterialsconsistentwithMedinalandscapingstandardscChainlinkfencesshallbepaintedorcoatedwithanonreflectivecolorThePlanningCommissionshallconsiderthecumulativevisualeffectsofWCFsmountedonexistingstructuresandorlocatedonagivenpermittedsiteindeterminingwhetheradditionalpermitscanbegrantedsoastonotadverselyeffectthecharacterofthecitySECTION6COLOCATIONApermitteeshallcooperatewithotherWCFprovidersincolocatingadditionalantennasonsupportstructuresandoronexistingbuildingsprovidedsaidproposedcolocatorshavereceivedaSpecialUsePermitforsuchuseatsaidsitefromtheCityApermitteeshallexercisegoodfaithincolocatingwithotherprovidersandsharingthepermittedsiteprovidedsuchsharedusedoesnotgiverisetoasubstantialtechnicallevelimpairmentoftheabilitytoprovidethepermitteduseieasignificantinterferenceinbroadcastorreceptioncapabilitiesasopposedtoacompetitiveconflictorfinancialburdenSuchgoodfaithshallincludesharingtechnicalinformationtoevaluatethefeasibilityofcolocationIntheeventadisputearisesastowhetherapermitteehasexercisedgoodfaithinaccommodatingotheruserstheCitymayrequireathirdpartytechnicalstudyattheexpenseofeitherorboththeapplicantandpermitteeAllapplicantsshalldemonstrateeffortsindevelopingaalternativefortheirproposalreasonablecolocationFailuretocomplywiththecolocationrequirementsofthissectionmayresultinthedenialofapermitrequestorrevocationofanexistingpermit7 SECTION7SUBMITTALREOUIREMENTSInadditiontotheinformationrequestedintheSpecialUseApplicationthefollowingitemsshallberequiredforaWCFapplicationAdiagramormapshowingtheviewshedoftheproposedfacilityPhotosimulationsoftheproposedfacilityfromeffectedresidentialpropertiesandpublicrightsofwayataryingdistancesAmapshowingtheserviceareaoftheproposedWCFandanexplanationoftheneedforthatfacilityAmapshowingthelocationsandserviceareasofotherWCFsitesoperatedbytheapplicantandthosethatareproposedbytheapplicantwhicharecloseenoughtoimpactservicewithintheCityAsitelandscapingplanshowingthespecificplacementoftheWCFonthesiteshowingthelocationofexistingstructurestreesandothersignificantsitefeaturesandindicatingtypeandlocationsofpiantmaterialsusedtoscreenWCFcomponentsandtheproposedcolorsfortheWCFAsignedstatementindicatingaTheapplicantagreestoallowforthepotentialcolocationofadditionalWCFequipmentbyotherprovidersontheapplicantsstructureorwithinthesamesitelocationandThattheapplicantagreestoremovethefacilitywithin90daysafterthatsitesuseisdiscontinued7AleaseagreementwiththelandholderthataAllowsthelandholdertoenterintoleaseswithotherprovidersandbSpecifiesthatiftheproviderfailstoremovethefacilityupon90daysofitsdiscontinuedusetheresponsibilityforremovalfallsuponthelandholder8 ApprovalofaWCFwilloccurthroughtheConditionalSpecialUsepermitprocessasspecifiedinChapter1756oftheMedinaMunicipalCodeThepermitfeeforeachneworrenewalpermitforeachsiteshallbe500000plusallconsultingcostsasdescribedinMMC1744020Thepermitfeeshallbereducedto3000plusconsultingcostsforanapplicantwhoiscolocatingatthesiteofanexistingprovideranddoesnotrequireanyadditionalsupportstructureorexpansionofanexistingsupportstructureSECTION8RADIOFREOUENCYSTANDARDSTheapplicantshallcomplywithFederalstandardsforradiofrequencyemissionsWithinsixmonthsaftertheissuanceofitsoperationalpermittheapplicantshallsubmitaprojectimplementationreportwhichprovidescumulativefieldmeasurementsofradiofrequencyemissionsofallantennasinstalledatthesubjectsiteandcomparestheresultswithestablishedFederalstandardsSaidreportshallbesubjecttoreviewandapprovaloftheCitysPlanningConsultantforconsistencywithFederalstandardsIfonreviewtheCityfindsthattheWCFdoesnotmeetFederalstandardstheCitymayrevokeormodifythisSpecialUsePermitTheapplicantshallensurethattheWCFwillnotcauselocalizedinterferencewiththereceptionofareatelevisionorradiobroadcastsIfonreviewtheCityfindsthattheWCFinterfereswithsuchreceptionandifsuchinterferenceisnotcuredwithinsixty60daystheCitymayrevokeormodifythisSpecialUsePermitSECTION9TECHNOLOGICALCHANGEANDPERIODICREVIEWTheCityrecognizesthatWCFsandcommunicationtechnologiesingeneralarecurrentlysubjecttorapidchangeInnovationsinsuchthingsasswitchinghardwareandsoftwaretransmissionreceivingequipmentcommunicationsprotocolsanddevelopmentofhybridcablewirelesssystemsmayresultinreducingtheimpactsofindividualfacilitiesandtorenderspecificportionsofthisordinanceobsoleteThereforetheCityshallreviewthisordinanceatleastevery5yearsoruponrequestoftheCityCouncilCityManagerorPlanningCommission9 AtthetimeofreviewtheCityPlannerandoraqualifiedcommunicationsconsultantwillprepareawrittenreporttobesubmittedtothePlanningCommissionandCityCouncilthatassessesthisordinancerelativetocurrenttrendsinthecommunicationsindustryinnovationsincommunicationstechnologypermitactivityduringtheprevious5yearsandeffectivenessinproducingWCFSthatarecompatiblewiththeCitysresidentialcharacterTheCityPlannerandoraqualifiedcommunicationsconsultantshallifnecessaryrecommendupdatestothisordinancethatmayincludebutnotbelimitedtothedeletionmodificationoradditionofallowedlocationsallowedheightssitedevelopmentrequirementsadministrativereviewpossibilitiesorpermittingproceduresSECTION10PERMITLIMITATIONSASpecialUsePermitforaWCFshallexpire5yearsaftertheeffectivedateofthepermitapprovalApermitteewishingtocontinuetheuseofaspecificWCFattheendofthe5yearperiodmustapplyforaSpecialUsePermitrenewalapplicationtocontinuethatuseatleastsixmonthspriortoitsexpirationInrulingonsaidrenewalthePlanningCommissionshallapplyallthenexistingregulationseffectingtheapplicationTheSpecialUsePermitshallbecomenullvoidandnonrenewableifthepermittedfacilityisnotconstructedandplacedintousewithinoneyearofthedateofthePlanningCommissionsapprovalprovidedthatthespecialusepermitmaybeextendedonetimeforsixmonthsifconstructionhascommencedbeforeexpirationoftheinitialyearuponpaymentofanextensionfeeof25000ThepermitteeoperatorofaWCFshallanddoesuponapprovalofthisSpecialUsePermitagreetoindemnifyprotectdefendandholdharmlesstheCityitsCouncilmembersPlanningCommissionmembersofficersemployeesagentsandrepresentativesfromandagainstanyandallliabilitieslossesdamagesdemandsclaimsandcostsincludingcourtcostsandattorneysfeescollectivelyliabilitiesincurredbytheCityarisingdirectlyorindirectlyfromaCitys10 approvalandissuanceofthisSpecialUsePermitbCitysapprovalorissuanceofanypermitoractionwhetherdiscretionaryornondiscretionaryinconnectionwiththeusecontemplatedhereinandcApplicantsinstallationandoperationofthefacilitypermittedherebyincludingwithoutlimitationanyandallliabilitiesarisingfromtheemissionbythefacilityofelectromagneticfieldsorotherenergywavesoremissionsPermitteeoperatorcompliancewiththissectionisanexpressconditionofthisSpecialUsePermitandthisprovisionshallbebindingonanyandallofthepermitteesoperatorssuccessorsandassignsThepermitshallexpireandtheapplicantmustremovethefacilityifthefacilityisnotputintousewithinninety90daysafterconstructionorifuseisdiscontinuedforaperiodinexcessofninety90daysIfthefacilityisnotsoremovedtheCitymaycausethefacilitytoberemovedandallexpensesofremovalshallbepaidbytheownerofthelandwherethefacilityislocatedTheapplicantshallmaintaintheWCFtostandardsthatmaybeimposedbytheCityatthetimeofthegrantingofapermitSuchmaintenanceshallincludebutshallnotbelimitedtomaintenanceofthepaintstructuralintegrityandlandscapingIftheapplicantfailstomaintainthefacilitytheCitymayundertakethemaintenanceattheexpenseoftheapplicantorterminatethepermitatitssoleoptionTheapplicantshallnotifytheCityofallchangesinownershiporoperationofthefacilitywithinsixty60daysOfthechangeSECTION11APPLICABILITYTherequirementsofthisordinanceapplytoallnewWCFsandtheexpansionandoralterationofanyexistingWCFsprovidedthataninkindorsmallerreplacementoftransmissionequipmentwillonlyrequireawrittennotificationtotheCity11 SECTION12EFFECTIVEDATEREPEALERSREVIVALOFMORATORIUMTheCityCouncildeclaresthatthisisapublicemergencyordinancenecessaryfortheprotectionofpublichealthsafetyandwelfareandshallbeeffectiveuponadoptionUpontheeffectivedateofthisordinancethemoratoriumupontheissuanceofspecialusepermitsforcommunicationsfacilitiesestablishedinResolutionNo236andconfirmedinResolutionNo237isrepealedprovidedhoweverthatifthisordinanceoranysectionorclausecontainedinthisordinanceisheldtobeunconstitutionalorvoidforanyreasonthemoratoriumestablishedinResolutionNo236andconfirmedinResolutionNo237shallbeimmediatelyreinstatedforaperiodofsixmonthstoallowtheCitytoformulateandpassnewregulationsUpontheeffectivedateofthisordinanceMedinaMunicipalCodeSection1752070isrepealedPASSEDBYTHECITYCOUNCILONTHIS8thDAYOFaULY1996ANDSIGNEDINAUTHENTICATIONOFITSPASSAGETHE10hDAYOFJILy1996DeweyayorMayerApprovedastoformKirkRWinescityAttoeyAttestEdvalsoncityClerkP712
