thegreatestvisualimpactofallantennasandWHEREAStubularpanelantennasareavailablewhichhavemuchlessvisualimpactthandirectionalantennaarraysandWHEREAStechnologyexiststoallowallequipmentenclosurestobeplacedundergroundnowthereforeTHECITYCOUNCILOFTHECITYOFMEDINAORDAINSASFOLLOWSSECTION1DEFINITIONSAThedefinitionscontainedinOrdinanceNo609AthroughEareherebyadoptedbyreferenceBThefollowingnewdefinitionsareaddedtoOrdinanceNo609Section2ATubularPanelAntennaAnantennawhichiseighteeninches18indiameterorlessandwhichiscapableofreceivingortransmittingsignalsinathreehundredsixty360degreepatternandwhichislessthaneightfeet8inheightResidentialUsePropertyAllportionsofanypropertywhichcontainsaresidenceandallportionsofanyvacantpropertywhichiszonedforresidentialuseResidentialusepropertyincludespropertylocatedwithinadjoiningjurisdictionsSECTION2ORDINANCENO609SECTION3AMENDEDSection3ofOrdinanceNo609isamendedtoreadfollowsIasSECTION3PERMITTEDLOCATIONSWCFsmaybemountedonallcurrentlyexistingnonresidentialbuildingswhicharelocatedatleast500feetfromthenearestresidentialusepropertyexceptafollowsTheqedinaCityHallandtheMcdinaEtorcwhicharcexceptedbcoauucoftheirhiztoricarchitecturalsignificance2Anybuildingwhichisanacccsoorystructure SECTION5Section7followsCEquipmentenclosuresshallconformtothefollowingEquipmentenclosureswillbeplacedundergroundifsiteconditionspermitandiftechnicallyfeasibleEGuiDmentenclosuresmaynotextendmorethanfiveinchesabovetheGroundatoriginalorfinishedGradewhicheverislowerAnyvisibleportionofequipmentenclosuresshallbescreenedfromviewexceptasprovidedincbclowWalkinquipmcntcncloourcu1Maynotbcconstructedwithexposedmetaluufaccu2MaynotberequiredtobetotallyscreenedfromviewprovidedtherlannngCommissionfindsthataThewalkinequipmentenclosurehasbccndesignedusingmaterialscolorsanddetailingthatproducesastructurewhichemulatestheresidentialcharacteroftheCityAllheightsshallbemeasuredfromoriginalGradeorfinishGradewhicheverislowerAllapplicantsshallsubmitasbuiltdrawingsfollowingcompletionandallheightsmustbeconfirmedbysurveyafterconstructionbyalicensedsurveyororenaineerORDINANCENO609SECTION7CAMENDEDCofOrdinanceNo609isamendedtoreadasThepermitfeeforeachneworrenewalpermitforeachsiteshallbe500000plusallconsultingcostsasdescribedinMMC1744020thcpermitfecshallbereducedto63000plusconsultingcootsforanapplicantwhoiuoolocatingatthesiteofanexistingprorideranddocunotrequireanyadditionalsupportstructureorexpansionofanexistingsupportstructureIfmorethanoneinstallationissoughttobeaDDrovedunderasinglepermitafullPermitfeeshallbePaidforeachinstallationprovidedthatifthefacilityisexemptfromFCCregulationandiftheCityManauerfindsthateachseparatefacilityisinsignificant6 intermsofaestheticimpactUDOnthesurroundingneiahborhoodtheCityManaaermayinhisorhersolediscretionreducethepermitfeestobechargedSuchreductionmayonlybemadeafterpublichearinuonthepermitSECTION6ORDINANCENO609SECTION8AMENDEDSection8ofOrdinanceNo609isamendedtoreadasfollowsSECTION8RADIOFREOUENCYSTANDARDSTheapplicantshallcomplywithPederalstandardsforradiofrequencyemissionsWithinsixmonthsaftertheissuanceofitsoperationalpermittheapplicantshallsubmitaprojectimplementationreportwhichprovidecumulativefieldmeasurementsofradiofrequencyemissionsofallantennasinstalledatthesubjectsiteandcomparestheresultswithestablishedFederalstandardsSaidreportshallbesubjecttoreviewandapprovaloftheCityuPlanningConsultantforconsistencywithFederalstandardsIfonreviewtheCityfindsthattheWCFdoesnotmeetFederalstandardstheCitymayrevokeormodifythisSpecialUsePermitTheapplicantshallensurethattheWCFwillnotcauselocalizedinterferencewiththereceptionofareatelevisionorradiobroadcastsIfonreviewtheCityfindsthattheWCFinterfereswithsuchreceptionandifsuchinterferenceisnotcuredwithinsixty60daystheCitymayrevokeormodifythisSpecialUsePermitCeAtthetimeofapplicationandatallothertimesrequestedbytheCitytheapplicantshallsupplyinformationastothenumberofchannelscapableofbeingemployedatthesitetheirindividualandcombinedpotentiallycapacitiesandallotherinformationrequestedbytheCitySECTION7ORDINANCENO609SECTION10AANDFAMENDEDSection10AandFofOrdinanceNo609areamendedtoreadasfollowsASpecialUsePermitforaWCFshallexpire2yearsaftertheeffectivedateofthepermitapprovalApermitteewishingtocontinuetheuseofa7 specificWCFattheendoftheperiodmustapplyforaSpecialUsePermitrenewalapplicationtocontinuethatuseatleastsixmonthspriortoitsexpirationInrulingonsaidrenewalthePlanningCommissionshallapplyallregulationsineffectatthetimeofrenewalthenexistingrcgulationseffectingtheapplicationThcapplicantshallnotifythcCityofallchangcoinowncruhiporopcrationofthcfacilitywithinOiXty60dayofthcchangcSECTION8ORDINANCENO609SECTION11AMENDEDSection11ofOrdinanceNo609isamendedtoreadasfollowsSECTION11APPLICABILITYATherequirementsofthisordinanceapplytoallnewWCFsandtheexpansionandoralterationofanyexistingWCFsIprovidedthataninkindormallcrrcplaocmcntoftranmiuioncguipmcntwillonlyrequireawrittennotifioationtotheCityBTherequirementsofthisordinanceaDDlVthroughoutthecityItistheexpressintentoftheCitytoimposeallregulationsonthisordinancetoalllandwithintheCitywhetherpubliclyorprivatelyheldincludingwithoutlimitationprivatepropertyCitypropertystateownedrightsofwayandorpropertychurchroDertyutilitypropertyandschoolpropertySECTION9WIRELESSCOMMUNICATIONFACILITIESSITINGPOLICIESTheWirelessCommunicationsFacilitiesSitingPoliciesadoptedbytheCityCouncilonApril141997shallgovernthelocationandplacementofwirelesscommunicationsfacilitieswithintheCityIntheeventofanyconflictbetweenthisordinanceandsaidpoliciestheprovisionsofthisordinanceshallgovernSECTION10CONCEALMENTTECHNOLOGYDefinitionConcealmentTechnologyisdefinedastheuseofbothexistingandfuturetechnologythroughwhichawirelesscommunicationsfacilityisdesignedtoresembleanobjectwhichisnota8 wirelesscommunicationsfacilityandwhichisalreadypresentinthenaturalenvironmentConcealmentTechnologyforWirelessCommunicationsFacilitiesAllwirelesscommunicationsfacilitiesmustuseconcealmenttechnologyConcealmentTechnologyforEcruiDmentSheltersAllsheltersforandallassociatedequipmentneededfortheoperationofawirelesscommunicationsfacilityshallbelocatedwithinanexistingnonresidentialbuildingorundergroundUndergroundsheltersshallnotextendmorethanfiveinchesabovetheexistingsurfaceandshallbecompletelyandimmediatelyscreenedbyapprovedvegetationUndergroundsheltersshallnotbeallowedwheretheirpresencewouldinterferewithexistingusesofpubliclandSECTION11TESTINGTestinReuuiredAllexistingandfuturewirelesscommunicationsfacilitiesshallbetestednotlessfrequentlythanannuallytodetermineifthefacilitiesareincompliancewithallapplicablefederalstateandlocalregulationsFacilitiesthatareinexistenceontheeffectivedateofthisordinanceshallbetestedwithinthree3monthsaftertheeffectivedateofthisordinanceAlltestingshallbeconductedunderthedirectionandcontroloftheCityReGulationsTheCityManagershalladoptspecifictestingproceduresandprotocolsRevocationofPermitAnyexistfngorfuturewirelesscommunicationsfacilitieswhichdoesnotcomplyallapplicablefederalstateandlocalregulationsshallberemoveduponfailuretobringthefacilityintocomplianceafterthirty30daysadvancewrittennoticeCooperationAllexistingandfuturewirelessserviceprovidersshallcooperatewiththeCityinperformingthetestingrequiredbythisordinanceCooperationshallincludesupplyingnecessarytestingequipmentwhichhascurrentcertificationfromanindependenttestinglaboratoryandshallincludeoperatingtheequipmentatuptofullcapacityandorshuttingofftheequipmenttoallowbaselinetesting BaselineTestindAllexistingandfuturewirelessserviceprovidersshallcooperatewiththeCityinestablishingbaselinemeasurementsofambientradiofrequencyemissionswhicharepresentwithoutcontributionfromthefacilityToestablishbaselinetestingexistingwirelessserviceprovidersmayberequiredtoturnoffalloftheirequipmentFuturewirelessserviceprovidersshallnotifytheCityinadvancewhentheyarepreparedtobeginoperatingtheirequipmentFuturewirelessservicesprovidersshallnotbegintooperatetheirequipmentuntiltheCityhasobtainedbaselinemeasurementsCostsAlltestingshallbeatthecostofthewirelessserviceproridersFailuretopaysuchcostsshallbeanadequatebasisfortheCitytorevokeallspecialuepermitsSECTION12REOUIREMENTTODEMONSTRATENEEDAllapplicationsshallbeaccompaniedwithadequateinformationtodemonstratecompliancewiththerequirementsofMedinaWirelessCommunicationFacilitiesPolicyNumber8SECTION13ASSIGNMENTADSUBLEASINGNofacilitysiteorpermitmaybesoldtransferredorassignedunlessanduntiltheassigneeobtainsapermitforthefacilityNosubleaseshallbeenteredintobyaprovideruntilthesublesseehasobtainedapermitforitsfacilityAnassigneeorsublesseeseekingapermitshallsubmitalldatarequiredforanoriginalpermitSECTION14APPLICATIONFORMINFORMATIONTOBEPROVIDEDAllapplicationsshallbesubmittedonaformtobedevelopedunderthesupervisionandcontroloftheCityManagerAllsuchapplicationsinordertobedeemedcompleteshallanswerallenquiriescontainedintheapplicationformandshallbeaccompaniedbymaterialsdescribedwithintheapplicationformAtaminimumtheapplicationformshallrequirethefollowinginformationAAcompletedescriptionoftheproposedfacility10 BCoveragemapsinaformacceptabletotheCityLocationmapofallsitescurrentlyoperatedbytheproriderinafivemileradiusoftheproposedsitetogetherwithallsitesforwhichtheapplicantholdsthedevelopmentrightsincludingbutnotlimitedtoabindingcommitmentoroptiontoleaseasiteForeachsuchsitethetargetedareaandcapabilitiesofthesitesshallbeadequatelydescribedAllsuchadditionalinformationastheCityManagermayfromtimetotimerequestthroughmodificationsoftheapplicationformAllsuchadditionalinformationasthePlanningCommissionmayidentifyfromtimetotimeasbeingrelevanttothpermittingprocessSECTION15VIOLATIONPENALTYViolationofanyprovisionOfthisordinanceorofOrdinanceNo608shallconstituteacivilinfractionpunishablebyacivilpenaltynottoexceed1000EachdayonwhichaviolationcontinuesshallconstituteaseparatecivilinfractionpunishableasprovidedhereinViolationofanyprovisionofthisordinanceorofOrdinanceNo608ifnotcuredwithinthirty30daysafteradvancewrittennoticeshallconstituteadequatecausefortheCitytomodifyorrevokeanyspecialusepermitSECTION16EFFECTIVEDATEREPEALERREVIVALOFMORATORIUMTheCityCouncildeclaresthatthisisapublicemergencyordinancenecessaryfortheprotectionofpublichealthsafetyandwelfareandshallbeeffectiveuponadoptionUpontheeffectivedateofthisordinancethemoratoriumupontheacceptanceandprocessingofspecialusepermitsforcommunicationsfacilitiesestablishedinResolutionNo242andconfirmedinResolutionNo243isrepealedprovidedhoweverthatifthisordinanceoranysectionorclausecontainedinthisordinanceisheldtobeunconstitutionalorvoidforanyreasonthemoratoriumestablishedinResolutionNo242andconfirmedinResolutionNo243shallbeimmediatelyreinstatedforaperiodofsixmonthstoallowtheCitytoformulateandpassnewregulations11
