CITYOFMEDINAORDINANCENO662ANORDINANCEAMENDINGTHEGOALSANDPOLICIESOFTHECITYOFMEDINASHORELINEMANAGEMENTMASTERPROGRAMRELATINGTOCIRCULATIONANDPUBLICACCESSANDESTABLISHINGANEFFECTIVEDATEWHEREAStheMedinaShorelineManagementMasterProgramwaslastrevisedonJuly91990andWHEREASTheMedinaPlanningCommissionconductedseveralpublichearingsfollowingregularandpropernoticethereoftogatherpublicinputonproposedamendmentstotheShorelineManagementMasterProgramandWHEREASTheMedinaPlanningCommissionafterfullyfairlyandcarefullyconsideringthepublicinputandstaffmaterialsrelevanttotheamendmentproposalsforwardeditsrecommendationstotheCityCouncilandtotheStateDepartmentofCommunityTradeandEconomicDevelopmentandWHEREASTheonlycommentsontheproposedamendmentscamefromtheWashingtonStateDepartmentofTransportationandWHEREASconcernsoftheWashingtonStateDepartmentofTransportationwereaddressedbymodificationstotheproposedamendmentsandWHEREASafterafurtherpublichearingonthemodifiedamendmentsthePlanningCommissionrecommendedapprovaloftheamendmentsassetforthinthisordinanceandWHEREASincompliancewithallofthetermsconditionsandproceduresoftheStateEnvironmentalPolicyActandChapter1804oftheMedinaMunicipalCodeanenvironmentalassessmentoftheproposedamendmentstotheShorelineManagementMasterProgramwasconductedandanenvironmentalchecklistcompletedandupondeterminationthatnoprobablesignificantadverseenvironmentalimpactwouldresultfromtheproposaltheCityPlannerresponsibleofficialissuedadeterminationofnonsignificanceand WHEREAStheCityCouncilfindsthatallproceduralrequirementsforadoptionoftheattachedamendmentssetforthinstatelawandintheMedinaMunicipalCodehavebeencompliedwithandthatadequateenvironmentalreviewhasbeengivenNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINAWASHINGTONDOORDAINASFOLLOWSSection1AmendmentsAdoptedChapterIIoftheCityofMedinaShorelineManagementMasterProgramSectionCCirculationandSectionDPublicAccessareamendedtoreadasfollowsCCirculationGoalThepresenttransportationsystemwithinMedinashorelineshallbemaintainedbutanyexpansionshallbcminimisedormodificationoftheexistintransportationsystemtoaccommodaterowthshallbedesignedinamannerwhicheffectivelymitiuatestheimpactsofthefacilityontheadjacentneiuhborhoodsandthecityasawholeusinthebesttechnolovandscienceavailablePolicies1Additionaltransportationoystcmsmustbcdcsigcdtominimi2canyincrca5cinnoiocairandwatcrpollutionabovccxistinglcvcl5InadditionthccxlunsionofcxistingfaoilitieieEvcrgrccnPointSridgcmuotreduoctothcmEimumcxtcntandmitigatcanypoosiblcauoociatcdimpactsfromupgradingorimprovcmcntsNewtransportationfacilitiesortheexpansionOfexistinfacilitiesmustbedesignedtominimizeairnoiseandwaterPollutionadverseimpactsonaquatichabitatandwildlifehabitatandtheadverseimpactsofexcessiveliahtclareandcommunityseparation2NoadditionalcrosslakebridgesshallbebuiltonMedinasshoreline3ProvisionsforMETR0PublicTransitorothermasstransitshallbeimplementedinalltransportationfacilitiescrossingLakeWashington4Pdc5trianandbicyclcpathwaysshouldbcincludedinanymodifioation5ofthcEvcrgrecnPointBridgc5PedestrianandbicyclepathwaysshouldconnectcityownedshorelinesfacilitiescityparksandpublicschoolsDPublicAccess GoalAssureAccesstoMedinasPublicShorelinePolicies1ViewsoftheshorelineandwaterfrompublicparksshouldbepreservedandenhancedEnhancementofviewshallnotbeconstruedtomeanexcessiveremovalofvegetationViewpreservationmayincludeobtainingairrightsoverpropertiesbetweenparksandtheshorelineormajorlimitedaccesstransportationfacilitieswhereappropriate2Thecityshoulddcvclopapolicyofuhorclincacquiuition3WhenappropriateMedinashouldconsiderjoiningwithothergovernmentalbodiesinacooperativeefforttoexpandpublicaccesstotheshorelinesthroughprogramsofacquisitionanddevelopmentSection2CopyonFileAcopyoftheCityofMedinasShorelineManagementMasterProgramshallbekeptonfileforexaminationbythepublicSection3UseofShorelineManagementMasterProaramTheCityofMedinasShorelineManagementMasterProgramasamendedbythisordinanceshallbeusedbyalldepartmentsboardsandcommissionsandbytheCityCouncilasapolicyguidelineforalldevelopmentoccurringwithinorotherwiseaffectingtheshorelinesandadjacentlandwithin200feetoftheshorelineswithintheCityofMedinaTheCityofMedinaShorelineManagementMasterProgramasamendedbythisordinanceshallbeconsideredasasourceofsubstantiveenvironmentalpolicyinallenvironmentalconsiderationsbythecityunderthetermsoftheStateEnvironmentalPolicyActandChapter1804oftheMedinaMunicipalCodeSection4ValidityIfanysectionsubsectionclauseorphraseofthisordinanceisforanyreasonheldtobeinvalidorunconstitutionalsuchdecisionshallnotaffecttheremainingportionsofthisordinanceSectionSEffectiveDateThisordinanceshalltakeeffectfivedaysafteritspublicationorthepublicationofasummaryofitsintentandcontents
