CITYOFMEDINAORDINANCENO687ANORDINANCERELATINGTOSTRUCTURESANDOBJECTSINUNIMPROVEDPORTIONSOFPUBLICRIGHTSOFWAYPROVIDINGFORAPENALTYFORVIOLATIONANDREMOVALATTHEADJOININGPROPERTYOWNERSEXPENSEWHEREAStheCitywishestotakereasonablestepstoprotectthemotodngpublicwhilealsoprotectingtherightsofpropertyownersadjoiningrightsofwaytodeveloptheunimprovedportionsoftherightsofwayandWHEREASMedinaMunicipalCodeSection1220015requiresownersofpropertyadjoiningtherightofwaytomaintainalltreesshrubberiesandalllandscapingplacedintherightofwaybytheownerandWHEREAStheWashingtonCitiesInsuranceAuthorityhasrecommendedthattheCityprohibitrocksandstructuresthatarecapableofcausinginjurytotheoperatomandoccupantsofvehicleswhichleavethepavedsurfaceofthestreetandWHEREASpropertyownershaveplacedrocksandotherstructuressoastopreventvehiculardamagetothatportionoftherightofwaytheyarerequiredtomaintainNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSECTION1SECTIONMMC1232040ISDELETEDSECTION1MMC1232040REPEALEDMedinaMunicipalCodeSection1232040isherebyrepealed1232040VarianceConditionsTheboardof3djustmentisauthorizedtograntvariancasfromthorequirementsofthischapterAllraquostsforvnriancashallboconsideredundertheconditionssetforthforgrantingavahancatothezoningcedetogothorwiththecomprohonsiveplanandthoctrootdesignstandardsreferencedtherainSECTION2MMC1232050AMENDEDMedinaMunicipalCodeSection1232050isamendedtoreadasfollows1232050RemovalconditionsAnystructureorartificialthinglawfullyplacedinoronapublicrightofwayshallberemoveduponwrittenrequestofthecityGroundsforremovalincludebutarenotlimitedtoORD687090620001
