SECTION1ANEWCHAPTERMMC1902ISADDEDMedinaMunicipalCodeChapter1902isaddedtoreadasfollowsGENERALPROVISIONS1902010PurposeandIntentThepurposeandintentofthisTitleistoAEstablishalocalpolicyconcemingtelecommunicationsprovidersandserviceBEstablishguidelinesstandardsandtimeframesfortheexerciseoflocalauthoritywithrespecttotheregulationoftelecommunicationsprovidersandservicesCPromotecompetitionintelecommunicationsDMinimizeunnecessarylocalregulationoftelecommunicationsprovidersandservicesEEncouragetheprovisionofadvancedandcompetitivetelecommunicationsservicesonthewidestpossiblebasistothebusinessesinstitutionsandresidentsoftheCityandtheregionFPermitandmanagereasonableaccesstotherightsofwayoftheCityfortelecommunicationspurposesonacompetitivelyneutralbasisGConservethelimitedphysicalcapacityoftherightsofwayoftheCityHAssurethattheCityscurrentandongoingcostsofgrantingandregulatingprivateaccesstoanduseoftffierightsofwayarafullypaidbythepersonsseekingsuchaccessandcausingsuchcostsISecurefairandraasonablecompensationtotheCityforpermittingprivateuseoftherightsofwayJAssurethatalltelecommuncatonscarriersprovidingfacilitiesorserviceswithintheCitycomplywiththeordinancesrulesandregulationsoftheCityandKEnabletheCitytodischargeitspublictrustconsistentwithrapidlyevolvingfederalandstateregulatorypoliciesindustrycompetitionandtechnologicaldevelopment 902020DefinitionsThefollowingwordsandphrasesshallhavethefollowingmeaningsunlessthecontexofthesentenceinwhichtheyareusedshallindicateotherwiseAffiliatemeansapersonwhodirectlyorindirectlyownsorcontrolsisownedorcontrolledbyorisundercommonownershiporcontrolwithanotherpersonApplicantmeansanypersonorentitythatappliesforanyauthorizationfranchiseleaseorpermitpursuanttothisTitleCableActmeanstheCableCommunicationsPolicyActof1984andtheCableTelevisionConsumerProtectionandCompetitionActof1992CablefacilitiesmeansequipmentandwiringusedtotransmitaudioandvideosignalstosubscribersCableoperatormeansatelecommunicationscarderprovidingorofferingtoprovidecableservicewithintheCityasthattermisdefinedintheCableActCableserviceforthepurposeoftheseChaptersshallhavethesamemeaningprovidedbytheCableActCablesystemmeansafacilityconsistingofasetofclosedtransmissionpathsandassociatedsignalgenerationreceptionandcontrolequipmentthatisdesignedtoprovidecableserviceandotherservicetosubscribersCitymeanstheCityofMedinaWashingtonCitypropertymeansandincludesallrealpropertyownedbytheCityotherthanpublicstreetsandutilityeasementsasthosetermsaredefinedhereinandallpropertyheldinaproprietarycapacitybytheCitywhicharenotsubjecttorightofwaylicensingandfranchisingCouncilmeanstheCityCounciloftheCityofMedinaWashingtonactinginitsofficialcapacityDatacommunicationmeans1thetransmissionofencodedinformationor2thetransmissionofdatafromonepointtoanotherEmergencymeansaconditionofimminentdangertothehealthsafetyandwelfareofpropertyorpersonslocatedwithintheCityincludingwithout limitationdamagetopersonsorpropertyfromnaturalconsequencessuchasstormsearthquakesriotsorwarsExcesscapacitymeansthevolumeorcapacityinanyexistingorfutureductconduitmanholehandholeorotherutilityfacilitywithinthepublicwaythatisorwillbeavailableforuseforadditionaltelecommunicationsfacilitiesFCCorFederalCommunicationsCommissionmeanstheFederaladministrativeagencyorlawfulsuccessorauthorizedtoregulateandoverseetelecommunicationscarriersservicesandprovidersonanationallevelFiberOpticsmeansthetechnologyofguidingandprojectinglightforuseasacommunicationsmediumFranchiseshallmeantheinitialauthorizationorrenewalthereofapprovedbyanordinanceoftheCitywhichauthorizesthefranchiseetoconstructinstalloperateormaintaintelecommunicationsfacilitiesinunderoveroracrossrightsofwayoftheCityandtoalsoprovidetelecommunicationsservicetopersonsorareasintheCityFranchiseemeansthepersonfirmorcorporationtowhomorwhichafranchiseasdefinedinthisSectionisgrantedbytheCouncilunderthisTeandthelawfulsuccessortransfereeorassigneeofsaidpersonfirmorcorpoaionsubjecttosuchconditionsasmaybedefinedinthisTitleOpenvideosystemorOVSreferstoafacilityconsistingofasetoftransmissionpathsandassociatedsignalgenerationreceptionandcentralequipmentthatisdesignedtoprovideCableServicewhichisprovidedtomultiplesubscriberswithinacommunityandwhichtheFederalCommunicationsCommissionoritssuccessorshascertifiedascompliantwithPart76ofitsrules47CFRPart76asamendedfromtimetotimeOperatormeansthepersonfirmorcorporationtowhomafranchiseisgrantedpursuanttotheprovisionsofthisTitleOverheadfacilitiesmeansutilitypolesutilityfacilitiesandtelecommunicationsfacilitieslocatedabovethesurfaceofthegroundincludingtheundergroundsupportsandfoundationsforsuchfacilitiesPersonmeansandincludescorporationscompaniesassociationsjointstockcompaniesorassociationsfirmspartnershipslimitedliabilitycompaniesandindividualsandincludestheirlessorstrusteesandreceivers PropertyoffranchiseemeansallpropertyownedinstalledorusedbyaFranchiseeintheconductofitsbusinessintheCityundertheauthorityofafranchisegrantedpursuanttothisTitleProposalmeanstheresponsebyanindividualororganizationtoarequestbytheCityregardingtheprovisionofcableservicesoranunsolicitedplansubmittedbyanindividualororganizationseekingtoprovidecableservicesintheCityRightofwaymeanslandacquiredordedicatedforpublicroadsandstreetsbutdoesnotincludestatehighwaysorlanddedicatedforroadsstreetsandhighwaysnotopenedandnotimprovedformotorvehicleusebythepublicStatemeanstheStateofWashingtonSurplusspacemeansthatportionoftheusablespaceonautilitypolewhichhasthenecessaryclearancefromotherpoleusersasrequiredbythefederalorstateordersandregulationstoallowitsusebyatelecommunicationscarrierforapoleattachmentqelecommunicationscarriermeansandincludeseverypersonthatdirectlyorindirectlyownscontrolsoperatesormanagesplantequipmentorpropertywithintheCityusedortobeusedforthepurposeofofferingtelecommunicationsserviceqelecommunicetionsfacilitiesmeanstheplantequipmentandpropertyincludingbutnotlimitedtocableswiresconduitsductspedestalsantennaeelectroniceandotherappurtenancesusedortobeusedtotransmitreceivedistributeprovideoroffertelecommunicationsservicesTelecommunicationsprovidermeansandincludeseverypersonwhoprovidestelecommunicationsservicesovertelecommunicationsfacilitieswithoutanyownershipormanagementcontrolofthefacilitieslelecommunicationsservicemeanstheprovidingorofferingforrentsaleorleaseorinexchangeforothervaluereceivedofthetransmittalofvoicedataimagegraphicandvideoprogramminginformationbetweenoramongpointsbywirecablefiberopticslasermicrowaveradiosatelliteorsimilarfacilitieswithorwithoutbenefitofanyclosedtransmissionmediumqelecommunicationssystemSeeqelecommunicationsfacilities UndergroundfacilitiesmeansutilityandtelecommunicationsfacilitieslocatedunderthesurfaceofthegroundexcludingtheundergroundfoundationsorsupportsforoverheadfacilitiesUniversalservicemeansalevelofanddefinitionoftelecommunicationsservicesasthetermisdefinedbytheFCCthroughitsauthoritygrantedpursuanttoSection254oftheActUsablespacemeansthetotaldistancebetweenthetopofautilitypoleandthelowestpossibleattachmentpointthatprovidestheminimumallowableverticalclearanceasspecifiedinanyfederalorstateordersandregulationsUtilityfacilitiesmeanstheplantequipmentandpropertyincludingbutnotlimitedtothepolespipesmainsconduitsductscableswiresplantandequipmentlocatedunderonorabovethesurfaceofthegroundwithintherightsofwayoftheCityandusedortobeusedforthepurposeofprovidingutilityortelecommunicationsservices1902030TelecommunicationsRiqhtofWavUseRequiredAuthorizationExceptasotherwiseprovidedhereinanytelecommunicationscarderwhodesirestoconstructinstalloperatemaintainorotherwiselocatetelecommunicationsfacilitiesinunderoveroracrossanypublicwayoftheCityforthesolepurposeofprovidingtelecommunicationsservicetopersonsandareasoutsidetheCityshallfirstobtainaTelecommunicationsRightofWayUseAuthodzationgrantingtheuseofsuchrightsofwayfromtheCitypursuanttoChapter1904ofthisTitle1902040TelecommunicationsFranchiseRequiredExceptasotherwiseprovidedhereinanytelecommunicationscarrierwhodesirestoconstructinstalloperatemaintainorotherwiselocatetelecommunicationsfacilitiesinunderoveroracrossanypublicwayoftheCityandtoalsoprovidetelecommunicationsservicetopersonsorareasintheCityshallfirstobtainaTelecommunicationsFranchisegrantingtheuseofsuchrightsofwayfromtheCitypursuanttoChapter1906ofthisTitle1902050CableTelevisionFranchiseRequiredExceptasotherwiseprovidedhereinanytelecommunicationscarrierorotherpersonwhodesirestoconstructinstalloperatemaintainorlocatecableortelecommunicationsfacilitiesinanypublicwayintheCityforthepurposeof providingcableservicetopersonsintheCityshallfirstobtainaCableFranchisefromtheCitySaidfranchisesshallbenegotiatedonacasebycasebasistakingintoaccountthetermsandprovisionsofexistingsuchfranchisesandtherequirementsoftheCableActsof1984and1992ProvidedhoweverunlessotherwiseauthorizedorexemptedbythetermsofanunexpiredfranchiseleaseoragreementcableserviceoperatorsshallcomplywiththerelevantprovisionsofChapters1910and1912ofthisTitle1902060FacilitiesLeaseReauiredNotelecommunicationscarrierorotherentitywhodesirestolocatetelecommunicationsorotherequipmentonCitypropertyshalllocatesuchfacilitiesorequipmentonCitypropertyunlessgrantedaFacilitiesLeasefromtheCitypursuanttoChapter1908ofthisTitleTheCityCouncilreservesuntoitselfthesolediscretiontoleaseCitypropertyfortelecommunicationsandotherfacilitiesandnovestedorotherrightshallbecreatedbyanyprovisionofthisTitle1902070ConstructionPermitsRequiredExceptasotherwiseprovidedhereintheholderofanauthorizationfranchiseorleasegrantedpursuanttothisTitleandtheholdersofCableFranchisesgrantedbytheCityandtelecommunicationprovidersclaimingtohaveastatewidegranttooccupytherightsofwayshallinadditiontosaidauthorizationfranchiseorleaseberequiredtoobtainaConstructionPermitfromtheCitypursuanttoChapter1912ofthisTrrJeNoworkconstructiondevelopmentexcavationorinstallationofanyequipmentorfacilitiesshalltakeplacewithintherightsofwayoruponCitypropertyuntilsuchtimeastheConstructionPermitisissued1902080AI3DlicationtoExistinaFranchiseOrdinancesAGreementsLeasesandPermitsEffectofotherLawsATheseprovisionsshallhavenoeffectonanyexistingfranchiseordinancefranchiseagreementleasepermitorotherauthorizationtouseoroccupyapublicwayintheCityuntil1Theexpirationofsaidfranchiseordinanceagreementleasepermitorauthorizationor2Anamendmenttoanunexpiredfranchiseordinancefranchiseagreementleasepermitorauthorizationthathasbeenapprovedunlessbothpartiesagreetodeferfullcompliancetoaspecificdatenotlaterthanthepresentexpirationdate BNothingintheseprovisionsshallbedeemedtocreateanobligationuponanypersonforwhichtheCityisforbiddentorequirepursuanttofederalstateorotherlaw1902090UniversalServiceExceptasotherwiseprovidedhereinallcableoperatorstelecommunicationscarriersandtelecommunicationsprovidersengagedinthebusinessoftransmittingsupplyingorfurnishingtelecommunicationsserviceofanykindoriginatingorterminatingintheCityaresubjecttotheCitysdghtwhichisexpresslyreserVedtorequiresaidoperatorcarrierorprovidertomakeanequitableandnondiscdminatorycontributiontothepreservationandadvancementofuniversalservicetotheextentpermittedbystateandfederallaw1920100GeneralPenaltiesACivilPenalty1AnypersonandtheofficersdirectorsmanagingagentsorpartnersofanycorporationfirmpartnershiporotherorganizationorbusinessviolatingorfailingtocomplywithanyoftheprovisionsofthisTitleshallbesubjecttoapenaltyinanamountnotlessthan10000normorethan100000perdayforeachviolationfromthedatesetforcomplianceuntilcompliancewiththeorderisachieved2InadditiontoanypenaltywhichmaybeimposedbytheCityanypersonviolatingorfailingtocomplywithanyoftheprovisionsofthisTitleshallbeliableforalldamagetopublicorprivatepropertyadsingfromsuchviolationincludingthecostofrestoringtheaffectedareainaccordancewiththeCitysDevelopmentGuidelines3ThepenaltyimposedbythisSectionshallbecollectedbycivilactionbroughtbytheCityAttorneyBCdminalPenaltyAnypersonandtheofficersdirectorsmanagingagentsorpartnersofanycorporationfirmpartnershiporotherorganizationorbusinessviolatingorfailingtocomplywithanyoftheapplicableprovisionsofthisTitleshallbesubjecttocriminalprosecutionanduponconvictionofsuchviolationshallbefinedinasumnotexceeding500000orbeimprisonedforatermnotexceedingIyearorbebothORD92 finedandimprisonedEachdayofnoncompliancewithanyoftheapplicableprovisionsoftheTitleshallconstituteaseparateoffenseCAdditionalReliefTheCitymayseeklegalorequitablerelieftoenjoinanyactsorpracticesandabateanyconditionwhichconstitutesorwillconstituteaviolationoftheapplicableprovisionsofthisTitlewhencivilorcriminalpenaltiesareinadequatetoeffectcomplianceInadditiontothepenaltiessetforthinthisSectionviolationofthetermsofthisTitlemayalsoresultintherevocationofanyauthorizationfranchiseapprovalleaseorpermitissuedorgrantedhereunderassetforthinthisTitle1902110InitialinluinReslsonsibilitiesInitialinquiriesregardingcabletelevisionandtelecommunicationsfranchisestelecommunicationsrightofwayauthorizationsorfacilitiesleasesshallbedirectedtotheCityManagerordesigneefordeterminationofwhichtypeortypesofagreementsandpermitsarerequiredTheCityManagerordesigneeshallhaveleadresponsibilityfornegotiatingauthodzationsfranchisesandleases1902120OtherRemediesNothinginthisChaptershallbeconstruedaslimitinganyjudicialremediesthattheCitymayhaveatlaworinequityforenforcementofthisTrtle1902130FeesandCompensationNotaTaxThefeeschargesandfinesprovidedforinthisTitleandanycompensationchargedandpaidfortherightsofwayprovidedforhereinwhetherfinancialorinkindareseparatefromandadditionalGoanyandallfederalstatelocalandCitytaxesasmaybeleviedimposedorduefromatelecommunicationscarTierorprovideritscustomersorsubscribersoronaccountoftheleasesaledeliveryortransmissionoftelecommunicationsservicesSECTION2ANEWCHAPTERMMC1904ISADDEDMedinaMunicipalCodeChapter1904isaddedtoreadasfollowsCHAPTER1904TELECOMMUNICATIONSRIGHTOFWAYUSEAUTHORIZATIONS 1904010TelecommunicationsRiGhtofWayUseAuthorizationATelecommunicationsRightofWayUseAuthorizationshallberequiredofanytelecommunicationscarrierorproviderwhodesirestooccupyspecificrightsofwayoftheCityforthesolepurposeofprovidingtelecommunicationsservicestopersonsorareasoutsidetheCity1904020TelecommunicationsRiclhtofWaVUseAuthorizationADllicationAnypersonthatdesiresaTelecommunicationsRightofWayUseAuthorizationpursuanttothisChaptershallfileanapplicationwiththeCityClerkwhichshallincludethefollowinginformationAThenameoftheapplicantincludingallaffiliatesoftheapplicantBAdescriptionofthetetecommunicationsservicesthataroorwillbeofferedorprovidedbytheapplicantoveritstelecommunicationsfacilitiesCAdescriptionofthetransmissionmediumthatwillbeusedbytheapplicanttoofferorprovidesuchtelecommunicationsservicesDPreliminaryengineeringplansspecificationsandanetworkmapofthefacilitiestobelocatedwithintheCityallinsufficientdetailtoidentify1Thelocationandrouterequestedforapplicantsproposedtelecommunicationsfacilities2Thelocationofalloverheadandundergroundpublicutilitytelecommunicationcablewatersewerdrainageandotherfacilitiesinthepublicwayalongtheproposedroute3Thelocationsifanyforinterconnectionwiththetelecommunicationsfacilitiesofothertelecommunicationscarriersand4ThespecifictreesstructuresimprovementsfacilitiesandobstructionsifanythatapplicantproposestotemporarilyorpermanentlyremoveorrelocateEIfapplicantisproposingtoinstalloverheadfacilitiesevidencethatsurplusspaceisavailableforlocatingitstelecommunicationsfacilitiesonexistingutilitypolesalongtheproposedroute10 FIfapplicantisproposinganundergroundinstallationinexistingductsorconduitswithintherightsofwayinformationinsufficientdetailtoidentify1Theexcesscapacitycurrentlyavailableinsuchductsorconduitsbeforeinstallationofapplicantstelecommunicationsfacilities2Theexcesscapacityifanythatwillexistinsuchductsorconduitsafterinstallationofapplicantstelecommunicationsfacilitiesand3EvidenceofownershiporadghttousesuchductsorconduitsGIfapplicantisproposinganundergroundinstallationwithinnewductsorconduitstobeconstructedwithintherightsofway1Thelocationproposedforthenewductsorconduitsand2TheexcesscapacitythatwillexistinsuchductsorconduitsafterinstallationofapplicantstelecommunicationsfacilitiesHApreliminaryconstructionscheduleandcompletiondateIInformationtoestablishthattheapplicanthasobtainedallothergovernmentalapprovalsandpermitstoconstructandoperatethefacilitiesandtoofferorprovidethetelecommunicationsservicesincludingbutnotlimitedtoevidencethattheapplicanthasregisteredwiththeWashingtonUtilitiesandTransportationCommissionorisnotrequiredtosoregisterJAlldepositsorchargesrequiredpursuanttothisChapterandKAnapplicationfeewhichshallbeetbytheCityCouncilbyresolution1904030IssuanceDenialofTelecommunicationsRiqhtofWavUseAuthorizatiohWithin120daysafterreceivingacompleteapplicationtheCityManagerordesigneeshallissueawdttendeterminationgrantingordenyingtheauthorizationinwholeorinpartThe120daylimitationmaybewaivedbytheapplicantandshallnotapplyifactionbytheCityCouncilisrequestedIftheauthorizationisdeniedthewrittendeterminationshallincludethereasonsfordenialThedecisiontograntordenyanapplicationforaTelecommunicationsRightOfWayUseAuthodzationshallbebaseduponthefollowingstandardsORD6921 AWhethertheapplicanthasreceivedallrequisitelicensescertificatesandauthorizationsfromtheFederalCommunicationsCommissiontheWashingtonUtilitiesandTransportationCommissionandanyotherfederalorstateagencywithjurisdictionovertheactivitiesproposedbytheapplicantBThecapacityoftherightsofwaytoaccommodatetheapplicantsproposedfacilitiesCThecapacityoftherightsofwaytoaccommodateadditionalutilitycableandtelecommunicationsfacilitiesiftheauthorizationisgrantedDThedamageordisruptionifanyofpublicorprivatefacilitiesimprovementsservicetravelorlandscapingiftheauthorizationisgrantedandeffortsproposedtomitigatesuchdamagesordisruptionEThepublicinterestinminimizingthecostanddisruptionofconstructionwithintherightsofwayFApplicantsproposedcompliancewiththeCitysDevelopmentGuidelinesGTheeffectifanyonpublichealthsafetyandwelfareiftheauthorizationisgrantedHTheavailabilityofalternateroutesandorlocationsfortheproposedfadlitiesISuchotherfactorsasmaydemonstratethatthegranttousetherightsofwaywillorwillnotservethecommunityinterest1904040AoDealofCityManaqersDecisionAnypersonaggdevedbythegrantingordenyingofaTelecommunicationsRightofWayAuthorizationortherenewalthereofpursuanttothisChaptershallhavethedgllttoappealtotheBoardofAdjustmentasfollowsAAllappealsfiledpursuanttothisSectionmustbefiledinwritingwiththeCityClerkwithin10daysofthedateofthedecisionappealedfromBAllappealsfiledpursuanttothisSectionshallspecifytheerroroflaworfactornewevidencewhichcouldnothavebeenreasonablyavailableatthetimeoftheCityManagersdecisionwhichshallconstitutethebasisoftheappealORD692 EIfthesystemorfacilitywasconstructedorinstalledatalocationnotpermittedbytheauthorizationorfranchiseProvidedhoweverthattheCitymayinitssolediscretionallowagranteefranchiseeorothersuchpersonswhomayowncontrolormaintaincableortelecommunicationsfacilitieswithintherightsofwayoftheCitytoabandonsuchfacilitiesinplaceNofacilitiesofanytypemaybeabandonedinplacewithouttheexpresswdttenconsentoftheCityAnyplanforabandonmentorremovalofagranteeorfranchiseesfacilitiesmustbefirstapprovedbytheCityManagerandallnecessarypermitsmustbeobtainedpdortosuchworkUponpermanentabandonmentofthepropertyofsuchpersonsinplacethepropertyshallbecomethatoftheCityandsuchpersonsshallsubmittotheCityaninstrumentinwritingtobeapprovedbytheCityAttorneytransferringtotheCitytheownershipofsuchpropertyTheprovisionsofthisSectionshallsurvivetheexpirationrevocationorterminationofanauthorizationorfranchisegrantedunderthisTle1910180EmerqencvRemovalorRelocationofFacilitiesTheCityretainsthedghtandprivilegetocutormoveanycableorteiecommunicationsfacilitieslocatedwithintherightsofwayoftheCityanduponCitypropertyastheCitymaydeterminetobenecessaryappropriateorusefulinresponsetoanypublichealthorsafetyemergencyTheCityshallnotbeliabletoanycableoperatortelecommunicationscarrierorprovideroranyotherpartyforanydirectindirectoranyothersuchdamagessufferedbyanypersonorentityofanytypeasadirectorindirectresultoftheCitysactionsunderthisSection1910190DamaqetoFacilitiesUnlessdirectlyandproximatelycausedbythewillfulintentionalormaliciousactsbytheCitytheCityshallnotbeliableforanydamagetoorlossofanycableortelecommunicationsfacilityuponCitypropertyorwithintherightsofwayoftheCityasaresultoforinconnectionwithanypublicworkspublicimprovementsconstructionexcavationgradingfillingorworkofanykindonsuchCitypr6pertyorwithintherightsofwaybyoronbehalfoftheCity1910200RestorationofRklhtsofwayOtherWaysandCityPropertyAVVhenagranteefranchiseelesseeoranypersonactingonitsbehalfdoesanyworkinoraffectinganyrightsofwayorCitypropertyitshallatitsownexpensepromptlyremoveanyobstructionstherefromandrestoresuchwaysorpropertytoasgoodaconditionasexistedbeforetheworkwasundertakenunlessotherwisedirectedbytheCity37 BIfweatherorotherconditionsdonotpermitthecompleterestorationrequiredbythisSectionthegranteefranchiseeorlesseeshalltemporarilyrestoretheaffectedwaysorpropertySuchtemporaryrestorationshallbeatthegranteefranchiseeorlesseessoleexpenseandthegranteefranchiseeorlesseeshallpromptlyundertakeandcompletetherequiredpermanentrestorationwhentheweatherorotherconditionsnolongerpreventsuchpermanentrestorationCAgranteefranchiseelesseeorotherpersonactinginitsbehalfshalladheretotrafficcontrolmeasuresestablishedbytheManualofUniformTrafficControlDeviceslatesteditionandusesuitablebarricadesflagsflagmenlightsflaresandothermeasuresasrequiredforthesafetyofallmembersofthegeneralpublicandtopreventinjuryordamagetoanypersonvehicleorpropertybyreasonofsuchworkinoraffectingsuchwaysorpropertyDTheCityEngineershallberesponsibleforinspectionandfinalapprovaloftheconditionoftherightsofwayandCitypropertyfollowinganyconstructionandrestorationactivitiesthereinFurthertheprovisionsofthisSectionshallsurvivetheexpirationrevocationorterminationofanauthorizationfranchiseleaseorotheragreementgrantedpursuanttothisTitle1910210FacilitiesMapsForallneworretocatedfacilitieseachgranteefranchiseeandlesseeshallprovidetheCitywithamapormapsaccuratelyreflectingthehorizontalandverticallocationandconfigurationofalloftheirtelecommunicationsfacilitieswithintherightsofwayanduponCitypropertyEachgranteefranchiseeandlesseeshallprovidetheCitywithupdatedmapsannuallyoruponrequestbytheCity1910220DutoProvideInformationWithin10daysofawrittenrequestfromtheCityeachgranteefranchiseeorlesseeshallfurnishtheCitywithinformationsufficienttodemonstrateAThatthegranteefranchiseeorlesseehascompliedwithallrequirementsofthisTtleandBThatallsalesutilityandortelecommunicationstaxesduetheCityinconnectionwiththecableortelecommunicationsservicesandfacilitiesprovidedbythegranteefranchiseeorlesseehavebeenproperlycollectedandpaidbythegranteefranchiseeorlesseeCRD692
