CITYOFMEDINAORDINANCENO709AnOrdinanceRegulatingtheOpeningandExcavatingofStreetsAlleysSidewalksandOtherPublicGroundsRequiringaPermitThereforeandPaymentofaFeeImposingRequirementsfortheProtectionofLifeandPropertyinConnectionwithExcavationWorkIncludingTrafficandPedestrianSafeguardsandtheProtectionofUtiliUesandOtherPropertyRegulaUngtheBackFillingandResurfacingofExcavationsPrescribingSuretyBondInsuranceRequirementsandPrescribingPenalUesforViolaUonsofItsProvisionsTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSECTIONtANBNCHAPTERMMC1206ISADOPTEDThereisherebyaddedtotheMedinaMunicipalCodeChapter1206whichistoreadasfollowsMEDINAMUNICIPALCODECHAPTER1206STREETEXCAVATIONSECTION1206010DefinitionsForthepurposeofthisOrdinancethefollowingtermsphraseswordsandtheirdedvationsshallhavethemeaninggivenhereinWhennotinconsistentwiththecontextwordsusedinthepresenttenseincludethefuturewordsinthepluralnumberincludethesingularnumberandwordsinthesingularnumberincludethepluralnumberThewordshallisalwaysmandatoryandnotmerelydirectory1ApplicantisanypersonmakingwdttenapplicationtotheCitysDesigneeforanExcavationpermithereunder2CityistheCityofMedina3CityCouncilorCouncilistheCityCounciloftheCityofMedina4CitysDesigneeistheCityEngineeroftheCityofMedinatheCityManageroftheCityofMedinaorthePublicWorksSuperintendentoftheCityofMedina5ExcavationWorkistheexcavationandotherworkpermittedunderanexcavationpermitandrequiredtobeperformedunderthisOrdinance6Permitteeisanypersonwhohasbeengrantedandhasinfullforceandeffectanexcavationpermitissuedhereunder7Personisanypersonfirmpartnershipassociationcorporationcompanyororganizationofanykind 8StreetisanystreethighwaysidewalkalleyavenueeasementmadetotheCityforpublicuseorotherpublicwayorpublicgroundsintheCitySECTION1206020ExcavationPermitItshallbeunlawfulforanypersontodigupcutintomardefacealterbreakexcavatetunnelundermineorinanymannerbreakupanystreetortomakeorcausetobemadeanyexcavationinorunderthesurfaceofanystreetanyearthorotherexcavatedmaterialobstructingortendingtointerferewiththefleeuseofthestreetunlesssuchpersonshallfirsthaveobtainedanexcavationpermitthereforefromtheCitysDesigneeashereinprovidedSECTION1206030AlllicaUonNoexcavationpermitshallbeissuedunlessawrittenapplicationfortheissuanceofanexcavationpermitissubmittedtotheCityEngineerThewrittenapplicationshallstatethenameandaddressoftheapplicantthenaturelocationandpurposeoftheexcavationthedateofcommencementanddateofcompletionoftheexcavationandotherdataasmayreasonablyberequiredbytheCitysDesigneeTheapplicationshallbeaccompaniedbyplansshowingtheextentoftheproposedexcavationworkthedimensionsandelevationsofboththeexistinggroundpdortosaidexcavationandoftheproposedexcavatedsurfacesthelocationoftheexcavationworkandsuchotherinformationasmaybeprescribedbytheCitysDesigneeSECTION1206040ExcavationPermitFeesFeeschargedforissuanceofexcavationpermitsarespecifiedinthescheduleofpermitfeeswhichmaybeacquiredatMedinaCityHallSECTION1206050FranchiseRecluiredItisunlawfulforanypuklicutilitytousetheCitystreetfightsofwayofheCitywithoutavalidandeffectivefranchisegrantedbytheCityortheStateandapplicabletotheCitystreetrightsofwaySECTION1206060SuretyBondBeforeanexcavationpermitashereinprovidedisissuedtheapplicantshalldepositwiththeCityClerkasuretybondinsuchreasonableamountassetbytheCitysDesigneepayabletotheCityTherequiredsuretybondmustbeaWithgoodandsufficientsuretybByasuretycompanyauthorizedtotransactbusinessinthestatecSatisfactorytotheCityAttorneyinformandsubstance dConditioneduponthepermitteescompliancewiththisOrdinancetofilluprestoreandplaceingoodandsafeconditionasnearasmaybetoitsodginalconditionandtothesatisfactionoftheCitysDesigneeallopeningsandexcavationsmadeinstreetsandtomaintainanystreetwhereexcavationismadeinasgoodconditionfortheperiodof24monthsaftersaidworkshallhavebeendoneusualwearandtearexpectedasitwasinbeforesaidworkshallhavebeendoneAnysettlementofthesurfacewithinsaidtwoyearperiodshallbedeemedconclusiveevidenceofdefectivebackfillingbythepermitteeNothinghereincontainedshallbeconstruedtorequirethepermitteetomaintainanyrepairstopavementmadebytheCityifsuchrepairsshouldprovedefectiveAnyownerofrealestaterepairingorengaginganothertorepairhisownsidewalkshallnotberequiredtogivesuchbondAnannualbondmaybegivenunderthisprovisionwhichshallremaininforceforoneyearconditionedasaboveintheamountspecifiedaboveandinotherrespectsasspecifiedabovebutapplicableastoallexcavationworkinstreetsbythepdncipleinsuchbondduringthetermofoneyearfromsaiddateSECTIONt206070RoutingTrafficThepermitteeshalltakeappropriatemeasurestoassurethatduringtheperformanceoftheexcavationworktrafficconditionsasnearnormalaspracticableshallbemaintainedatalltimessoastocauseaslittleinconvenienceaspossibletotheoccupantsoftheabuttingpropertyandtothegeneralpublicprovidedthattheCitysDesigneemaypermittheclosingofstreetstoalltrafficforapedodoftimeprescribedbyhimifinhisopinionitisnecessaryThepermitteeshallrouteandcontroltrafficincludingitsownvehiclesasdirectedbytheCityPoliceDepartmentThefollowingstepsshallbetakenbeforeanystreetmaybeclosedorrestdctedtotraffic1ThepermitteemustreceivetheapprovaloftheCitysDesigneeandthePoliceDepartmenttherefore2ThepermitteemustnotifytheChiefoftheFireDepartmentofanystreetsoclosed3UponcompletionofconstructionworkthepermitteeshallnotifytheCitysDesigneeandCityPoliceDepartmentbeforetrafficismovedbacktoitsnormalFlowsothatanynecessaryadjustmentsmaybemade4WhereflagpersonsaredeemednecessarybytheCitysDesigneetheyshallbefurnishedbythepermitteeatitsownexpenseThroughtrafficshallbemaintainedwithouttheaidofdetoursifpossibleIninstancesinwhichthiswouldnotbefeasibletheCitysDesigneewilldesignatedetoursTheCityshallmaintainroadwaysurfacesofexistingstreetsdesignatedasdetourswithoutexpensetothepermitteebutincasetherearenoexistingstreetsthepermitteeshallconstructalldetoursatitsexpenseandinconformitywiththespecificationsoftheCitysDesigneeThepermitteewillberesponsibleforanyunnecessarydamagecausedtoanystreetsbytheoperationofitsequipment SECTION1206080ClearanceforFireEcluipmentTheexcavationworkshallbeperformedandconductedsoasnottointerferewithaccesstofirestationsandfirehydrantsMaterialsorobstructionsshallnotbeplacedwithin15feetoftireplugsPassagewaysleadingtofireescapesorfirefightingequipmentshallbekeptfreeofpilesofmaterialorotherobstructionsSECTION1206090ProtectionofTrafficThepermitteeshallerectandmaintainsuitabletimberbarderstoconfineearthfromtrenchesorotherexcavationsinordertoencroachuponstreetsaslittleaspossibleThepermitteeshallconstructandmaintainadequateandsafecrossingsoverexcavationsandacrossstreetsunderimprovementtoaccommodatevehicularandpedestriantrafficatallstreetintersectionsVehicularcrossingsshallbeconstructedandmaintainedofplanktimbersandblockingofadequatesizetoaccommodatevehiculartrafficsafelyDeckingshallbenotlessthanfourinchesthickandshallbesecurelyfastenedtogetherwithheavywireandstaplesPedestriancrossingsshallconsistofplanking3inchesthick12incheswideandofadequatelengthtogetherwithnecessaryblockingThewalkshallbenotlessthan3feetinwidthandshallbeprovidedwitharailingasrequiredbytheCitysDesigneeSECTION1206100RemovalandProtectionofUtilitiesThepermitteeshallnotinterferewithanyexistingutilitywithoutthewrittenconsentoftheCitysDesigneeandtheutilitycompanyorpersonowningtheutilityNoutilityownedbytheCityshallbemovedtoaccommodatethepermitteeunlessthecostofsuchworkbebornebythepermitteeThecostofmovingprivatelyownedutilitiesshallbesimilarlybornebythepermitteeunlessitmakesotherarrangementswiththepersonowningtheutilityThepermitteeshallsupportandprotectbytimbersorotherwiseallpipesconduitspoleswiresorotherapparatuswhichmaybeinanywayaffectedbytheexcavationworkanddoeverythingnecessarytosupportsustainandprotectthemunderoveralongoracrosssaidworkIncaseanyofsaidpipesconduitspoleswiresorapparatusshouldbedamagedtheyshallberepairedbytheagencyorpersonowningthemandtheexpenseofsuchrepairsshallbechargedtothepermitteeandhisoritsbondshallbeliablethereforeThepermitteeshallberesponsibleforanydamagedonetoanypublicorprivatepropertybyreasonofthebreakingofanywaterpipessewergaspipeelectricconduitorotherutilityanditsbondshallbeliablethereforeThepermitteeshallberesponsibleforcontactingtheappropriateagencyforundergroundutilitylocateswithsurfacemarkingstobeperformedpdortoanyexcavationworkThepermitteeshallinformitselfastotheexistenceandlocationofallundergroundutilitiesandprotectthesameagainstdamage SECTIONt206tt0ProtectionofAdjoiningProlertyThepermitteeshallatalltimesandatitsownexpensepreserveandprotectfrominjuryanyadjoiningpropertybyprovidingproperfoundationsandtakingothermeasuressuitableforthepurposeWhereintheprotectionofsuchpropertyitisnecessarytoenteruponprivatepropertyforthepurposeoftakingappropriateprotectivemeasuresthepermitteeshallobtainalicensefromtheownerofsuchprivatepropertyforsuchpurposeandifpermitteecannotobtainalicensefromsuchownertheCitysDesigneemayauthorizepermitteetoenterthepdvatepremisessolelyforthepurposeofmakingthepropertysafeThepermitteeshallatitsownexpenseshoreupandprotectallbuildingswallsfencesorotherpropertylikelytobedamagedduringtheprogressoftheexcavationworkandshallberesponsibleforalldamagetopublicorprivatepropertyorstreetsresultingfromitsfailureproperlytoprotectandcarryoutsaidworkWheneveritmaybenecessaryforthepermitteetotrenchthroughanylawnareathesodshallbecarefullycutandrolledandreplacedafterditcheshavebeenbackfilledasrequiredinthisOrdinanceAllconstructionandmaintenanceworkshallbedoneinamannercalculatedtoleavethelawnareacleanofearthanddebrisandinaconditionasnearaspossibletothatwhichexistedbeforesuchworkbeganThepermitteeshallnotremoveeventemporarilyanytreesorshrubswhichexistinparkingstripareasoreasementsacrossprivatepropertywithoutfirsthavingnotifiedandobtainedtheconsentofthepropertyownerorinthecaseofpublicpropertytheappropriateCitydepartmentorCityofficialhavingcontrolofsuchpropertySECTION1206120SidewalkExcavaUonsAnyexcavationmadeinanysidewalkorunderasidewalkshallbeprovidedwithasubstantialandadequatefootbridgeoversaidexcavationonthelineofthesidewalkwhichbridgeshallbeatleastthreefeetwideandsecurelyrailedoneachsidesothatfootpassengerscanpassoversafelyatalltimesSECTION1206130ProtectiveMeasuresThepermitteeshallerectsuchfencerailingorbarriersaboutthesiteoftheexcavationworkasshallpreventdangertopersonsusingtheCityStreetorsidewalksandsuchprotectivebardersshallbemaintaineduntiltheworkshallbecompletedorthedangerremovedAttwilightthereshallbeplaceduponsuchplaceofexcavationanduponanyexcavatedmaterialsorstructuresorotherobstructionstostreetssuitableandsufficientlightswhichshallbekeptburningthroughoutthenightduringthemaintenanceofsuchobstructionsItshallbeunlawfulforanyonetoremoveorteardownthefenceorrailingorotherprotectivebarriersoranylightsprovidedtherefortheprotectionofthepublic SECTION1206140AttractiveNuisanceItshallbeunlawfulforthepermitteetosufferorpermittoremainunguardedattheplaceofexcavationoropeninganymachineryequipmentorotherdevicehavingthecharacteristicsofanattractivenuisancelikelytoattractchildrenandhazardoustotheirsafetyorhealthSECTION1206150CareofExcavatedMaterialAllmaterialexcavatedfromtrenchesandpiledadjacenttothetrenchorinanystreetshallbepiledandmaintainedinsuchamannerasnottoendangerthoseworkinginthetrenchpedestriansorusersofthestreetsandsothatasliffieinconvenienceaspossibleiscausedtothoseusingstreetsandadjoiningpropertyWheretheconfinesoftheareabeingexcavatedaretoonarrowtopermitthepilingofexcavatedmaterialbesidethetrenchsuchasmightbeinthecaseinanarrowalleytheCitysDesigneeshallhavetheauthoritytorequirethatthepermitteehaultheexcavatedmaterialtoastoragesiteandthenrehaulittothetrenchsiteatthetimeofbackfillingItshallbethepermitteesresponsibilitytosecurethenecessarypermissionandmakeallnecessaryarrangementsforallrequiredstorageanddisposalSECTION1206160DamaletoExistingImlrovementsAlldamagedonetoexistingimprovementsdudngtheprogressoftheexcavationworkshallberepairedbythepermitteeMaterialsandworkmanshipforsuchrepairshallconformwiththerequirementsofanyapplicablecodeorordinanceIfuponbeingorderedthepermitteefailstofurnishthenecessarylaborandmaterialsforsuchrepairstheCitysDesigneeshallhavetheauthoritytocausesaidnecessarylaborandmaterialstobefurnishedbytheCityandthecostshallbechargedagainstthepermitteeandthepermitteeshallalsobeliableonitsbondthereforeSECTION1206170PropertyLinesandEasementsPropertylinesandlimitsofeasementsshallbeindicatedontheplanofexcavationsubmittedwiththeapplicationfortheexcavationpermitanditshallbethepermitteesresponsibilitytoconfineexcavationworkwithintheselimitsSECTIONt206180Cleanul3AstheexcavationworkprogressesallstreetsandpdvatepropertiesshallbethoroughlycleanedofallrubbishexcessearthreckandotherdebrisresultingfromsuchworkAllcleanupoperationsatthelocationofsuchexcavationshallbeaccomplishedattheexpenseofthepermitteeandshallbecompletedtothesatisfactionoftheCitysDesigneeFromtimetotimeasmay beorderedbytheCitysDesigneeandinanyeventimmediatelyaftercompletionofsaidworkthepermitteeshallatitsownexpensecleanupandremoveallrefuseandunusedmaterialsofanykindresultingfromsaidworkanduponfailuretodosowithin24hoursafterhavingbeennotifiedtodosobytheCitysDesigneesaidworkmaybedonebytheCitysDesigneeandatthecostthereofchargedtothepermitteeandthepermitteeshallalsobeliableforthecostthereofunderthesuretybondprovidedhereunderSECTION1206190ProtectionofWaterCoursesThepermitteeshallprovidefortheflowofallwatercoursessewersordrainsinterceptedduringtheexcavationworkandshallreplacethesameinasgoodconditionasitfoundthemorshallmakesuchprovisionsforthemastheCitysDesigneemaydirectThepermitteeshallnotobstructthegutterofanystreetbutshalluseallpropermeasurestoprovideforthefreepassageofsurfacewaterThepermitteeshallmakeprovisionstotakecareofallsurpluswatermucksiltslickingorotherrunoffpumpedfromexcavationsorresultingfromsluicingorotheroperationsandshallberesponsibleforanydamageresultingfromitsfailuretosoprovidePermitteeshallberesponsibleforprotectionandorcleaningofalldownstreamcatchbasinspipesandditcheswithin300feetofexcavationpriortofinalinspectionapprovalofissuedpermitAnyrunofforliquidresultingfromthecleaningofpouredconcreteproductsconcretetruckssluicechutesorequipmentisnotallowedtoentertheCitysstormdrainsystemditchesetcSECTION1206200BreakingThroughPavementWheneveritisnecessarytobreakthroughexistingpavementforexcavationpurposesandwheretrenchesaretobe4feetoroverindepththepavementinthebaseshallberemovedtoatleast12inchesbeyondtheouterlimitsofthesubgradethatistobedisturbedinordertopreventsettlementanda12inchshoulderofundisturbedmaterialshallbeprovidedineachsideoftheexcavatedtrenchThefaceoftheremainingpavementshallbeapproximatelyverticalApowerdrivenconcretesawshallbeusedsoastopermitcompletebreakageofconcretepavementorbasewithoutraggededgesAsphaltpavingshallbescoredorotherwisecutinastraightlineNopileddvermaybeusedinbreakingupthepavementSECTION1206210TunnelsTunnelsunderpavementsshallnotbepermittedexceptbypermissionoftheCitysDesigneeWherepipesorcablesareplacedundermainthoroughfaresconcretestreetsStateHighwaysfirstgradeasphaltstreetsorwhereverdesignatedbytheCitysDesigneesuchworkshallbedonebyjacking orbodngcasingsunderstreetsurfacesandplacingsaidpipesorcablesinsideofthecasingSECTION1206220BackFillingBackfillinginanystreetopenedorexcavatedpursuanttoanexcavationpermitissuedhereundershallbecompactedtoadegreeequivalenttothatoftheundisturbedgroundinwhichthetrenchwasdugorcompactedto95ofmodifiedProctorASTMD1557whicheverisgreaterCompactingshallbedonebymechanicaltappersorvibratorsbyrollinginlayersorbywatersettlingasrequiredbythesoilinquestionandsoundengineeringpracticesgenerallyrecognizedintheconstructionindustryWhenwateristakenfromahydrantthepermitteeshallassignonepersontooperatethehydrantandshallmakecertainthatsaidpersonhasbeeninstructedintheoperationofthehydrantTheCityWaterPurveyorshalllikewisebenotifiedatboththebeginningandendofthejobsothattheconditionofthefirehydrantscanbecheckedonbothoccasionsAnydamagedonetothehydrantduringtheexcavationshallbetheresponsibilityofthepermitteeWatershallbepaidforbythepermitteeonthetermsagreeduponwiththeCityWaterPurveyorSECTION1206230BackFillingbyWaterSettlingWhenbackfillingistobedonebywatersettlingandbeforeanycompactingofthetrenchesisattemptedthepermitteeshallcausetheloosematedaltobewettedbyforcingaheadofwaterofnotlessthan30feetinheightdownintothesoftmatedalsothattheendofthepipeisnotmorethan3feetabovethebottomoftheexcavationThepermitteeshallallowthewatertorununtilthematedalissaturatedasindicatedbythewaterrisingandrunningoutonthesurfaceofthegroundaroundthepipeAftereachholehasbeensaturatedthejetpipeshallbemovedalongthetrenchlineadistanceofapproximately4or5feetbutinnocasemorethan8feetandtheprocessrepeatedfortheentirelengthofthebackfilltrenchAllworkshallbedoneinsuchamannerastoobtainarelativecompactionthroughouttheentiredepthofthebackfillofnotlessthanexistingadjacenttotheexcavationSECTION1206240DryBackFillingBackfillinguptothefirst18inchesabovethetopoftheutilitypipesorsimilarinstallationsshallbedonewiththinlayersEachlayeristobetampedbymanualormechanicalmeansLayersthatarehandtampedshallnotexceed4inchesinthicknessLayersthatarepowertampedshallnotexceed6inchesinthicknessThesamerequirementsshallapplytotheremainderofthebackfillingiftampingisthemethodusedforbackfillingBackfillingofallpipesofover24inchesindiametershallbecardeduptothespringlineofthepipeinthreeinchlayerswitheachlayermoistenedandthoroughlytampedwithsuitable mechanicalequipmentThebackfillaroundallpipes24inchesorlessindiametershallbefloodedortampedasspecifiedabovetoadepthof18inchesabovethetopofthepipebeforeanyadditionalbackfillingisplacedthereonAnydeviationfromthemethodsetforthaboveshallhavepriorwdttenapprovaloftheCitysDesigneeSECTIONt206250BackFillMaterialWheneveranyexcavationforthelayingofpipeismadethroughrockthepipeshallbelaid6inchesabovetherockbottomofthetrenchandthespaceunderaroundand6inchesabovethepipeshallbebackfilledwithcleanriversandnoncerrosivesoiloronequarterinchminusgravelBrokenPavementLargestonesanddebrisshallnotbeusedinthebackfillSECTION1206260BackFillingattheSurfaceBackfillingshallbecompletedbyplacingthebackfillmatedalwellupoverthetopofthetrenchFordrybackfillingthematedalshallbecompactedwitharollerofanapprovedtypeorwiththerearofatruckcarryingatleastfivetonsuntilthesurfaceisunyieldingCareshallbetakenthatmaterialbeingcompactedhaspropermoisturecontentformaximumcompatibilityThesurfaceshallthenbegradedasrequiredSECTION1206270RestorationofSurfaceThepermitteeshallrastorethesurfaceofallstreetsbrokenintoordamagedasaresultoftheexcavationworktoitsodginalconditioninaccordancewiththespecificationsoftheCityDesigneeThepermitteemayberequiredtoplaceatemporarysurfaceoveropeningsmadeinpavedtrafficlanesExceptwhenthepavementistobereplacedbeforetheopeningofthecuttotrafficthefillabovethebottomofthepavingslabshallbemadewithsuitablematerialwelltampedintoplaceandthisfillshallbetoppedwithaminimumofatleastoneinchofbituminousmixturewhichissuitabletomaintaintheopeningingoodconditionuntilpermanentrestorationcanbemadeThecrownofthetemporaryrestorationshallnotexceedoneinchabovetheadjoiningpavementThepermitteeshallexercisespecialcareinmakingsuchtemporaryrestorationsandmustmaintainsuchrestorationsinsafetravelingconditionuntilsuchtimeaspermanentrestorationsaremadeTheasphaltwhichisusedshallbeinaccordancewiththespecificationsoftheCitysDesigneeIfinthejudgmentoftheCitysDesigneeitisnotexpedienttoreplacethepavementoveranycutorexcavationmadeinthestreetuponcompletionoftheworkallowedundersuchpermitbyreasonoftheIoosenessoftheearthorweatherconditionstheCitysDesigneemaydirectthepermitteetolayatemporarypavementofwoodorothersuitablematerialdesignatedbyhimoversuchcutorexcavationtoremainuntilsuchtimeastherepairoftheoriginalpavementmaybeproperlymade PermanentrestorationofthestreetshallbemadebythepermitteeinstdctaccordancewiththespecificationsprescribedbytheCitysDesigneetorestorethestreettoitsodginalandproperconditionorasnearasmaybeAcceptanceorapprovalofanyexcavationworkbytheCitysDesigneeshallnotpreventtheCityfromassertingaclaimagainstthepermitteeanditssuretyunderthesuretybondrequiredhereunderforincompleteordefectiveworkifdiscoveredwithin24monthsfromthecompletionoftheexcavationworkTheCitysDesigneespresenceduringtheperformanceofanyexcavationworkshallnotrelievethepermitteeofitsresponsibilitieshereunderSECTION1206280CitysRighttoRestoreSurfaceIfthepermitteeshallhavefailedtorestorethesurfaceofthestreettoitsoriginalandproperconditionupontheexpirationofthetimefixedbysuchpermitorfailstoprosecutetheworkinaccordancewiththerequirementsofthisOrdinanceorshallotherwisehavefailedtocompletetheexcavationworkcoveredbysuchpermittheCitysDesigneeifhedeemsitadvisableshallhavetherighttodoallworkandthingsnecessarytorestorethestreetandtocompletetheexcavationworkThepermitteeshallbeliablefortheactualcostthereofand25ofsuchcostinadditionforgeneraloverheadandadministrativeexpensesTheCityshallhaveacauseofactionforallfeesexpensesandamountspaidoutanddueitforsuchworkandtheCityshallalsoenforceitsfightsunderthepermitteessuretybondprovidedpursuanttothisOrdinanceItshallbethedutyofthepermitteetoguaranteeandmaintainthesiteoftheexcavationworkinthesameconditionitwaspriortotheexcavationfortwoyearsafterrestoringittoitsoriginalconditionSECTION1206290TrenchesinPipeLayingExceptbyspecialpermissionfromtheCitysDesigneenotrenchshallbeexcavatedmorethan250feetinadvanceofpipelayingnorleftunfilledmorethan250feetwherepipehasbeenlaidThelengthofthetrenchthatmaybeopenedatanyonetimeshallnotbegreaterthanthelengthofpipeandthenecessaryaccessorieswhichareavailableatthesitereadytobeputinplaceTrenchesshallbebracedandsheathedaccordingtogenerallyacceptedsafetystandardsforconstructionworkNotimberbracinglaggingsheathingorotherlumbershallbeleftinanytrenchSECTION1206300PromptCompletionofWorkThepermitteeshallprosecutewithdiligenceandexpeditionallexcavationworkcoveredbytheexcavationpermitandshallpromptlycompletesuchworkandrestorethestreettoitsoriginalconditionorasnearasmaybeassoonaspracticableandinanyeventnotlaterthanthedatespecifiedintheexcavationpermittherefore
