HomeMy WebLinkAboutOrdinance No. 0783OrdinanceNo783ANORDINANCEOFTHECITYCOUNCILOFMEDINAWASHINGTONADOPTINGTHE2005AMENDMENTSTOTHECOMPREHENSIVEPLANASRECOMMENDEDBYTHEMEDINAPLANNINGCOMMISSIONWHEREASthePlanningCommissionischargedwiththeresponsibilityofpreparingandamendingacomprehensiveplanincludinglandusedesignationsforanticipatingandinfluencingtheorderlyandcoordinateddevelopmentoflandandbuildingusesoftheCityassetforthinChapter3670ARCWandtheMedinaMunicipalCodeandWHEREASthePlanningCommissionengagedinopenpublicdiscussionoftheComprehensivePlananddesignatedlandusemapatvariouspublicmeetingsspanningfouryears20022005andWHEREASthePlanningCommissionheldpublichearingsontheproposedComprehensivePlanamendmentsWHEREASincompliancewiththeGrowthManagementActRCW3670A215theCityofMedinareviewedtheconditionoflandusehousingtransportationcapitalfacilityandutilitiesincludingbutnotlimitedtoBuildablelandsconditionsrecordedbythe2002KingCountyBuildableLandsReportandPopulationandemploymentlevelsrecordedbytheKingCountyAnnualGrowthReportthe2000USCensusandthePugetSoundRegionalCouncilandLocalbuildingpermitrecordsandLocalenvironmentalconditionsincludingthebestavailablesciencedocumentedbytheWatershedCompanyWHEREAStheCityfindsthattheCityhasbeennearlycompletelydevelopedunderitscurrentzoningstandardsandthatanyfurtherdevelopmentislikelytofollowthesamestandardsandWHEREAStheCitvfindsthatthatthemosteffectivemeansforincreasingpopulationdensitywithintheCityhasbeentheallowanceofaccessorydwellingunitsandWHEREAStheCityfindsthatchangingminimumlotsizeswithintheCitywouldnotleadtoincreaseddensitybecausetheCityisfullydevelopedandrecentORD783 developmenthasfrequentlyresultedintheacquisitionofmultiplelotstoallowforconstructionoflargerdwellingsandWHEREAStheCityfindsthatlargerminimumlotsizerequirementswithstrictmaximumcoveragerequirementsaidsinprotectingenvironmentallysensitiveareasandthatsuchdevelopmentrestrictionsshouldbemaintainedinareasofsteepslopesandforwaterfrontlotsWHEREAStheCitvhasdeterminedtheactualdensityofhousingdevelopmentisconsistentwiththeCityscomprehensiveplanandWHEREAStheCityhasreviewedpopulationandemploymentforecastsandtargetsadoptedbythestateOfficeofFinanceandManagementOFMandtheKingCountyGrowthManagementPlanningCouncilincomparisonwithbuildablelandsinformationandhasdeterminedthatsufficientlandisavailableunderexistingzoningtoaccommodatetheminimalgrowthexpectedandWHEREAStheCityhasdevelopedgoalsandpoliciesconsistentwiththeGrowthManagementActthatprovideforappropriatelandusesconsistentwiththeCitysvisionandanticipatedgrowthandWHEREAStheCityhasdevelopedgoalsandpoliciessupportingdevelopmentofarangeofhousingtypesandsupportingeffortstoprovideaffordablehousingandWHEREAStheCityhasdevelopedgoalsandpoliciesregardingtransportationandsupportingstrategiestoreducetheimpactsoftrafficonthecommunityandWHEREAStheCityrecognizestherequirementundertheGrowthManagementActtoprovidepublicservicesconcurrentwithanticipatedgrowthandhasdevelopedasixyearcapitalfacilitiesplanforlocallyprovidedservicesandWHEREASanenvironmentalchecklistaccordingtotheSEPAGuidelinesChapter19710WACwaspreparedfortheactionofadoptingtheproposedamendmentsandWHEREAStheCityResponsibleOfficialissuedaDeclarationofNonSignificancepursuanttotheStateEnvironmentalPolicyActChapter4321CRCWonJanuary312005andWHEREAStheCityhasprovidedpublicnoticeoftheproposedamendmentstothecomprehensiveplanandORD783 WHEREASitisnowappropriatefortheCityCounciltoadoptthe2005amendmentstotheMedinaComprehensivePlanNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSection1The2005MedinaComprehensivePlanisdeclaredandfoundtobeconsistentwithapplicablesubstantiveprocedurestateandlocallawsSection2The2005MedinaComprehensivePlanisapprovedandadoptedaspresentedbythePlanningCommissionpursuanttotheauthoritysetoutinChapter3670ARCWandwithchangesbroughtoutduringCouncildiscussionSection3Citystaffisdirectedtoimplementthe2005MedinaComprehensivePlanasprovidedbystateandlocallawincludingsubmittingtheComprehensivePlantotheWashingtonStateDepartmentofCommunityTradeandEconomicDevelopmentPassedbytheCityCounciloftheCityofMedinaonthe14thdayofMarch2005andsignedinauthenticationofitspassagethe14thdayofMarch2005Ran4yReCCityCSerkAPPROVEDASTOFORMWayneTaoaCityAttorneyFILEDWITHTHECITYCLERKMarch142005PASSEDBYTHECITYCOUNCILMarch142005EFFECTIVEDATEORD783
