CITYOFMEDINAWASHINGTONORDINANCENO795ANORDINANCEREPEALINGORDINANCENO538ANDENACTINGNEWCABLESYSTEMREGULATIONSWHEREAStheCitywishesitopromotetheavailabilityofhighqualityanddiverseCableServicestoresidentstheCityandotherpublicinstitutionsiitopromotetheavailabilityofdiverseinformationresourcestothecommunityiiitopromotecompetitiveCableServicesandratesivtotakeadvantageoftechnologiesvtoenhanceeducationalopportunitiesthroughoutthecommunityandprovideopportunitiesforbuildingastrongercommunityandvitoallowflexibilitytorespondtochangesintechnologyCustomerinterestsandcompetitivefactorswithinthecabletelevisionindustrythatwillpositivelyaffectthehealthwelfareandwellbeingofthecommunityWHEREAStheCitypursuanttoapplicablefederallawisauthorizedtograntoneormorenonexclusiveFranchisestoconstructoperateandmaintainCableSystemswithintheCityandWHEREASbecauseofthecomplexandrapidlychangingtechnologyassociatedwithCableSystemstheCityCouncilfurtherfindsthatthepublicconveniencesafetyandgeneralwelfarecanbestbeservedbyestablishingregulatorypowersthatshouldbevestedintheCityItisfurthertheintentofthisOrdinanceandsubsequentamendmentstoprovideforandspecifythemeanstoattainthebestpossibleCableServicetothepublicItisthefurtherintentofthisOrdinancetoestablishregulatoryprovisionsthatpermittheCitytoregulateCableSystemFranchisestothemaximumextentpermittedbyfederalandstatelawincludingbutnotlimitedtotheCableCommunicationsPolicyActof1984theCableTelevisionConsumerProtectionandCompetitionActof1992theTelecommunicationsActof1996applicableFederalCommunicationsCommissionregulationsandWashingtonlawNOWTHEREFORETHECITYCOUNCILOFTHECITYOFMEDINAWASHINGTONDOORDAINASFOLLOWSSection1RepealOrdinanceNo538isherebyrepealedSection2ShortTitleThisOrdinanceshallconstitutetheCableSystemRegulationsoftheCityofMedinaandmaybereferredtoassuchSection3DefinitionsForthepurposesofthisOrdinancethefollowingwordstermsphrasesandtheirderivationshavethemeaningsgivenhereinWhennotinconsistentwiththecontextwordsusedinthepresenttenseincludethefuturetensewordsinthesingularnumberincludethepluralnumberandwordsinthepluralnumberincludethesingularnumber1ApplicantmeansanypersonorentitythatappliesforaninitialFranchise1 2CableActmeanstheCableCommunicationsPolicyActof1984asamendedbytheCableTelevisionConsumerProtectionandCompetitionActof1992andtheTelecommunicationsActof1996andasanyofthemmaybeamended3CableOperatormeansanypersonorgroupofpersonsincludingaFranchiseewhoprovidesCableServiceoveraCableSystemanddirectlyorthroughoneormoreaffiliatesownsasignificantinterestinsuchCableSystemorwhootherwisecontrolsorisareresponsibleforthroughanyarrangementthemanagementandoperationofsuchaCableSystem4CableServicemeanstheonewaytransmissiontoCustomersofvideoprogrammingorotherprogrammingserviceandCustomerinteractionifanywhichisrequiredfortheselectionoruseofsuchvideoprogrammingorotherprogrammingservice5CableSystemmeansanyfacilityconsistingofasetofclosedtransmissionpathsandassociatedsignalgenerationreceptionandcontrolequipmentthatisdesignedtoprovideCableServicewhichincludesvideoprogrammingandwhichisprovidedtomultipleCustomerswithinacommunitybutsuchtermdoesnotincludeAafacilitythatservesonlytoretransmitthetelevisionsignalsofoneormoretelevisionbroadcaststationsBafacilitythatservesCustomerswithoutusinganypublicRightofWayCafacilityofacommoncarrierwhichissubjectinwholeorinparttotheprovisionsofTitleIIofthefederalCommunicationsAct47USc201etseqexceptthatsuchfacilityshallbeconsideredaCableSystemotherthanforpurposesofSection621c47USc541ctotheextentsuchfacilityisusedinthetransmissionofvideoprogrammingdirectlytoCustomersunlesstheextentofsuchuseissolelytoprovideinteractiveondemandservicesDanopenvideosystemthatcomplieswithfederalstatutesandregulationsorEanyfacilitiesofanyelectricutilityusedsolelyforoperatingitselectricutilitysystems6CitymeanstheCityofMedinaamunicipalcorporationoftheStateofWashingtonandalloftheareawithinitsboundariesassuchmaychangefromtimetotime7oftheCityCityCouncilmeanstheMedinaCityCounciloritssuccessorthegoverningbody8CustomermeansanypersonwhoorwhichelectstosubscribetoforanypurposeCableServiceprovidedbyaFranchiseebymeansoforinconnectionwiththeCableSystemandwhosepremisesarephysicallywiredandlawfullyactivatedtoreceiveCableServicefromFranchiseesCableSystem9CustomerServiceRepresentativeorCSRshallmeananypersonemployedbytheCableOperatortoassistorprovideservicetoCustomerswhetherbyansweringpublictelephonelinesansweringCustomersquestionsorperformingotherCustomerservicerelatedtasks10CustomerServiceStandardsmeansthosecustomerservicestandardssetforthhereinandashereafteramendedthatareapplicabletoCableOperators11FCCmeanstheFederalCommunicationsCommission2 12FranchisemeansanagreementthatauthorizesapersonorentitytoconstructoperatemaintainorreconstructaCableSystemUponthewrittenacceptancebyaFranchiseetheagreementconstitutesacontractbetweentheCityandFranchisee13FranchiseAreameanstheareawithinthejurisdictionalboundariesoftheCitytobeservedbyaFranchiseeasspecifiedintheFranchise14FranchiseemeansthepersonflfIllcorporationorentitytowhomorwhichaFranchiseashereinabovedefinedisgrantedbytheCityCouncilunderthisOrdinanceandthelawfulsuccessortransfereeorassigneeofsaidpersonfirmcorporationorentity15NormalBusinessHoursshallmeanthosehoursduringwhichmostsimilarbusinessesintheCityareopentoserveCustomersInallcasesnormalbusinesshoursmustincludesomeeveninghoursatleastonenightperweekandorsomeweekendhours16NormalOperatingConditionsshallmeanthoseserviceconditionsthatarewithinthecontroloftheCableOperatorThoseconditionsthatarenotwithinthecontroloftheCableOperatorincludebutarenotlimitedtonaturaldisasterscivildisturbancespoweroutagestelephonenetworkoutagesandsevereorunusualweatherconditionsThoseconditionsthatareordinarilywithinthecontroloftheCableOperatorincludebutarenotlimitedtospecialpromotionspaypervieweventsrateincreasesregularpeakorseasonaldemandperiodsandmaintenanceorupgradeofthecablesystem17RightofWayorRightsofWaymeansallofthefollowingwhichhavebeendedicatedtothepublicorarehereafterdedicatedtothepublicandmaintainedunderpublicauthorityorbyothersandarelocatedwithintheCitystreetsroadwayshighwaysavenueslanesalleysbridgessidewalkseasementsandsimilarpublicpropertyandareas18channelsServiceInterruptionshallmeanthelossofpictureorsoundononeormorecableSection4FranchiseGrantItisunlawfultoengageinorcommenceconstructionoperationormaintenanceofaCableSystemintheCitywithoutaFranchiseissuedunderthisOrdinanceTheCityCouncilmaybyordinanceissueanonexclusiveFranchisetoconstructoperateandmaintainaCableSystemwithinalloranyportionoftheCitytoanypersonorentitywhetheroperatingunderanexistingfranchiseornotwhoappliesforauthoritytofurnishCableServicewhichcomplieswiththetermsandconditionsofthisOrdinanceandprovidedthatsuchpersonorentityalsoagreestocomplywithalloftheprovisionsoftheFranchiseHoweverthisshallnotbedeemedtorequirethegrantofaFranchisetoanyparticularpersonorentityTheCityCouncilmayrestrictthenumberofFranchisesshoulditdeterminesucharestrictionwouldbeinthepublicinterestSection5FranchisePurposesAFranchisegrantedbytheCityundertheprovisionsofthisOrdinanceshall3 APermittheFranchiseetoengageinthebusinessofoperatingaCableSystemandprovidingCableServicewithintheCityBPermittheFranchiseetoerectinstallconstructrepairreconstructreplaceandretainwirescablesrelatedelectronicequipmentconduitsandotherpropertyinconnectionwiththeoperationoftheCableSysteminonoverunderuponalongandacrossRightsofWaywithintheCityandcSetforththeobligationsoftheFranchiseeundertheFranchiseSection6NonexclusiveFranchiseAnyFranchisegrantedpursuanttothisOrdinanceshallbenonexclusiveandnotprecludetheCityfromgrantingotherorfutureFranchisesorpermitsSection7ApplicationAAnApplicantforaninitialFranchiseshallsubmittotheCityawrittenapplicationonaformprovidedbytheCityatthetimeandplacespecifiedbytheCityforacceptingapplicationsandaccompaniedbythedesignatedapplicationfeeAnapplicationfeeintheamountof20000shallaccompanytheapplicationtocovercostsassociatedwithprocessingtheapplicationincludingwithoutlimitationcostsofadministrativereviewfinanciallegalandtechnicalevaluationoftheApplicantthecostsofconsultantsnoticeandpublicationrequirementsanddocumentpreparationexpensesIntheeventsuchcostsexceedtheapplicationfeetheApplicantshallpaythedifferencetotheCitywithinthirty30daysfollowingreceiptofanitemizedstatementofsuchcostsConverselyifsuchcostsarelessthantheapplicationfeetheCityshallrefundthedifferencetotheApplicantBAnapplicationforaninitialFranchiseforaCableSystemshallcontainatamInImum1AstatementastotheproposedFranchiseandinformationrelatingtothecharacteristicsandlocationoftheproposedCableSystem2AresumeofpriorhistoryoftheApplicantincludingtheexpertiseoftheApplicantintheCableSystemfield3InformationdemonstratingtheApplicantslegaltechnicalandfinancialabilitytoconstructandoperatetheproposedCableSystem4AlistofthepartnersgeneralandlimitedoftheApplicantifapartnershipmembersifalimitedliabilitycompanyorthepercentageofstockownedorcontrolledbyeachstockholderhavingafivepercent5orgreaterinterestifacorporation5AlistofofficersdirectorsandkeyemployeesoftheApplicanttogetherwithadescriptionofthebackgroundandexperienceofallsuchpersons4 6ThenamesandaddressesofanyparententityorsubsidiaryoftheApplicantoranyotherbusinessentityowningorcontrollingtheApplicantinwholeorinpartorownedorcontrolledinwholeorinpartbytheApplicant7Aproposedconstructionandserviceschedule8AnyotherreasonableinformationthattheCitymayrequestTheCityshallbeallowedtheopportunitytoaskrelevantfollowupquestionsandobtainfurtherinformationfromwhateversourceArefusalbyanApplicanttocooperateorproviderequestedinformationissufficientgroundsfortheCitytodenyanapplicationCUponreceiptofanapplicationforaninitialFranchiseandafterobtaininganyadditionalinformationtheCityinitssolediscretiondeemsappropriatefromanysourceahearingshallbescheduledtoallowpubliccommentAtthehearingtheCityCouncilshallreceivepubliccommentregardingthefollowing1WhetherthepublicwillbenefitfromgrantingaFranchisetotheApplicant2WhethertheApplicantappearstohaveadequatelegalfinancialandtechnicalqualificationsandcapabilitiestobuildoperateandmaintainaCableSystemintheCity3WhethertheApplicanthasanyconflictinginterestseitherfinancialorcommercialthatwillbecontrarytotheinterestsoftheCity4WhethertheApplicantwillcomplywithallofthetermsandconditionsplaceduponaFranchiseebytheFranchisethisOrdinanceandotherapplicablelocallawsandregulations5WhethertheApplicantwillcomplywithallrelevantfederalandstatelawsandregulationspertainingtotheconstructionoperationandmaintenanceoftheCableSystemDWithinsixty60daysafterthecloseofthehearingtheCityCouncilshalldecidewhethertograntaFranchiseandonwhatconditionsTheCityCouncilsdecisionshallbebasedupontheapplicationanyadditionalinformationsubmittedbytheApplicantorobtainedbytheCityfromanysourceandpubliccommentsTheCityCouncilmaygrantone1ormoreFranchisesormaydeclinetograntanyFranchiseSection8DurationThetermofanyFranchiseandallrightsprivilegesobligationsandrestrictionspertainingtheretoshallbespecifiedintheFranchiseTheeffectivedateofanyFranchiseshallbeasspecifiedintheFranchiseSection9FranchiseTerritoryTheFranchiseterritoryshallincludeallareaswithintheCityoralesserareaasspecifiedintheFranchise5 Section10PolicePowersInacceptinganyFranchisetheFranchiseeacknowledgesthatitsrightsthereunderaresubjecttothepolicepowersoftheCitytoadoptandenforceordinancesnecessaryforthehealthsafetyandwelfareofthepublicanditagreestocomplywithallapplicablelawsenactedbytheCitypursuanttosuchpowerSection11UseofRightsofWayForthepurposesofoperatingandmaintainingaCableSystemintheCityaFranchiseemayplaceandmaintainwithintheRightsofWaysuchpropertyandequipmentasarenecessaryandappurtenanttotheoperationoftheCableSystemPriortoconstructionoftheCableSystemintheRightsofWaytheFranchiseeshallprocureallnecessarypermitspayallapplicablefeesinconnectiontherewithandcomplywithallapplicablelawsregulationsresolutionsandordinancesincludingbutnotlimitedtolanduseandzoningrequirementsSection12PoleorConduitAgreementsNoFranchiseshallrelieveFranchiseeofanyofitsobligationsinvolvedinobtainingpoleorconduitagreementsfromanydepartmentoftheCityanyutilitycompanyorfromothersmaintainingfacilitiesintheRightsofWaySection13FranchiseFeesTheFranchiseeshallpaytheCityfranchisefeesInaccordancewiththetermsoftheFranchiseSection14TaxesNothinginthisOrdinanceshalllimittheFranchiseesobligationtopayapplicablelocalstateandfederaltaxesSection15CustomerServiceStandardsAACableOperatorwillfirstresolveCustomerinquiriesandcomplaintswithoutdelayandwithoutinvolvementoftheCityWhereagivencomplaintisnotaddressedbytheCableOperatortotheCustomerssatisfactiontheCitymayinterveneThesestandardsareintendedtobeofgeneralapplicationACableOperatorisfreetoexceedthesestandardsforthebenefitofitsCustomersHowevertheCableOperatorshallberelievedofobligationshereunderifitisunabletoperformduetoaforcemajeureeventaffectingasignificantportionoftheFranchiseAreaBrllftomerService6 1ronrtefYAllemployeesoftheCableOperatorshallbecourteousknowledgeableandhelpfulandshallprovideeffectiveandsatisfactoryserviceinallcontactswithCustomers2AVIillhilityInclAcceffihilityTnPerfonTheCableOperatormustmaintainataminimumone1fullservicecustomerservicecenteroralternativelytwo2colocationcustomerservicelocationsconvenientlylocatedontheEastsideThefullservicecustomerservicelocationshallatalltimesallowCustomerstomakepaymentsreturnequipmentorgetassistancefromknowledgeablestaffThefullservicecustomerservicecenterorlocationsshallbeopenMondaythroughSaturdayexcludinglegalholidayswithsufficienthoursnecessarytomeetCustomerdemandIfthefullservicecustomerservicecenterorlocationsisarerequiredtorelocatetheCableOperatorshallbeallowedareasonableperiodoftimetoestablishanewlocation3AvIillhilityInnAcceffihilityOntheTelephoneACSRwillbeavailabletorespondtoCustomerinquiriesduringnormalbusinesshoursTheCableOperatorshallmaintainlocalortollfreetelephoneaccesslinesthatshallbeavailableduringnormalbusinesshoursforservicerepairrequestsandbillinginquiriesTheCableOperatorshallretainsufficientCSRsandtelephonelinecapacitytoensurethatduringnormaloperatingconditionstelephonecallstoservicerepairandbillinginquirylinesareansweredwithinthirty30secondsorlessandthatanytransfersaremadewithinthirty30secondsThisstandardshallbemetnolessthanninety90percentofthetimemeasuredonaquarterlybasisundernormaloperatingconditionsUndernormaloperatingconditionsthetotalnumberofcallsreceivingbusysignalsshallnotexceedthreepercent3ofthetotaltelephonecallsTheCableOperatorshallnotberequiredtoacquireequipmentorperformsurveystomeasurecompliancewithanyofthetelephoneansweringstandardsaboveunlessanduntiltheCityrequestssuchactionsbasedonahistoricalrecordofCustomercomplaintsindicatingaclearfailuretocomplyCRefponfiveneff1TheCableOperatorshallcompleteallstandardinstallationswithinseven7businessdaysafteranorderhasbeenplacedunlessotherwiserequestedbytheCustomerStandardinstallationsshallincludethosethatarelocatedwithin125aerialfeetoftheCableOperatorsdistributionsystemThisstandardmustbemetninetyfivepercent95ofthetimeundernormaloperatingconditionsasmeasuredonaquarterlybasisIftheCustomerrequestsanonstandardinstallationortheCableOperatordeterminesthatanonstandardinstallationisrequiredtheCableOperatorshallprovidetheCustomerinadvancewithatotalinstallationcostestimateandanestimateddateofcompletion2Undernormaloperatingconditionsalltemporarycabledropsshallbeconvertedtoapermanentdropwithinnomorethanthree3calendarweeksfromtheinitialinstallationoratatimemutuallyagreeduponbetweentheCableOperatorandCustomer7 3Customersrequestinginstallationofcableserviceorrepairservicetoanexistinginstallationmaychooseanyavailablefour4hourblockoftimefortheappointmentduringnormalbusinesshours4TheCableOperatorshallbedeemedtohaverespondedtoarequestforserviceundertheprovisionsofthissubsectionwhenatechnicianarriveswithintheagreedupontimeIftheCustomerisabsentwhenthetechnicianarrivesthetechnicianshallleavewrittennotificationoftimelyarrivalArecordthatnoticewasprovidedshallbekeptbytheCableOperator5IfaCableOperatorrepresentativefailstokeepaninstallationorserviceappointmentforanyreasontheCableOperatorwillcontacttheCustomerbeforetheendofthescheduledappointmentandrescheduletheappointmentatatimeconvenientfortheCustomer6TheCableOperatorshallrespondtoaCustomersletterinwritingwithinone1weekofreceiptoftheletterTheCableOperatorshallrespondtoaCustomersinquirycomplaintgeneralquestionorcommentmadebytelephoneoremailwithinfortyeight48hours7AnydifficultiesthatcannotberesolvedbytheCSRshallbereferredtotheappropriatesupervisorwhoshallusehisherbesteffortstocontacttheCustomerwithineight8hoursofinitialcontactandresolvetheproblemwithinamutuallyagreeabletimeframeDRIirfInnOlltleef1TheCableOperatorshallrenderefficientservicemakerepairspromptlyandinterruptserviceonlyforgoodcauseandfortheshortesttimepossibleScheduledinterruptionsthattheCableOperatoranticipateswilllastmorethanfour4hoursshalloccurduringperiodsofminimumuseofthecablesystemasreasonablydeterminedbytheCableOperator2IfaCustomercallstoreportpoorsignalqualityorinterruptionsattributabletotheCableOperatorsequipmenttheCableOperatorshallbeginworkingontheproblemnolaterthanthenextdayfollowingtheCustomerscallprovidedthattheCustomerisavailableoratsuchlatertimeasisconvenientfortheCustomerIfanappointmentisnecessarytheCustomermaychooseafour4hourblockoftimeduringnormalbusinesshoursorsuchothertimethatisconvenientfortheCustomer3Upondiscoveryofanoutageaffectingthree3ormoreCustomerstheCableOperatorshallinitiateitsoutagerepairprocesswithintwo2hoursundernormaloperatingconditions4TheCableOperatorshallinitiaterepairstoCustomerreportedserviceinterruptionsforanycausebeyondthecontroloftheCableOperatorwithintwentyfour24hoursaftertheconditionsbeyonditscontrolhavebeencorrected5Undernormaloperatingconditionsifaftertwentyfour24hoursserviceisnotrestoredtoaCustomertheCableOperatorshalluponaCustomersrequestprovidearefundorcreditorothercompensationofequalorgreatervalue8 6TheCableOperatorwilltrackandrecordalloutagesandserviceinterruptionsthatoccurwithintheFranchiseArea7TheCableOperatorshallendeavortonotifytheCitythenextbusinessdayofanyoutageofatleastone1continuoushourthataffects100ormoreofitsCustomersERillfrrelitJRefimclfInclnofit1TheCableOperatorshallprovideaclearandconcisebilleverymonth2IfaCustomerrequestsdisconnectionofanyorallservicesbillingforaffectedservicesshallendonthesamedayastherequestoronthefuturedateforwhichthedisconnectisorderedHowevertheCustomermaycontinuetobebilledforequipmentuntilreturnedtotheCableOperatorTheCableOperatorshallissueacreditorrefundtoaCustomerwithinthirty30businessdaysafterthecloseofthebillingcyclefollowingthereturnoftheequipmentandrequestfordisconnectionIfaCustomerwasrequiredtoprovideadepositthatdepositmustbereturnedwithanyinterestaccruedonthedepositFTreltmentofPropertyOwnerfProperty1RemovalortrimmingoftreesandshrubsintheRightofWaywillbesubjecttotheregulationsoftheCity2TheCableOperatorshallrepairanydamageorrestoreanypropertytoasgoodaconditionasbeforetheworkcausingsuchdamageordisturbancewasinitiatedTheCableOperatorshallrepairreplaceorcompensateallpropertyownersfordamagesresultingfromtheCableOperatorsinstallationconstructionserviceorrepairactivities3ExceptinthecaseofanemergencyinvolvingpublicsafetyorserviceinterruptiontoalargenumberofCustomerstheCableOperatorshallgivereasonablenoticetopropertyownersorlegaltenantspriortoenteringuponprivatepremisesandthenoticeshallspecifytheworktobeperformedprovidedthatinthecaseofplannedconstructionoperationssuchnoticeshallbedeliveredorprovidedatleasttwentyfour24hourspriortoentryAllworkdoneintheRightofWayshallbesubjecttotimerequirementsofthepermit4Nothinghereinshallbeconstruedasauthorizingaccessorentrytoprivatepropertyoranyotherpropertywheresuchrighttoaccessorentryisnototherwiseprovidedbylaw5FortheinstallationofpedestalsorothermajorconstructionorinstallationprojectstheCableOperatorshallnotifybymailordoorhangertheadjacentpropertyownerslegaltenantsinadvanceoftheRightofWayworkInthecaseofanemergencytheCableOperatorshallattempttocontactthepropertyownerorlegaltenantinpersonandintheeventpersonalcontactisnotmadetheCableOperatorshallleaveadoorhangernotice6TheCableOperatorshallcleanallareassurroundinganyworksiteofdebriscausedbytheCableOperatorsactivitiesandensurethatallcablematerialsaredisposedofproperly9 1TheCableOperatorshallestablishwrittenproceduresforreceivingactinguponandresolvingCustomercomplaintsandcreditingCustomeraccountsinaccordancewithcompanypoliciesandshallpublicizesuchproceduresthroughprinteddocumentsattheCableOperatorssoleexpense2ThewrittenproceduresshalldescribeasimpleprocessbywhichanyCustomermaysubmitacomplaintinpersonorbytelephoneelectronicmailorbylettertotheCableOperatorregardinganallegedviolationofanyprovisionoftheseCustomerservicestandardsanytermsorconditionsoftheCustomerscontractwiththeCableOperatororreasonablebusinesspractices3TheCableOperatorwilluseitsbesteffortstoresolveCustomerconcernsorcomplaintsatthefirstcontact4TheCableOperatorshallalsonotifytheCustomeroftheCustomersrighttofileacomplaintwiththeCityintheeventtheCustomerisdissatisfiedwiththeCableOperatorsdecision5rompllinttotherityAnyCustomershallbeentitledtolodgeanycomplaintdirectlywiththeCityTheCustomermaylodgethecomplainteitherbycallingtheCityorbyfilingawrittencomplaintbyletterorinelectronicform6IftheCitydecidesthatfurtheractioniswarrantedtheCitymayintercedeandattempttohelpreacharesolutionandorrequiretheCableOperatortoaddresstheinquirywithintwentyfour24hoursUponrequestbytheCitytheCableOperatorshallnotifytheCityofthestatusoftheinquirywithinfortyeight48hoursandanysubsequentresolution7TheCableOperatorshallmaintaininamannerconsistentwiththeprivacyrightsofCustomersanaccurateandcomprehensivefileofcomplaintsregardingthecablesystemortheCableOperatorsoperationofthecablesystembynumberandtypeandtheirdispositionservicerequestsidentifyingthenumberandnatureoftherequestsandtheirdispositionoutagesserviceinterruptionsandtheirdispositionandCustomerprivacyinformation8OverlllQlmlityofServiceTheCitymayevaluatetheoverallqualityofCustomerserviceprovidedbytheCableOperatortoCustomersintheCityatitssolediscretionbasedonthenumberofCustomercomplaintsreceiveddirectlybytheCityorreportedbytheCableOperatorinitsreportsKVerificItionofromplilnceUponwrittenrequestbytheCitytheCableOperatorshalldocumentitscompliancewithalloftheStandardsrequiredthroughquarterlyreportsLNoncomplilncewithStmcllrnfNoncompliancewithanyprovisionoftheseStandardsmayresultinaviolationofthefranchiseMRemenyineViolltlonfIftheCityhasreasontobelievethattheCableOperatorhasfailedtocomplywithanyoftheseStandardsorhasfailedtoperforminatimelymannerorifsimilarcomplaintsrepetitivelyarisetheCitymayrequireinwritingthattheCableOperatorremedythe12
