CITYOFMEDINAORDINANCENO797ANORDINANCEAMENDINGMMC1712010MMCCHAPTER1408ANDMMC1756020TOMODIFYPROCEDURESFORADMINISTRATIVEREVIEWSOFCERTAINDISCRETIONARYLANDUSEPERMITSTHECITYCOUNCILOFTHECITYOFMEDINADOORDAINASFOLLOWSSECTION1MMC1712010AMENDEDMedinaMunicipalCode1712012DefinitionsisamendedforthefollowingdefinitionMinorDeviationmeansadiscretionarylandusepermittoallowbuildingremodelingproiectstodepartfromchangesinnumericdevelopmentstandardsandtopreservenonconformingconditionswithrespecttosetbackrequirementsandmaximumbuildingheightsRequestsforMinorDeviationsarereviewedbytheCityManagerordesigneeandinvolvepublicnoticeasspecifiedinMMCChapter1408SECTION2MMC1408AMENDEDMedinaMunicipalCodeChapterl408isamendedtoreadasfollows1408010FindingsconditionsAVariancesThecitymanagerordesigneemaygrantadministrativevarianceswhenallofthefollowingconditionsarepresent1ExceptionalorextraordinarycircumstancesapplytothepropertyitselfsuchaslotsizeshapeortopographywhichdonotapplygenerallytoallotherpropertiesinthesamezoneorvicinityQualifyingcircumstancesshallnotbetheresultoftheactionsoftheapplicantorofthewrongfulactionsofanypreviousownerthattheapplicantwasawareoforthattheapplicantshouldhavebeenawareofwiththeexerciseofreasonablecare2Thevarianceisnecessaryforthepreservationofapropertyrightoftheapplicantsubstantiallythesameasispossessedbyownersofotherpropertyinthesamezoneorvicinity3Thegrantingofthevariancewillnotbedetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichthesubjectpropertyislocated4ThegrantingofavariancewillnotconstituteagrantofspecialprivilegeinconsistentwiththelimitationsonotherpropertiesinthesamezoningdistrictOrdinanceNo797 5ThevarianceisnecessarytorelieveamaterialhardshipwhichcannotberelievedbyanyothermeansThematerialhardshipmustrelatetothelanditselfandnottoproblemspersonaltotheapplicant6Thevariancepermittedistheminimumvariancenecessary7ThevarianceiscompatiblewithandmeetsthespiritofthecomprehensiveplanBIndeterminingwhethertoapproveanapplicationforavarianceevidenceofvariancesgrantedundersimilarcircumstancesshallnotbeconsideredCInauthorizationofavariancethecitymanagerordesigneemayattachsuchconditionsregardingthelocationcharacterandotherfeaturesoftheproposedstructureasheorshemaydeemnecessarytocarryoutthespiritandpurposeoftheMedinaZoningCodeandthepublicinterestDMinorDeviationsTheCityManagerordesigneemaygrantminordeviationswhenallofthefollowingconditionsarepresent1TheproposeddevelopmentwillnotsubstantiallyreducetheamountofprivacyfromthelevelenjoyedbyusersofnearbystructuresifthedevelopmentwerelocatedasspecifiedbythisCode2Thegrantingofthedeviationwillnotalterthecharacteroftheneighborhoodnorimpairtheappropriateuseordevelopmentoftheproperty3Thegrantingofthedeviationwillnotbemateriallydetrimentaltothepublicwelfareorinjurioustothepropertyorimprovementsinthevicinityandzoneinwhichthepropertyissituated4ThedeviationisconsistentwiththepoliciesandprovisionsofthezoningcodethecomprehensiveplanandanyotherapplicablestandardsorpoliciesadoptedbytheCityofMedinaEConditionsAnyadministrativevarianceorpermitmaybegrantedsubjecttosuchconditionsaswillassurethatthevarianceshallnotconstituteagrantofspecialprivilegesinconsistentwiththelimitationsuponotherpropertiesinthevicinityandzoneinwhichsuchpropertyislocatedFIneligibleMinorDeviationsRequestsTheminordeviationsprocessmaynotbeusedtoobtainfinalapprovalofastructurewherecompliancewiththedevelopmentstandardwasrepresentedbytheapplicantinthebuildingpermitapplicationProjectsconsistingofabuildingalterationorimprovementforaresidencethatwascompletedatanytimewithinthepreviousfiveyearsareineligibleforminordeviationsrequestsTheminordeviationsprocessmaynotbeusedforaproiectthatincreasestheamountofbuildingbulkinasetbackareaoraboveabuildingheightlimitifthesubiectpropertyis16000squarefeetorgreaterinnetlotarea1408020SCOPEOFADMINISTRATIVEREVIEWSAAdministrativevariancesmaybeauthorizedforthefollowingmatters1Fenceandwallvarianceslessthaneight8feetinheight2StructuralcoverageincreasesoflessthanonepercentofthelotareaBAdministrativepermitsmaybeauthorizedforthefollowingmattersITreetrimmingandremovalintherightofway2SpecialusepermitsforswimmingpoolsspasandsportscourtsCApermitapplicantmayrequestaMinorDeviationfromanynumericdevelopmentstandardcontainedintheZoningCodeTherequestwillbeprocessedaccordingtotheOrdinanceNo7972 proceduresforadministrativereviewofapplicationscontainedinthischapterThereviewcriteriathatwillbeappliedareidentifiedinsubsection140801OBofthischapterEligibleMinorDeviationrequestsarelimitedtonogreaterthan5ofthedevelopmentstandardWherethedevelopmentstandardisexpressedasapercentagesuchasstructuralcoveragethe5limitonMinorDeviationrequestsiscalculatedasthedevelopmentstandardpercentagemultipliedby105MinorDeviationsmayberequestedfromqualifyingconditionsusedinZoningCodedevelopmentstandardssuchasthereducedhouseheightforwhichastructuralcoveragebonusisawardedDApermitapplicantmayalsorequestaMinorDeviationtoallowanadditiontoabuildingthatmatchesalegallvestablishedbuildingheightorsetbacknonconformityMatchingabuildingheightnonconformityisdefinedasaminoradditionthatextendsabovethepresentmaximumbuildingheightstandardbutdoesnotexceedthehighestpointoftheexistingbuildingMatchingasetbacknonconformityisdefinedasaminoradditionthatdoesnotcomplywiththepresentsetbackstandardbutextendsnoclosertothepropertylinethantheclosestpointoftheexistingbuildingThisMinorDeviationisnotintendedtoallowanapplicanttobuildanadditionthatoccupiestheentirenonconformingenvelopeSECTION3EFFECTIVEDATEThisordinanceshalltakeeffectfivedaysafteritspublicationorthepublicationofasummaryofitsintentandcontentsPASSEDBYTHECITYCOUNCILONTHIS27OkMilesRAdamMayorApprovedastoformAttestPassedOrdinanceNo7973
