HomeMy WebLinkAboutOrdinance No. 0919h IF: ORDINANCE NO. 919 AN ORDINANCE OF THE CITY OF, EDI A„ WASHINGTON AMENDING VARIOUS SECTIONS OF CHAPTER 20.40 OF THE MEDINA MUNICIPAL CODE RELATING TO BUILDING; AND AMENDING SECTION 0.40.110 OF THE MEDINA MUNICIPAL CODE TO EXEMPT CERTAIN MAINTENANCE ACTIVITIES FROM THE REQUIREMENTS FOR A GRADING PERMIT lF WHEREAS, the City Council has enacted Chapter 20.40 of the Medina Municipal Code regulating building; and WHEREAS, the City Council adopted Ordinance No. 852 adopting Appendix J, Grading, of the International Building Code (IBC) and amendments thereto to regulate grading; activities; and y WHEREAS, CWW 19, 7.0 1 provides that that there shall be in effect in all counties, towns and cities the state building code, which shall consist of the International Building Code„ Fire, Residential and Mechanical Codes, along with a number of different enumerated code which are adopted by reference (collectively referred to as the "State Building Code"); and WHEREAS, RCWW 19, 7,040 provides that the governing body of each county, town or city is authorized to amend the State Building Code as it applies within the jurisdiction of the county or city so long as the minimum performance standards of the codes and the } objectives enumerated in RCWW19,27,020 are not diminished by any such amendments, - and i WHEREAS, the State Building Code is amended from time to time by the State 3 Building Code Council pursuant to RCW 19, 7.00 ; and WHEREAS, the State Building Code Council adopted the 2012 editions of the International Building, Fire Residential and Mechanical Codes, along with updates to other enumerated codes that comprise the Mate Building Code', and i WHEREAS, S, Section 20.40.010 of the Medina Municipal Code was amended by Ordinance No. 899, approved by the City Council on June 1`0, 2013, adopting the 2012 editions of the State Building Code; and WHEREAS, the City Council desires to amend various sections of Chapter 20,40 MMC to male corrections and update internal references to reflect adoption of the 2012 editions of the applicable International codes as part of the State Building Code; and WHEREAS,, the City Council desires to provide an additional exception from the requirements for a grading permit for normal and routine maintenance of public pans and public and private golf courses where the impacts of such activities minimally <affect the public; and c WHEREAS, the City Council has determined that it is in the best interest of the I# public health, safety and 'welfare to update Chapter 20.40 MMC to reflect adoption of the 2012 editions of the applicable International codes as part of the State Building Code and to c provide an additional exception from grading permit requirements; and �t Ordinance No 919 Page 1 of i _ �i l WHEREAS, the Responsible Official determined that the adoption of an ordinance pertaining solely to governmental procedures and containing no substantive standards respecting use or modification of the environment is exempt from the State Environmental # Policy Act pursuant to WAC 1-1 1-Itlt1 , NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, l DOES ORDAIN AS FOLLOWS: Section 1. Section 20.40.020 Amended. Section 20.40. 20 of the Medina Municipal Code is hereby amended to read as follows: Subsection 101.2 of the 2012 International Building Code is amended to read as follows: Section 2. Section 20.4 .050 Amended. Section 20.49�.050 of the Medina Municipal Code is hereby amended to read as follows: i Subsection 105.2 of the 2012 IBC and Subsection R105.2 of the 1 II , which h lists work of a building nature that is exempt from building permit requirements, are amended to read as follows: Section 3. Section 20.40.060 Amended. Section 20.40.969 of the Medina u: Municipal Code is hereby amended to read as follows-, i Subsection 1.5 of the 2012 International Building Cade and Subsection R105.5 of the { 2012 International Residential Code are hereby amended to ream as follows: Section 4. Section 20.40.070 Amended. Section 20.4 .115 Amended. Section 20,40,115 of the Medina Municipal 1 Code is hereby amended to read as follows: Section J 104 of Appendix J of the 2012 International Building Code is amended to add a new subsection to read as follows: i Section 9. aeyerabilit^y. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section; sentence, clause, or phrase of this ordinance. Section 10. Effective [date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent or contents.
