CITY OF MEDINA, WASHINGTON, AMENDING SECTIONS 20.81.040
AND 20.81.060 OF THE MEDINA MUNICIPAL CODE (MMC) RELATING
TO TEXT AMENDMENT PROCEDURES
WHEREAS, the City of Medina is classified as a non -charter code City under title 35A
RCW; and
WHEREAS, pursuant to RCW 35A,63.100(2), amendments to zoning ordinance may not
be enacted without at least one ,qub
agency or such other body as the legislative body shall designate; and
WHEREAS, the City Council approved Ordinance No. 855 adopting Chapter is of the
Medina Municipal Code on July 12, 2010, establishing procedures for processing text
amendments to development regulations; and
WHEREAS, the City Council directed the Planning Commission at their January 9, 2018,
regular meeting to review proposed amendments to Chapter 20.81 MMC pursuant to MMC
20.81.040(A); and
WHEREAS ' the Planning Commission considered the proposed amendments to Chapter
20.81 MMC at their January 23, 2018, regular meeting, and voted to forward a recommendation
to the City Council; and
WHEREAS� the City Council considered the Planning Commission's recommendation at
their March 12, 2018, re ular meeting and scheduled a pubt
9 ic hearing for April 16, 2018; and
'IVHEREAS, in accordance with RCW 36.70A. 106(3)(b), a notice of intent was transmitted
to the Washington State Department of Commerce on January 31, 2018, requesting expedited
review, (Material ID # 24597), and expedited review was granted on February 15, 2018; and
WHEREAS, the adoption of an ordinance pertaining to review procedures relates solely
to governmental procedures and contains no substantive standards respecting use or
modification of the environment and is therefore exempt from the requirements of the State
Environmental Policy Act pursuant to WAC 197-11-800(19); and
WHEREAS, notice of the public hearing was published in The Seattle Times on March 22,
2018, in accordance with the content set forth in MMC 20.83,120, and posted to the City's notice
boards and website on March 21, 2018; and

V!HEREAS, the City Council held a public hearing on April 16, 2018, to receive testimony
for and against the proposed amendments to Chapter 20,81 MMC and following the hearing
deliberated on the proposal.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO
*RDAIN AS FOLLOWS:
Section 1. Amend MMC 20.81.040. Section 20.81 .040 of the Medina Municipal Code is
amended as follows,

Section 2. Amend MMC 20.81.050. Section 20.81 .050 of the Medina Municipal Code is
amended as follows:

or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of
this ordinance or its application to other persons or circumstances.
Section 4. Effective Date. A summary of this ordinance shall be published in the officia[
newspaper of the City, and the ordinance shall take effect and be in full force five 1(5) days after tht
tate of publication.
