PROHIBITING UNSANITARY ACTS IN PUBLIC; AND ESTABLISHING AN EFFECTIVE DATE �i WHEREAS, there have a growing number of instances of public urination and defecation within the City of Medina; and WHEREAS, the Medina Municipal Code does not prohibit public urination or defecation; and WHEREAS, public urination and defecation is unsanitary and a threat to the public health, safety and welfare; and WHEREAS, the City Council desires to adopt code provisions prohibiting such acts and providing enforcement mechanisms therefor; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: 1TAET06yefir,ro =-J11411ZM$ IT* -a Section8.10.010 Urinating or Defecating in Public A. It is unlawful for any person to urinate or defecate in a public place other than a washroom or toilet room or other facility specifically designated and intended for that use. B. All offenses defined in Section 8. 10. 010 shall constitute a Class 1 civil infraction pursuant to Chapter 7.80 RCW, which is hereby incorporated by reference, and shall be enforced in accordance therewith. Section 2. Severability. Should any section, paragraph, sentence, clause or phrase of this *rdinance, or its application to any person or circumstance, be declared unconstitutional or ttherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state ir federal law or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or circumstances. Section 3. Clerical Corrections. The City Clerk is directed to take steps as required to implement and effectuate the terms of this Ordinance and incorporate its provisions into the Medina Municipal Code. The Clerk is authorized to correct scrivener's errors, internal references, and the like. Ordinance No. 964 Page 1 of 2 Section 4. Effective Date. This Ordinance shall take effect five (5) days after its publication or the publication of the attached summary of its intent and contents.
