MEDINA CITY COUNCIL
AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON,
AMENDING PROVISIONS OF MEDINA MUNICIPAL CODE
SECTION 2.66.010 RELATING TO THE CONTRACT APPROVAL
AUTHORIZATION OF THE CITY MANAGER; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, MMC Section 2.66.010(A) authorizes the Medina City Manager to enter into
and execute on behalf of the City contracts for less than $15,000; and
WHEREAS, MMC Section 2.66.010(A) was adopted in 2004 and has not been revisited
or revised to account for the increased costs of goods and services; and
WHEREAS, the average contract amount executed for City contracts consistently
exceeds the City Manager's signing approval, causing contract executions to be delayed by a
month or more while awaiting Council approval; and
WHEREAS, the purpose of authorizing the City Manager to enter into contracts for the
City's day-to-day needs is to increase efficiency of the City's work, reduce wait times for
contract executions, and streamline Council agendas. Those goals are not being achieved due
to the City Manager's outdated signing approval limit; and
WHEREAS, the City Manager's contract approval authorization should be increased to
$50,000 limit, which is consistent with other jurisdictions; and
WHEREAS, the City Council finds that this code amendment will further the public's
health, safety and welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
DOES ORDAIN AS FOLLOWS:
Section 1. Findings. The City Council hereby makes the following findings:
B. This ordinance increasing the City Manager's contract approval authorization amount is
in the best interest of the public health, safety, and welfare.
A. The foregoing recitals are adopted as Council findings in support of this ordinance.
Section 2. Amendment of Section 2.66.010(A). Section 2.66.010(A) of the Medina
Municipal Code is hereby amended to read as follows:
A. The city council authorizes the city manager to enter into and execute on behalf of the
city the following contracts without individual approval of each contract by the city council, so
long as the contract is consistent with the approved annual budget for the city, and the city's
liability under the contract does not exceed available fund balances:

1. Contracts for purchases of goods, supplies, materials, or equipment involving a cost
or fee (excluding sales tax) of less than $1045,000.
2. Professional service contracts, including contracts for architectural, engineering, legal,
and consulting services involving a cost or fee (excluding sales tax) of less than
$§0 46,000.
3. Maintenance contracts involving a cost or fee (excluding sales tax) of less than
$510,000 per year.
4. Public works projects involving a cost or fee of less than $50,00035,000 ifwel
multiple tFades and $20,GGG invelying a eiRgle tFa4e.
5. Settlement agreements involving a cost or fee of less than $520,000, including
retention of legal counsel and expert consultants, involving damage claims or suits.
6. Other routine agreements where no expenditure is involved, or the cost, expenditure,
or fee (excluding sales tax) does not exceed $540,000.
7. Lease agreements for materials, supplies, and equipment where the expenditure or
fee does not exceed $540,000.
8. Sale of unneeded surplus personal property with an estimated cumulative value of
$540,000 or less, which has been certified for disposition, such sale or disposition to be
made by the city manager in accordance with informal procedures and in the best
interest of the city.
9. Contracts that carry out or implement a provision of the Medina Municipal Code or
established city policy, e.g., maintenance or performance bonds for plat improvements.
10. Emergency Contracts. "Emergency" means a set of unforeseen circumstances that
either:
a. Presents a real, immediate threat to the proper performance of essential
functions; or
b. May result in material loss or damage to property, bodily injury, or loss of life if
immediate action is not taken; or
c. For public works projects, may result in a substantial loss to the city if the
contract is not immediately entered into.
11. Employment and Personnel Contracts for Positions That Have Been Approved by
the City Council. All compensation, including wages, salaries and benefits such as
health, dental and vision insurance, vacation time, sick leave, severance pay and similar
matters, shall be established by the city council through budget allocation, motion,
resolution, ordinance or approval of a contract. Compensation may be established in a

fixed sum or the city manager may determine the exact sum if the city council
establishes a compensation range,
Section >3. Corrections. The City Clerk and codifiers of the ordinance are authorized to
make necessary corrections to this Ordinance including, but not limited to, the correction of
scrivener/clerical errors, references, ordinance numbering, section subsection numbers and any
references thereto.
Section 4. Severabilit . If any section, subsection, paragraph, sentence, clause or
phrase of this Ordinance is declared unconstitutional or invalid for any reason, such invalidity
shall not affect the validity or effectiveness of the remaining portions of this Ordinance.
Section 5. Effective Date. This ordinance or a summary thereof consisting of the title
shall be published in the official newspaper of the City and shall be in full force and effect five
(5) days after publication.
