HomeMy WebLinkAboutOrdinance No. 0981Ordinance No. 981 MEDINA CITY COUNCIL AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, AMENDING MEDINA MUNICIPAL CHAPTER 2.04 TO UPDATE CERTAIN TERMS, REFERENCES AND COUNCIL MEETINGS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, certain references and terms in existing Chapter 2.04 are outdated and obsolete, rendering certain provisions superfluous; and WHEREAS, the City Council desires to amend existing Chapter 2.04 in order to establish regularly scheduled meetings as well as update certain references and terms as described in Exhibit A, attached and incorporated herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Amendment to MMC Chapter 2.04. Chapter 2.04 of the Medina Municipal Code hereby amended as described in Exhibit A, attached and incorporated herein. Section 2. Corrections. The City Clerk and codifiers of the ordinance are authorized to make necessary corrections to this Ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or effectiveness of the remaining portions of this Ordinance. Section 4. Effective Date. This ordinance or a summary thereof consisting of the title shall be published in the official newspaper of the City and shall take effect and be in full force five (5) days after publication. In the event a regular meeting date falls on a legal holiday, the regular meeting day shall be held on the Tuesday following the second and fourth Monday of each month. B. The second meeting of the month is set as a regular meeting for the convenience of the council and the efficient performant of the council's duties and the city's business, and may be cancelled in the event city or council business does not warrant convening such meeting. C. No regular meetings will be scheduled in the month of August. 2.04.020 Place. The regular meeting place of the city council will be at the Medina City Hall, 501 Evergreen Point Road, Medina, WA 98039. . Ordinance No. 981 Page 3 of 5 2.04.030 Rules of order. Except as otherwise provided in this chapter, the procedure of the meetings of the city council shall be governed by Robert's Rules of Order Revised, SeYeAty Fikh AnniveFsafy Ed4leRCurrent Edition. 2.04.040 Order of business. Repeated by Ord. 809. 2.04.050 Duties of presiding officer. It is the duty of the presiding officer of the council meeting to: A. Call the meeting to order. B. Keep the meeting to its order of business. C. Handle discussion in an orderly way: 1. Give every councilmemberma who wishes a chance to speak; 2. Permit audience participation at appropriate times; 3. Keep all speakers to the rules of order, and to the questions; 4. Give pro and con speakers alternating opportunities to speak. D. State each motion before it is discussed, and before it is voted upon. E. Put motions to a vote and announce the outcome. F. Appoint and participate in committees when authorized to do so. 2.04.060 Authority of chair. All questions of order shall be decided by the presiding officer of the council with the right of appeal to the council by any member. 2.04.070 Right to speak. A. No member of the council shall speak more than twice on the same subject without permission of the presiding officer. B. No person who is not a member of the council shall be allowed to address the samte-Council while in session without the permission of the presiding officer. 2.04.080 Precedence and prerogative. A. Motions to lay any matter on the table shall be first in order; and on all questions, the last amendment, the most distant day, and the largest sum shall be put first. B. A motion for adjournment shall always be in order, but adiournment may be by consensus at the end of a regular meeting and completion of the council's business. C. Motions to reconsider must be by a member who voted with the majority on the action for which reconsideration is sought. Such motion shall be brought and at the same or next succeeding meeting of the council. Ordinance No. 981 Page 4 of 5 2.04.090 Ordinances, resolutions and motions to be written. Motions shall be reduced to writing when required by the presiding officer of the council or any member of the council. All resolutions and ordinances shall be in writing. 2.04.100 Suspension of rules. The rules of the city council may be altered, amended or temporarily suspended by a vote of two-thirds of the members present. 2.04.110 Committees. The city council may, from time to time, appoint temporary or long-term committees from among its membership. All committees shall dissolve at the time of the biennial election of council mayor and deputy mayor council elections. The chairperson, if any, of each respective committee of the council, or the councilmemberffvap acting for her him in her his place, shall submit or make all reports to the council when so requested by the presiding officer or any member of the council. 2.04.120 Attendance of officers. The city manager, clerk, and city attorney, and such other officers or employees of the city as may by the council be requested to do so, shall attend all meetings of the council and shall remain in the council room for such length of time as the council may direct. 2.04.130 Failure to attend — Penalty. Special meetings may be called by the mayor or any three councilmembers by written notice delivered to each member of the council at least 24 hours before the time specified for the proposed meeting. B. No ordinance or resolution shall be passed, or contract let or entered into, or bill for the payment of money allowed at any meeting not open to the public, nor at any public meeting the date of which is not fixed by ordinance, resolution or rule, unless public notice of such meeting has been given by such notice to each local newspaper of general circulation and to each local radio or television station, as provided in RCW 42.30.080 as now or hereafter amended.
