HomeMy WebLinkAboutOrdinance No. 0990Ordinance No. 990 Page 1 of 4 Ordinance No. 990 MEDINA CITY COUNCIL AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, AMENDING MEDINA MUNICIPAL CODE CHAPTER 12.24 TO ESTABLISH A NEW RULE RELATED TO THE LEASH AREA REQUIREMENTS OF MEDINA PARK; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Medina Municipal Code (MMC) 12.24 provides general rules applying to all public parks; and WHEREAS, MMC 12.24.025 provides specific rules relating to leashed and off-leashed dog areas in Medina Park; and WHEREAS, it has been brought to the City Council’s attention that the seasonal restriction of leashed dog areas is cumbersome and challenging to enforce; and WHEREAS, the City Council desires to streamline the enforcement and regulation of the leashed dog areas in Medina Park; and WHEREAS, the City Council desires to amend existing MMC Chapter 12.24 to address the foregoing situation as set forth in Exhibit A, attached and incorporated herein. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Amendment to MMC Chapter 12.24. Chapter 12.24 of the Medina Municipal Code is hereby amended as set forth in Exhibit A, attached and incorporated herein. Section 2. Corrections. The City Clerk and codifiers of the ordinance are authorized to make necessary corrections to this Ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or effectiveness of the remaining portions of this Ordinance. Section 4. Effective Date. This ordinance or a summary thereof consisting of the title shall be published in the official newspaper of the City and shall take effect and be in full force five (5) days after publication. PUBLISHED: 10/19/2020 EFFECTIVE DATE: 10/24/2020 ORDINANCE NO. 990 Ordinance No. 990 Page 3 of 4 EXHIBIT A Chapter 12.24 PUBLIC PARKS Sections: 12.24.010 Rules applying to all public parks. 12.24.020 Rules applying to Medina Beach Park. 12.24.025 Rules applying to Medina Park and Fairweather Park and Nature Preserve regarding pets. 12.24.030 Violation; Penalty. 12.24.025 Rules applying to Medina Park and Fairweather Park and Nature Preserve regarding pets. A. The following rules shall apply to and be enforced in Medina Park: 1.The area to the west of the dividing line shown on Exhibit A is declared to be an hereby designated as a seasonal on-leash area. During the period of time from May 1st through September 30th and from 9:00 a.m. until 10:00 p.m. each day. All dogs in this area must be on a leash, tether or chain not to exceed eight feet in length. From October 1st through April 30th, this area shall be added to the off-leash area. 2.The area east of the dividing line shown on Exhibit A is declared to be an off-leash area. Dogs in off-leash areas of the park must be within positive voice control of their owner or handler and must respond promptly to the commands of the owner or handler. 3.No owner or handler shall have more than two dogs in the park at any time. 4.No dogs shall be permitted in the north pond, at any time. B. In Fairweather Park and Nature Preserve, no owner or handler shall have more than three dogs in the park at any time. Dogs shall be within positive voice control of their owner or handler and must respond promptly to the commands of the owner or handler. 12.24.030 Violation; Penalty. Violation of the public park, Medina Beach Park, or Medina Park rules shall constitute a Class 1 civil infraction per Chapter 7.80 RCW, which is incorporated by reference.
