HomeMy WebLinkAboutOrdinance No. 0448ORDINANCE NO. 448 l AN ORDINANCE REGULATING THE SALE, PURCHASE, POSSESSION AND USE OF FIREWORKS. THE CITY COUNCIL OF THE CITY OF MEDINA DO ORDAIN AS FOLLOWS: SECTION 1. State Law Adopted: R.C.W. Chapter 70.77 as now stated or hereafteramen !I!d S adopted by reference, except as amended herein, and a copy of the same shall be kept on file in the office of the City Clerk for public use and inspection. SECTION 2. Amendment Restricting Dates and Times of Discharge of Fireworks: R.C.W. 70. 77.395 is amendea to read as Except as provided in R.C.W. 70.77.311, no common fireworks shall be discharged within the City of Medina except between 8:00 a.m. and 12:00 midnight on the 4th day of July. SECTION 3. Deg nation of Local Fire Official: The local fire official for t e City of Medina snail e the Chief of the Bellevue Fire Department or such person as he may designate to fulfill the duties of a local fire official as set forth in R.C.N. Chapter 70.77. SECTION 4. Restriction of Areas for Dischar e: No common firework designated to d scharge more than e g t (8) feet above the ground, including but not limited to fireworks commonly known as aerials and roman candles shall be ignited within one hundred (100) feet of any building, structure, residence or wooded area or in any other area where such fireworks can not be safely ignited. SECTION 5. Penalties: Any violation of this ordinance or of R.C.W. Chapter 70:77 1nincorporated herein by reference may be punished by a fine not to exceed Three Hundred Dollars ($300.00), or imprisonment not to exceed six (6) months or by a combination of such fine and imprisonment.. SECTION 6. Seizure of Fireworks: Any fireworks which are illegally sold, offered for sa e, used, discharged, possessed or transported in violation of the provisions of this ordinance, R.C.W. 70.77 or the rules and regulations of the Director of Community Development, through the Director of Fire Protection, shall be subject to seizure by the Medina Police Department. The provisions for seizure of fireworks, petition for return, hearing, decision and judicial action for recovery shall be as set forth in R.C.W. 70.77.435 and .440 provided that the Chief of Police of the Medina Police Department shall have the powers and obligations set forth in said statutes for the Director of Fire Protection. SECTION 7. Code Reference: Section 1 through 6 shall constitute Medina C ty�ections 7-13.02, 04, 06, 08, 10 and 12 respectively. V. Y SECTION 8.
