ORDINANCE NO. 477
AN ORDINANCE of the City of Medina, Washington
relating to city administration and personnel;
eliminating the Department of Public Safety and
establishing the position of chief of police;
repealing Chapter 2.12 Medina Municipal Code
(Ordinance 431); amending Section 1.08.030 (Ordinance
258) and Sections 2.16.020 and 2.16.030
(Ordinance 254) Medina Municipal Code, and adding a
new section 2.20.040 Medina Municipal Code exempting
the position of chief of police from the civil
service.
THE CITY COUNCIL OF THE CITY OF MEDINA DOES HEREBY ORDAIN
AS FOLLOWS:
Section 1. Recitals.
1.2 The City of Medina ("City) has maintained a police
department to provide for the public health and safety of the
community. Prior to 1986, the chief executive officer of the
police department was the chief of police.
1.2 In May 1986 the City created a new Department of
Public Safety. The position of chief of police was eliminated,
and the duties of the chief of police were assigned to the
director of the Department of Public Safety. Additionally, the
director of the Department of Public Safety was to coordinate
fire and marine protective services, emergency services,
emergency medical services and such other related functions and
duties as were assigned by the City Manager.
1.3 In May 1988 the City retained the Delaine Group, a law
enforcement consulting firm, to conduct a study of the
management, administrative and operational practices of the City
police department.
1.4 The Delaine Group has produced a Study of Selected
Administrative and Operational Practices of the Medina Police
Department ("Study"). The Study included a review of the
organizational structure, management procedures, and an
evaluation of personnel practices, including staffing,
scheduling, training, use of overtime, and operation of the
police department reserve program.
1.5 The City Council received the Study on July 29, 1988
and on August 8, 1988. scheduled a special meeting for August 22,
1988 to consider the study and to receive public comment. The
City Council considered the public comment as well as
information provided by staff, as well as the need to provide
more direct police services to the City.

1.6 The City accepts the Study, and takes the following
action in order to partially provide for the implementation of
Study recommendations.
Section 2. Chapter 2.12 Repealed. Chapter 2.12 Medina
Municipal Code (Ordinance 431) is hereby repealed.
Section 3. Section 2.16.020 Medina Municipal Code
(Ordinance 254) is amended to read as follows:
2.16.020 Organization. The department shall consist
of one Chief of Police, one or more corporals or
sergeants, and three or more patrol officers, all of
whom shall be regular, full time personnel of the
department, and one or more [auxiliaries] reserve
officers as permitted by the City's equipment and
appropriations therefor, together with a clerk for

the receipt of bail in the city's traffic violations
bureau, the receipt of calls, (and] operation of
communications equipment, [for dispatch, service as
clerk to the judge of the municipal court.] and such
Section 4. Section 2.16.030 Medina Municipal Code
(Ordinance 254) is amended to read as follows:
2.16.030 Duties of the Police Chief. The Chief of
Police shall be chief executive officer of the
department, responsible for the effectiveness thereof
and enforcement of local laws and general protection
of the safety of the community, its residents and
visiting public. He shall be appointed by and under
the general supervision and control of the City
Manager, reporting to [him] the City Manager or to
the Council as [he] the City Manager directs. The
Chief shall be assisted by one or more corporals or
sergeants of his selection [from among the regular
full-time officers of the department] who shall have
such duties and responsibilites as the Chief shall
asign [him]. The Chief of Police shall, before
Section 5. Section 1.08.030 Medina Municipal Code
(Ordinance 258) is amended to read as follows:
1.08.030 Continuation of Council -Manager Plan. No
new form or organization of city's government is
intended to be adopted with its reclassification as a
noncharter code city, but the same shall continue
under the council-manager plan as in RCW Ch. 35A.13
Section 6. A new section 2.20.040 is added to the Medina
Municipal Code, as follows:
2.20.040 Chief of Police Exempt. Pursuant to RCW
41.12.050, the chief of police shall be excluded from
the civil service, and consistent with Section
2,16.030 shall be appointed by the City Manager.
Section 6. Effective Date. This ordinance shall take
effect five (5) days after its publication or the publication of
a summary of its intent and contents.
