ORDINANCE NO. 490 AN.� ORDINANCE AMENDING CHAPTER 2.40 OF THE MEDINA MUNICIPAL CODE GOVERNING THE BOARD OF PARK COMMISSIONERS AND REPEALING CHAPTER 2.36 GOVERNING THE DESIGN COMMISSION SECTION 1. Chapter 2.40 Amended: Medina Municipal Code Chapter 2.40, Board of Park Commissioners, is hereby amended to read as follows: 2.40.010 Definitions Words used in this chapter shall have the following meanings: A. "Park" means an area of land, with or without water, developed and used for public recreational purposes, including landscaped tracts, picnic grounds, playgrounds, athletic fields, recreation centers, (comp&) foot(-) and bicycle (end bridle) paths, (meter vekte3e dr4ve&r) wildlife sanctuaries, (museums-, meeiagleai, and) botanical gardens, facilities for bathing, boating, (3aaa64mg,) and fishing, as well as other recreational facilities for the use and benefit of the public. B. "Board" means board of park commissioners. 2.40.020 Created -- Eligibility A. There is created a board of park commissioners, con- sisting of five members who shall be appointed by the mayor, with the consent of the city council, from interested and otherwise qualified residents of .Medina. No commissioner shall receive any compensation for his services. The commission shall not be Involved in member selection. B. The city council shall selectone from among Its number to be a member of the park commission, ex offlcio, with voting powers in the commission only where his vote will break a tie, to serve until his council term expires or a successor Is, in like manner, by the council, appointed. The duties of the ex-officia shall be: 1. Interpret City Council policy for the Board's benefit. -2. Represent the Board's intent to the City Council. 3. Otherwise help the Board accomplish its advisory duties. 4. Apprise the Board of any City Council action affect- ing parks. 2.40.030 Term of office -- Removal from office A. The terms of park commissioners shall be four years, except that at the time of initial appointments, their terms shall be so determined that the terms of not more than two mem- bers, nor lose than one, shall expire in each year. Such terms shall begin after appointment has been approved by the city coun- cil, and upon taking the usual oath. The terms of later appoin- tees shall begin on the first Monday in [guise] February and upon such qualification, and the expiration of each commissioner's term, the mayor shall appoint, with the consent of the city coun- cil, new members to fill vacancies then occurring by reason of such expiration. There is created the office of secretary to the board of park commissioners with the duty of keeping minutes of all meetings and other proceedings of said board, which office, in order to assure continuity and effective communication, shall be filled by the city manager; its duties to be discharged per- sonally by him or through his delegate. 2.40.060 Powers and duties A. (Advise) Recommend regarding conduct of any form of recreation or cultural activity that will employ the leisure time of the people in a constructive and wholesome man- ner; and [S-] 2. [Advise) Recommend regarding control and super- vision of all parks belonging to the city; and (d-r] 3. [Advise) Recommend regarding planning, promo- tion, management and acquisition, construction, development, maintenance, and operation, including restrictions on, and com- pensation to be paid for, concessions or privileges in parks and/or playgrounds, either within or without the city limits, of parks, squares, parkways and boulevards, play and recreation grounds and/or other municipally owned recreational facilities, Including community buildings, and the improvement, [and] orna- mentation and aesthetic character of the some; (8-r) 4. Make recommendations regarding entering into written contracts with the United States, the state, [end] county, city or town, park district, school district, or any such public organizations for the purpose of conducting a recreational program [ev exereising any ether pewee 4ren+ed by this ehapter] and/or improvements to Park facilities. The board shall submit to the city council each year, [en er befere the , seeend Mender #a Augeet-r) on a timely basis, an estimate of the amount of money required by the depart- ment to carry on its activities for the ensuing year, together with recommendations for the development of the program and faci- lities as it may deem advisable, for the information and guidance of the city council in preparing the budget for the tax levy, for the operation and maintenance of the city parks and the recreational program and necessary facilities and the acquisition of land, structures, or facilities needed therefor. [0-.] D. The board shall have the power to recommend rules and regulations for the government, management, supervision and control of city parks and recreation facilities and programs. SECTION 2. Chapter 2.36 Repealed: Medina Municipal Code Chapter 2.36, Design Commission, is hereby repealed. SECTION 3. Effective Date: This ordinance shall take effect five (5) days after its publication or the publication of a sum- mary of its intent and content.
