HomeMy WebLinkAboutOrdinance No. 0828CITY OF MEDINA ORDINANCE NO.828 AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, AMENDING SECTION 17.40.020 AND 17.40.023 OF THE MEDINA MUNICIPAL CODE TO ALLOW THE AREA OF VEHICULAR PRIVATE LANES, VEHICULAR RIGHTS -OF -WAY AND VEHICULAR ACCESS EASEMENTS TO BE INCLUDED IN THE CALCULATION OF LOT AREA AND LOT COVERAGE. WHEREAS, the current Medina Municipal Code excludes the area of any vehicular, vehicular right-of-way or vehicular access easement from the calculation of lot coverage and lot area; and WHEREAS, including these areas within the calculation of lot coverage and lot area would be consistent with most contemporary planning practices in the state of Washington; and WHEREAS, this matter has been reviewed by the Planning Commission on November 27, 2007 and December 20, 2007; and WHEREAS, pursuant to RCW 36.70A.106, the City has notified the Department of Community Trade and Economic Development of its intent to adopt these amendments at least sixty days prior to final adoption; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Section 17.40.020 of the Medina Municipal Code is hereby amended to read as follows: 17.40.020 Determination of lot area and coverage. In all districts, the maximum allowable lot coverage shall be calculated including the area of any vehicular private lanes, vehicular rights -of -way or vehicular access easements. SECTION 2. Section 17.40.023 of the Medina Municipal Code is hereby amended to read as follows: 17.40.23 Determination of lot area. A. In all districts, the minimum lot area shall be calculated including the area of any vehicular private lanes, vehicular rights - of -way or vehicular access easements, except as provided in subsection B of this section. B. The portion of this title applying to calculation of minimum lot areas shall not apply to lots created by lawful subdivisions prior to April 14, 1986. SECTION 3. Severability. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase of this ordinance. SECTION 4. Effective Date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent and contents.
