HomeMy WebLinkAboutOrdinance No. 0851CITY OF MEDINA ORDINANCE NO. 851 AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, ESTABLISHING PROCEDURES FOR THE DISPOSAL OF SURPLUS PERSONAL PROPERTY OF THE CITY OF MEDINA. THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS: Section 1. 2.60.010 Sale of Unneeded Property Owned by the City. The city manager may authorize department Leads directors to sell property owned by the city and which is in the custody of their departments when they have declared in writing to the city manager that the property is no longer of public use to the city, or that the sale thereof would be in the best interest of the city, provided that the city council must approve any declaration of surplus property with a value in excess of $300.00 1 000. NOW Mr - MI -7 APON &M . .... . TIM= 2.60.030. Sale at Public Auction. All sales of city property, except items sold to another governmental agency, shall be sold at public auction. The city manager may determine whether such auction shall be by sealed bid, or by public or Internet auction, and may establish administrative rules for the conduct of such auctions. 2.60.040. Commercial Auction Services. In addition to auctions conducted by the city, the city manager is authorized to contract with commercial auction services for the disposition of surplus city property on any commercially reasonable terms. 1 of 2 2.60.050. Intergovernmental Sale. The city manager may dispose of city property to another governmental agency, and may acquire property from another governmental agency by means of private negotiations, upon such terms as may be agreed upon, and for such consideration as may be deemed by the city manager to be appropriate. 2.60.060. Resection of Bids, Bid Deposits. The city shall have the right to reject all bids received, whether by sealed bids or at public auction. When sealed bids are called.for, the city shall have the right to require bid deposits. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 2. Severability. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent and contents.
