HomeMy WebLinkAboutOrdinance No. 0881City of Medina, Washington Ordinance No. 881 AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, ADDING A NEW SECTION 20.80.085 OF THE MEDINA MUNICIPAL CODE RELATING TO REQUIREMENTS FOR SUBMISSION OF A BUILDING PERMIT APPLICATION WHEREAS, pursuant to RCW 19.27.095(2), the requirements for a fully complete building permit application shall be defined by local ordinance; and WHEREAS, Section 20.80.080 of the Medina Municipal Code sets forth the minimum submission requirements for project permit applications including building permit applications; and WHEREAS, Chapter 2.52 of the Medina Municipal Code requires documents prepared, reviewed or submitted by a professional to be signed and stamped by an architect, landscape architect, surveyor, engineer, or other professional examined and licensed or subject to licensing by the state; and WHEREAS, larger single-family construction projects within the City are frequently some of the most complex of any found in our region; and WHEREAS, the City wishes to establish a requirement that construction documents on larger single-family construction projects shall be prepared by a licensed architect to ensure integration and collaboration by the various specialized professionals who typically are involved with these complex projects; and WHEREAS, the adoption of an ordinance pertaining to procedures relating solely to governmental procedures, and containing no substantive standards respecting use or modification of the environment, is exempt from the State Environmental Policy Act (SEPA) pursuant to WAC 197-11-800(19). NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Section 20.80.085 of the Medina Municipal Code is hereby adopted to read as follows: 20.80.085 Supplemental submission requirements for building permit applications. In addition to the submittal requirements set forth in MMC 20.80.080, the following shall apply to applications for permits prescribed under Chapter 20.40 MMC (Building Codes): A. Construction documents shall be prepared by a professional as set forth in Chapter 2.52 MMC; and B. Where a person performs the "practice of architecture" as defined in RCW 18.08.320, the construction documents shall be prepared by a person licensed as prescribed in Chapter 18.08 RCW; and 1 of 2 C. The requirement for licensing shall not apply to a person meeting any of the conditions set forth in RCW 18.08.410, except a person performing design work including preparing construction contract documents and administration of the construction contract as defined in RCW 18.08.320 for the erection, enlargement, repair, or alteration of a single- family dwelling containing 4,000 gross square feet of floor area or larger shall be licensed as prescribed in Chapter 18.08 RCW. Section 2. Severability. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent or contents.
