HomeMy WebLinkAboutOrdinance No. 0889City of Medina, Washington Ordinance No. 889 AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON AMENDING SECTION 15.20.010 OF THE MEDINA MUNICIPAL CODE RELATING TO THE REQUIREMENTS FOR A LEVEL,11 CONSTRUCTION MITIGATION PLAN WHEREAS, the Medina Comprehensive Plan contains policies aimed at protecting the quality of the residential environment; and WHEREAS, the City Council approved Ordinance No. 588 on July 11, 1994, last amended by Ordinance No. 855, adopting procedures under which to review construction activity to address those impacts that adversely affect neighboring property owners and public streets; and WHEREAS, the City intended to require mitigation measures for construction activity which has negative impacts on the community; and WHEREAS, certain minor construction activities that do not negatively impact neighboring property owners and public streets have the same procedural review requirements as construction activities which do have negative impacts on the neighboring property owners and public streets; and WHEREAS, the City Council wishes to lessen the review burden for certain minor construction activities that do not have a negative impact on neighboring property owners and public streets; and WHEREAS, pursuant to WAC 197-11-800(19), adoption of a regulations pertaining solely to procedures and containing no substantive standards respecting use or ' modification of. the environment and is categorically exempt from the State Environmental Policy Act. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amendment of Level 1 CMP Criteria. Section 15.20.010 of the Medina Municipal Code is amended to read as follows: A. The requirements of this chapter shall apply to all construction projects requiring a building permit issued by the city. Unless waived by the city manager or city manager's designee, a construction mitigation plan application shall be submitted with all applications for building permit. Projects constructed in multiple phases shall be considered as a single project for determining the type of the construction Mitigation plan, for identifying construction impacts, and for evaluating proposed mitigation measures. B. All construction projects shall comply with the requirements of the Medina construction code of conduct or a tailored construction mitigation plan. C. A tailored construction mitigation plan shall be required if a proposed project meets one or more of the conditions outlined in subsection (C)(1.) or (2) of this section. 1. Level 1. 1 of 2 a. Total floor area of all structures or portions of structures which are the subject of the permitted construction exceeds 25 percent of lot area and 3,000 square feet; b. Total project cost is estimated to exceed $750,000; c. On -site parking for at least three vehicles associated with the construction activity is not available; d. Power, water, or sewer service to any other property within Medina will be interrupted on more than one occasion during construction; e. Construction is proposed within the building setback(s) on a building structure that is located in a setback area, excluding construction that is entirely interior to the building, including replacing of windows and doors not involving any framing or exterior alterations; f. Use of private lane or shared driveway is proposed for parking, staging of construction -related vehicles, loading or off-loading of equipment, or loading or off-loading of materials; g. Project is located within 600 feet of the Medina Elementary School, the Bellevue Christian School, or the Saint Thomas School, excluding projects with total construction costs of less than $50,000 and involving excavation and/or importing of fill of less than 25 total cubic yards. 2. Level 2. a. Total construction costs exceed $1,500,000. This cost figure shall be updated annually by applying the consumer price index for each year after the date of the ordinance codified in this chapter. b. Total quantity of excavated soils exceeds 2,000 cubic yards. c. Construction activities (except as exempt per MMC 18.12.110) occur in landslide hazard area. d. Use of tower crane during construction. Section 2. Severability. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent or contents. Approved as to f Bruce Disend, City Attorney Date Passed 09/10/2012 Date Published 00(((�3(710 12 Date Effective 01 /It /� ( � 1 2of2 Michael Luis, Mayor Attest R chel Baker, City Clerk CITY OF MEDINA RESOLUTION NO.358 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DECLARING MONDAY, DECEMBER 24, 20129 AS A CITY HALL CLOSURE WHEREAS, December 25, 2012, Christmas Day, falls on a Tuesday and it is anticipated that there will be minimal public use of City services on Monday, December 24, 2012; and WHEREAS, Medina's small City .Hall staff size makes it difficult to accommodate all employee leave requests without adversely impacting the ability to keep City Hall open and properly operating; and WHEREAS, Christmas Eve is traditionally devoted to family affairs and holiday preparation; and WHEREAS, this year's calendar provides a unique opportunity to express the City's appreciation for its employees through the award of an additional holiday without inconveniencing residents who otherwise will likely be preoccupied readying themselves for the holidays; now therefore THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: That City of Medina offices will be closed to the public on December 24, 2012, this year only, and all employees shall be credited with a paid day of work.
