Ordinance No. 42 6.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MEDINA,
WASHINGTON, AMENDING SECTIONS 10.40.070 AND 10.76.010 OF THE MEDINA
MUNICIPAL CODE TO INCREASE THE PENALTY FROM THIRTY -FIVE DOLLARS TO
FORTY -FIVE DOLLARS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE
WHEREAS, the penalties for certain violations of Title 10 of the City of Medina
Municipal Code are outdated and need to be revised;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. MMC 10.40.070 Amended. Section 10.40.010 of the Medina Municipal
Code is hereby amended to read as follows:
10.40.070 Citation - Fine - Failure to appear -
Penalty.
A. Any person violating any section of this chapter shall be fined in the
amount of $45790 $45.00.
B. Any person failing to pay the fine or to appear for any court proceedings
scheduled in
response to a citation for a parking violation shall be guilty of a misdemeanor
and shall, on conviction thereof, be punished by a fine in a sum not
exceeding $500.00 or by imprisonment for a term not to exceed 90 days, or
by both such fine and imprisonment.
Section 2. MMC 10.76.010 Amended. Section 10.76.010 of the Medina Municipal
Code is hereby amended to read as follows:
10.76.010 Failure to Respond. Chapter 10.76
10.76.010 Failure to respond - Unlawful.
It is unlawful for a person who has been issued a traffic infraction relating to
parking, standing, stopping or pedestrian infractions, defined by city
ordinance, to fail to respond in the manner directed on the notice of infraction.
Unless otherwise specified by state law or city ordinance, the penalty for such

failure to respond shall be $25.00 $45.00. This penalty is in addition to
penalties imposed for the underlying infraction.
Section 2. Severability. If any section, sentence, clause, or phrase of this ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity of any other section, sentence,
clause, or phrase of this ordinance.
Section 3. Effective Date. This ordinance shall be published in the official
newspaper of the City, and shall take effect and be in full force five (5) days after the date of
publication.
