HomeMy WebLinkAboutOrdinance No. 0891CITY OF MEDINA WASHINGTON ORDINANCE NO. 891 AN ORDINANCE OF THE CITY OF MEDINA, WASHINGTON, AMENDING SECTION 3.48.015 OF THE MEDINA MUNICIPAL CODE TO ALLOW THE SECOND QUARTER PERCENT OF REAL ESTATE EXCISE TAX REVENUES TO BE USED, WITH SOME CONDITIONS, FOR OPERATIONS AND MAINTENANCE OF EXISTING CAPITAL PROJECTS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the Legislature in 2011 amended RCW 82.46.035 to allow real estate excise tax revenues to be used, within certain limits, for the operations and maintenance of existing capital projects; and WHEREAS, the City Council desires to amend MMC Section 3.48.015 to be consistent with recently revised legislation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. MMC Section 3.48.015 "Additional real estate tax imposed" Amended. MMC Section 3.48.015 "Additional Real Estate Tax Imposed" is hereby amended (with legislative revision marks) to read as follows: Section 3.48.015 Additional real estate excise tax imposed. In accordance with RCW 82.46.035, and in addition to the excise tax on the sale of real property imposed by MMC 3.48.010, there is hereby imposed an excise tax on each sale of real property located within the corporate limits of the city at the rate of one - quarter of one percent of the selling price to be collected by the county as described in RCW 82.46.060. Proceeds from this additional tax shall be deposited in a separate account in a municipal capital improvements fund and expended as authorized by law under RCW 82.46.035(5). Section 2. Ratification and Confirmation. Actions taken prior to the effective date of this Ordinance that are consistent with it are hereby ratified and confirmed. Section 3. Severability. If any section, sentence, clause, or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of any other section, sentence, clause, or phrase of this ordinance. 1 Section 4. Effective Date. This ordinance shall take effect five (5) days after its publication or the publication of a summary of its intent or contents.
