CITY OF MEDINA, WASHINGTON
RESOLUTION NO. 412
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MEDINA, WASHINGTON, SETTING A LEGISLATIVE HEARING
ON THE NOVEMBER 9, 2020 COUNCIL AGENDA TO
CONSIDER THE UPLAND ROAD VACATION PETITION IN
ACCORDANCE WITH RCW CHAPTER 35.79.
WHEREAS, a street vacation petition dated August 11, 2020 (Petition), was submitted to
the City by Trenton C. Dykes seeking vacation of 1,029 square feet of Upland Road right-of-way
(ROW) immediately adjacent to his residence and property at 426 Upland Road; and
WHEREAS, Medina has not adopted regulations governing street vacations, thus the
requirements of RCW Chapter 35.79 apply to this matter; and
WHEREAS, the ROW to be vacated comprises a strip of land 7’ x 147’ in size abutting
only the property of Trenton C. Dykes, and the Petition is therefore signed by more than two-
thirds of the owners abutting on the portion of Upland Road for which vacation is sought; and
WHEREAS, in such circumstances the Council shall, by resolution, fix the time and date
for hearing, consideration, and determination of the Petition, which hearing date must be not
less than 20 days nor more than 60 days after passage of the resolution; and
WHEREAS, the City Clerk must give 20 days’ notice of the hearing by posting in 3 public
locations in the City and on the ROW for which vacation is sought; and
WHEREAS, the Council’s November 9, 2020 meeting satisfies the statutory 20-60 day
time limit for the hearing and required notice;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF MEDINA, WASHINGTON,
RESOLVES AS FOLLOWS:
Section 1. Hearing Date Scheduled. The hearing date and time for the Petition
described above is hereby set for November 9, 2020, commencing at 4:00 p.m. or as soon
thereafter as called by the Council from its meeting agenda. The hearing date and time may be
continued as determined necessary or appropriate by the Council to complete the statutory
review specified under RCW Chapter 35.79 and enable the Council to make a fully informed
legislative decision on the Petition.
Section 2. Posting of Notice. The City Clerk is directed to timely post notice of the
hearing as required by RCW Chapter 35.79. The Clerk may in addition publish or make
available other notices of the hearing as may be useful or customary, such as publication on the
City website.
