THE CITY COUNCIL OF THE CITY OF MEDINA DO ORDAIN AS FOLLOWS: The City Council of Medina does hereby authorize the Mayor of Medina to enter into an agreement with the Town of Clyde Hill pursuant to the Interlocal Cooperation Act for the improvement, maintenance and operation of 84th Avenue Northeast, in a form substantially similar to the Agreement which is attached to this resolution. Wines, City -Attorney Attest: a M rga' et Davis, City Clerk � r t _IT;g i ,ys or r,, Ys [ J iT r eny C�,,,, SEAL AGREEMENT FOR STREET IMPROVEMENT A14D LSAINTENANCE In consideration of the mutual covenants and promises set forth in this contract, and in the exercise of the authority granted by the Interlocal Cooperation Act, R.C.W. 39.34, the City of Medina, a municipal corporation, and the Town of Clyde Hill, a municipal corporation, do agree as follows: 1. Both parties shall pay equally the cost of restriping, signage, preparation of bus turnouts and other improvements on 84th Avenue NE and IJE 12 St. in general conformance with the preliminary plans which are attached hereto, provided that the total cost being shared by the parties shall not exceed $12,000. The parties shall share equally in any funds contributed by Pietro or any other entities. 2. Both parties must approve the final plans and specifications prior to construction. There will be no changes in the _Final plans and specifications without the approval of both parties. 3. following completion of construction, each party shall be responsible for maintaining 84th Avenue NE and NE 12th St. on its side of the newly established line separating opposing traffic flows. 4. The parties shall share equally all future consulting and engineering costs incurred for the improvements described in paragraph 1 above, not including costs for engineering done,by city employees, provided that such costs shall be included in the maximum costs set forth in paragraph 1 above. 5. Except as may be incorporated in the final plans and specifications, neither party shall cause any changes to be made in the existing traffic control signals and stop signs on 84th Avenue NE and NE 12th St. without prior approval of the other party and of the Town of Hunts Point, providing Hunts Point chooses to participate financially as deemed appropriate by ;Medina and Clyde Hill. o. The parties establish the goal of completion and approval of the final plans and specifications by March 31, 1989. The parties establish the goal of commencing construction as soon as weather wi permit and completing construction by 14 L , 1939. 7. The parties agree to stripe Northeast 12th as necessary to restrict vehicular traffic to one lane in each direction, provided that the cost thereof shall be included in the maximum cost set forth in paragraph 1 above. 3. Upon the request of either party, both parties will appoint council members to a committee to discuss and attempt to resolve any questions concerning the maintenance and operation of 84th Avenue 11E and NE 12th St. 9. In the event of any dispute arising out of this agreement, or if the parties are unable to agree on the future operation and maintenance of 84th Avenue Northeast and 14E 12th St., the parties agree to submit the dispute to arbitration under the rules and suggested procedures of the American Arbitration Association and to abide by the decision of any such arbitration. 10. This agreement shall remain in force for a period of twenty (20) years from the date of its execution. 11. Neither party shall be required to maintain a separate budget for the purposes set forth in this agreement. 12. This agreement shall be jointly administered by the mayors of each jurisdiction.
