HomeMy WebLinkAboutResolution No. 215RESOLUTION NO. 715 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MEDINA REGARDING VIOLATION OF THE UNIFORM CONTROLLED SUBSTANCES ACT IN OR ON CERTAIN PUBLIC PLACES OR FACILITIES; ADOPTING A MAP DEPICTING DRUG FREE ZONES FOR THE PURPOSE OF ENHANCED PENALTIES FOR USE AS EVIDENCE IN PROSECUTING CERTAIN OFFENSES UNDER THE UNIFORM CONTROLLED SUBSTANCE ACT; AND STATING THE CITY'S COMMITMENT TO DRUG FREE ZONES. WHEREAS, in 1989, the State Leaislature adopted RCW 69.50.435 regarding the manufacturing, selling, delivering, or possession with intent to manufacture, sell, or deliver a controlled substance to a person in a school or on a school bus or within 1,000 feet of a school bus route designated by the school district or within 1,000 feet of the perimeter of the school grounds or in a public park or in a public transit vehicle or in a public transit stop shelter; and WHEREAS, RCW 69.50.435 provides that such persons may be punished by a fine of up to twice the fine otherwise authorized by law or may be imprisoned for a period of up to twice the period of imprisonment otherwise authorized by law; and WHEREAS, RCW 69.50.435(e) provides that a map produced by any municipal engineer for the purpose of depicting the locations and boundaries of such areas shall under proper authentication be admissible and shall constitute prima facie evidence of the locations and boundaries of such areas if the map has been approved by resolution of governing body of the municipality; and WHEREAS, the City Council desires to approve such a map for the purposes described in RCW 69.50.435; and WHEREAS, the City Council further wishes to state its commitment to the maintenance of such areas as focus areas for law enforcement efforts aimed at eliminating drug trafficking, such areas to be known as "drug -free zones". NOW, THEREFORE, the City Council of the City of Medina, Washington, does resolve as follows: Section 1. In accordance with RCW 69.50.435, that certain map produced by the Medina City Engineer for the purpose of depicting the location and boundaries of the areas on or within 1,000 feet of any property used for a school, school bus route stop, public park, or public transit vehicle shelter, or a true copy of such map, is hereby approved as the official location and record of the location and boundaries of those areas. The map as hereby approved or copy thereof shall be filed with the City Clerk and maintained as an official record of the City. Section 2. The City Council hereby declares its commitment to eliminating drug traffic in the areas designated on the map described in Section 1 above, and designates those areas as "drug -free zones" which shall be a focus of law enforcement efforts aimed at eliminating traffic in controlled substances.
