HomeMy WebLinkAboutResolution No. 277RESOLUTION NO. 277 A resolution of the City Council of the City of Medina authorizing the settlement of litigation. WHEREAS, Peace Action of Washington and United States Mission of Seattle initiated litigation against the City of Medina on November 3, 2000, in order to resolve disputes concerning adoption of an ordinance by the City of Medina restricting the ability of citizens to exercise First Amendment rights within the Medina city limits, and . WHEREAS, the United States District Court, Western District of Washington -has ordered that Plaintiffs motion for a preliminary injunction be granted, and WHEREAS, the parties to the action have negotiated a settlement which will require the City of Medina to repeal those portions of the ordinance which the court enjoined the City from enforcing, and WHEREAS, Under the Civil Rights Act, a successful plaintiff is entitled to an award of attorney's fees the City of Medina agrees to pay attorney's fees in an amount of $22,500, and WHEREAS, the parties to the action have negotiated a settlement which will require plaintiffs attorney to contribute $22,500 to Peace Action of Washington and United States Mission of Seattle, and WHEREAS, the City Council finds that entering into the settlement agreement submitted to the Council this date is in the best interest of the City of Medina. NOW, THEREFORE, the City Council of the City of Medina, Washington, does resolve as follows: RESOLVED that the City Manager is hereby authorized to enter into and execute the settlement agreement presented to the City Council on April 24, 2001.
