At 6:00 PM and under authority of RCW 42.30.140 4 (b), and RCW 422.30.110(I) an Executive Session was held, for discussion of personnel issues and pending litigation. The Executive Session adjourned at 6:55 PM. CALL TO ORDER The regular meeting of the Medina City Council was called to order at 7:03 PM by Mayor Becker. The meeting was recorded on audio tape. ROLL CALL Present: Councilmembers Suzanne Cohen, Paul Demitriades, Thomas Morgan, Steve Preston and Mayor Daniel Becker. Absent: Councilmember Susan Potts Staff Present: City Manager Doug Schulze, City Attorney Kirk Wines, Police Chief Michael Knapp, Public Works Superintendent Carl Burris, City Engineer Jay Hummel and City Clerk Kristen Finnigan. ANNOUNCEMENTS Mayor Becker welcomed James Lawrence as a new Councilmember, filling the vacancy created with the resignation of Councilmember Ross, due to his move from the Medina area. The Oath of Office was administered by City Clerk Finnigan. Mayor Becker announced that the Trans -Lake Study had been completed during the past month. He explained that the recommendations of that committee were to go before the Transportation Commission on August 18, 1999. The Mayor stated that the recommendations were primarily extensive mitigation on anything that goes through the communities, both on the Seattle side and the Points Communities' side. He explained that several issues were yet to be sorted out. Mayor Becker stated that following the Trans -Lake Study this year would be the EIS Scoping Process which will happen over the next year, with $800,000 having been funded for this purpose. He added that these monies were in question with Initiative 695. Medina City Council Minutes August 9, 1999 Page 2 Mayor Becker reported that it would be three to five years down the road before anything would happen along the SR520 Corridor. Councilmember Demitriades announced that he would be speaking to the State's Blue Ribbon Commission on Transportation on Tuesday, August 17th, regarding potential revenue enhancements and change to the State transportation process. City Manager Schulze announced that the City had to take action to close the season for the swimming beach on August 9th, due to a shortage of lifeguards throughout the region. CONSENT AGENDA Councilmember Morgan moved to approve the consent agenda. Seconded by Councilmember Demitriades, approval was unanimous. A. Minutes from Regular Meeting of July 12, 1999 B. Approval of July, 1999 Warrants Regular Warrants - # 12613- 12716 & Corrected 912386, 912460, 912583, 912666 Personnel Warrants - # 16733 - 16788 STAFF REPORTS PUBLIC SAFETY REPORT $246,155.27 $ 92, 825.25 Police Chief Knapp explained that the Police Department had worked with postal authorities and they were fairly confident that the person responsible for recurring crimes of identity theft in the Points Communities and throughout the area had been apprehended. Chief Knapp reported that there had been two burglaries in July, during daytime hours. He reported that in each instance, the owners were in the back of the home at the time, with the front of the home unguarded. Discussion followed related to concerns of neighbors who have noticed the tossing of beer bottles and cans along the path near the BP/Circle K. Mayor Becker stated that there had been a concern when hearings were held for their liquor license. He suggested that Police Chief Knapp talk to the Circle K and ask them to maintain the area. Medina City Council Minutes August 9, 1999 Page 3 PARK BOARD Park Board Chair John Bell reported that the Park Board had been working with Anderson & Ray regarding Fairweather Park. He explained that they had come up with three plans which were presented at the last Park Board Meeting. Bell stated that these plans had been designated as: a)The Invisible Plan; b) The Elegant Plan, and c) The Grand Plan. He stated that, at the present time, the Park Board was looking at a combination of the Invisible and Elegant Plans. He stated that the Park Board would have a recommendation for the Council in September or October. Discussion followed relative to Fairweather Park. The consensus was that Friends of the Park, (those volunteering their time to work in the parks doing miscellaneous work) was an excellent idea. PUBLIC WORKS Public Works Superintendent Burris stated that Anderson & Ray had expressed to him that the Medina Stream Project's concept design would be delayed until their biological engineer was well -versed on the project. City Engineer Hummel explained that NE 24th Street was a Sidewalk Improvement Project, from Evergreen Pt. Rd., to 84th. He then gave a brief overview of the proposed project. Councilmember Morgan stated that it had been suggested by one member of the Public Works Committee and recommended by the other members of the Committee that they request that City Engineer Hummel provide the Council with the costs for the minimal amount of work that would address the repairs needed, the drainage needed and the curb and gutter adjustments needed, plus the addition of the sidewalk on the south side of NE 24th St. Hummel was asked to provide this information to the Council by the time of their upcoming Workshop, scheduled for August 16, 1999. OVERLAKE DRIVE PEDESTRIAN PATH PHASE II City Engineer Hummel stated that his recommendation for the surface of the portion of the pathway between 81 st and 84th was that it be cement concrete. He said that this was due to the fact that it would be adjacent to the road and not separated by a landscape strip. He stated that the probable construction costs for the pathway and storm drain work would be approximately $390,000. Medina City Council Minutes August 9, 1999 Page 4 AUDIENCE PARTICIPATION Henry Paulman, 1415 80th Ave. NE, stated that he had participated in the Trans -Lake Study. He complimented Mayor Becker's work on this study and recommended that he serve another term as Mayor. Mr. Paulman reported on the Senate Transportation Meeting which was held on August 9, 1999. POINT OF ORDER With several members of the audience in attendance on the issue of Ordinance No. 665, Mayor Becker moved the meeting into the Ordinances and Resolutions Section and invited City Manager Schulze to introduce the ordinance. Ordinance No. 665 - AN ORDINANCE ADDING A NEW SECTION TO THE MEDINA MUNICIPAL CODE CHAPTER 15.20, MITIGATION PLANS FOR MAJOR CONSTRUCTION ACTIVITIES TO ADD A REQUIREMENT FOR MITIGATION PLANS FOR PROJECTS USING TOWER CRANES. City Manager Schulze explained the proposed ordinance and stated that concerns had been expressed regarding the possibility of retroactive enforcement and the prohibition of cranes' swinging over neighboring properties. Councilmember Lawrence related that during his recent term on the Planning Commission, the Commission had addressed this issue. He said that the Commission had had a great deal of feedback from citizens regarding cranes. Discussion followed. The consensus was to strike Section 3 - Retroactive Application. Councilmember Morgan moved to adopt Ordinance No. 665. Councilmember Demitriades seconded the motion. Gerald Grinstein, 3630 & 647 Evergreen Point Road, was present and expressed his concern regarding the retroactive aspect of the proposed ordinance. Geof Whitten, 22720 NE 46th St., Redmond, explained that he had been an owner's representative in Medina for the past seven years. He addressed the issue of the cranes swinging over adjacent properties, related to in Section 2. Following discussion, Councilmember Preston moved to amend Section 2 to add "without written approval of the neighbors". Seconded by Councilmember Cohen, all were in favor except Councilmember Morgan. Moved by Councilmember Preston and seconded by Councilmember Cohen, proposed Ordinance No. 665 was tabled until the September Meeting, to allow the City Attorney to better define tower cranes and incorporate changes proposed. Mayor Becker noted for the record that he was opposed to the ordinance in any form or fashion. Medina City Council Minutes August 9, 1999 Page 5 PUBLIC HEARING Ordinance No. 670 - AN ORDINANCE PROHIBITING GATES ON PRIVATE LANES City Manager Schulze explained that the issue of prohibiting gates on private lanes came as a result of a determination of the Building Official that it was not permitted by Municipal Code. He said that the Building Official's determination had been overturned and that safety concerns had been expressed by the Fire Marshall. Discussion took place regarding the turnaround issue and safety. The ordinance was tabled and referred to the Public Safety Committee for additional review and work. ORDINANCES AND RESOLUTIONS(CONT'D) Ordinance No. 664 - An Ordinance OF THE CITY OF MEDINA, WASHINGTON, CREATING A MEDINA MUNICIPAL COURT TO COMMENCE OPERATION ON JANUARY 1, 2000, DESCRIBING THE STATUTORILY AUTHORIZED JURISDICTION, DUTIES AND POWERS OF THE COURT; REQUIRING THE APPOINTMENT OF A MUNICIPAL JUDGE, DESCRIBING MANNER OF APPOINTMENT JUDICIAL QUALIFICATIONS, TERM AND SALARY; AMENDING THE MEDINA MUNICIPAL CODE BY ADDING A NEW CHAPTER 4.01; AUTHORIZING AN INTERLOCAL AGREEMENT WITH THE CITY OF KIRKLAND FOR OPERATING SAID COURT; REPEALING MEDINA MUNICIPAL CODE CHAPTER 2.08; AND ESTABLISHING AN EFFECTIVE DATE. City Manager Schulze explained that the Kirkland City Council had taken action to approve the Interlocal Agreement with the Points Communities and that Ordinance No. 664 would create the Medina Municipal Court. Moved by Councilmember Morgan and seconded by Councilmember Demitriades, Ordinance No. 664 was adopted. Councilmember Cohen moved to authorize the City Manager to enter into an Interlocal Agreement with the Cities of Clyde Hill, Hunts Point, Kirkland and Yarrow Point, for the providing of all facilities and personnel for the Municipal Courts of Clyde Hill, Yarrow Point, Medina and Hunts Point. The second came from Councilmember Demitriades. Approval from the Council was unanimous. Ordinance No. 667 - AN ORDINANCE REPEALING MEDINA MUNICIPAL CODE SECTION 206.010 AND 2.24.020, IMPOSING TERM LIMITS ON CITY COUNCIL MEMBERS AND MEMBERS OF THE BOARDS AND COMMISSIONS. Following discussion, the consensus was that there was no interest in putting this ordinance for a motion or a second. Medina City Council Minutes August 9, 1999 Page 6 DISCUSSION EXTERIOR LIGHTING Councilmember Lawrence explained that the discussion of exterior lighting had been discussed by the Planning Commission after receiving a letter from Barbara Hodgson, a Medina resident. City Manager Schulze stated his recommendation that the new City Planner review this ordinance with the intent that she will obtain some model ordinances. He said that ordinances that he has seen are of more of an objective measure of the overflow of lighting. Councilmember Cohen suggested that exterior lighting be put in the zoning code. The consensus was to discuss further at a workshop. CONSIDER JOINING FILING WITH FCC OPPOSING PROPOSED RULE AND SUPPORTING MUNICIPAL INTERESTS City Manager Schulze explained that the reason for this joint filing was that the wireless industry had been attempting to gain further access. He stated that there would be a contribution of $300 to help with filing fees. The Council concurred with the City Manager to proceed with joining the filing with the FCC. POINTS COMMUNITIES TRAFFIC SURVEY Mayor Becker announced that there had been meetings of the four Points Communities Traffic Committee. He stated that there would be a Community Meeting on September 22, 1999, to discuss the limiting of access to SR520 from 84th. City Manager Schulze stated that the survey included in the Councilmembers' packets would be circulated to Points Community residents in September newsletters. There was discussion regarding the light cycling at 24th & 84th. City Manager Schulze explained that there was an improvement yet to be made in the computer. Councilmember Preston stated that he wanted to be assured that Medina residents would be given consideration in the timing of the signal. BOARD APPOINTMENTS Mayor Becker moved to appoint Mark Nelson to one of the openings on the Planning Commission. Seconded by Councilmember Demitriades, all were in favor. The consensus was that the Mayor and Councilmember Lawrence would set up interviews with the other applicants for Planning Commission vacancies. Medina City Council Minutes August 9, 1999 Page 7 NEW BUSINESS Councilmember Cohen explained that, since the time of the July Council Meeting, when Ordinance No. 657 was adopted as a change to the Comprehensive Plan, she had had second thoughts on the wording of the section regarding satellite receiving systems. It was decided that she would discuss this language with Councilmember Preston and further discussion would take place at the upcoming City Council Session.
