CALL TO ORDER The Special City Council Meeting was called to order by Mayor Pro Tern Thomas Morgan at 10:00 a.m. ROLL CALL Present: Councilmembers Suzanne Cohen, Paul Demitriades, Thomas Morgan, and Steve Preston Staff: City Manager Douglas Schulze, Public Works Superintendent Carl Burris, Consultants: City Engineer Jay Hummel and Kevin Goss, Roth Hill Engineering AWARDING OF CONTRACT MEDINA PARK POND, STREAM AND PATH IMPROVEMENTS, CONTRACT 3-99 The Council expressed concern that the Engineers' (Roth Hill) "should cost" estimate for the Medina Park Pond, Stream and Path Improvements, Contract 3- 99, was substantially lower than the low bid. The Council asked, because of the critical project completion date, whether any sub -contractors were involved. City Engineer Hummel said that AGI Technologies, the selected bidder, would not use sub -contractors. He indicated that AGI would meet the schedule and was prepared to start work October 11th and complete major items by October 30th. The Council expressed concern about the increase in contract scope -of -work caused by government agency (Fisheries) requirements, related to the HPA Medina City Council Special Meeting Minutes October 1, 1999 Page 2 permit. Council expressed concern about any fines by Fisheries, if the contractor did not meet the schedule (staff was requested to seek some "schedule slack" from Fisheries). Discussion focused upon the scope of the project and costs involved. City Engineer Hummel explained the tight time schedule mandated by the Department of Fisheries for completion of work by the end of October. The consensus was to communicate concerns to Larry Fisher, Fisheries Department, relative to timetable. Moved by Councilmember Demitriades, seconded by Councilmember Cohen, and approved unanimously, Medina Park Pond, Stream and Path Improvements, Contract 3-99, was awarded to AGI Technologies of Bellevue, WA, in the amount of $224,524.50, plus sales tax of $19,309, for a total of $243,833.50. It was decided that a meeting would be scheduled with Larry Fisher, for discussion of conceptual Medina Stream Project; specifically box culvert bridge over Medina Stream on NE 24th Street. It was also decided that fish barrier removal grants be explored. Councilmember Demitriades reported on the Lake Washington /Cedar River Watershed Forum Meeting of September 30, 1999. He stated that substantial effort will be required by city staff, consultants, Planning Commission, legal counsel and the City Council to prepare for 2000 evaluation of National Marine Fisheries Service/King County negotiations of Endangered Species Act (ESA) impact ("4D" rule) on Comprehensive Plan, Shoreline Management, SEPA and other ordinances. Councilmember Demitriades stated that, in his opinion, ESA requirements may be on the scale of Growth Management Act requirements.
