CALL TO ORDER The Study Session of the Medina City Council was called to order at 4:07 p.m. by Mayor Becker. ROLL CALL Present: Councilmembers Suzanne Cohen, Paul Demitriades, Jim Lawrence, Thomas Morgan (through phone conferencing), Steve Preston, and Mayor Daniel Becker. Staff Present: City Manager Doug Schulze, City Engineer Greg Hill, City Landscape Consultant Keith Bates, City Attorney Kirk Wines, City Planner Christine Schwamberger, Public Works Superintendent Carl Burris, and City Clerk Kristen Finnigan. DISCUSSION Mayor Becker announced the addition of two items to the agenda; the filling of the open City Council position No. 5, and an executive session for the last half hour of the meeting, for discussion of potential litigation. The topic of tree preservation was moved to the end of the agenda. PARK BOARD ISSUES Park Board Members John Bell, Claudia Stelle, Connie Gerlitz, Danya Hill and Joseph Brazen were in attendance. Chairperson Bell reviewed a memo written by the Park Board to the City Council, regarding the budget for Medina Parks. He discussed five items that the Park Board had requested, for inclusion in the 2000 budget: Anderson & Ray's final plan, with the condition that the Council commit to an annual budget for the continued maintenance of Fairweather Park and Preserve. City Council Study Session November 22, 1999 Page 2 2. $10,000 in an emergency/maintenance fund. 3. Replacement of floating dock. 4. Lake Lane dock to be maintained by a private landscaping business. 5. Money set aside for clean up before and after special events in Medina parks. City Manager Schulze reviewed the requests, clarifying and separating policy from administrative issues. He explained that the Boards and Commissions set up what is to be done and the administration sets up how it is to be done. He explained that it is always possible to go to the Council for a budget amendment for emergencies and that the Reserve Fund has a substantial amount in it. The City Manager explained that the City will pay particular attention to ensure that lifeguards make a commitment to stay through Labor Day in future years, providing an incentive if necessary, for them to do so. He agreed that it was a good idea to replace the floating dock. There was discussion relative to the maintenance of Lake Lane Dock and it was decided that the Public Works Committee would discuss privatizing this effort for the dock. City Manager Schulze explained that the Medina Days clean up was not so much a matter of funding but of coordination. The City Manager indicated that he will be involved with the Medina Days Committee in the future and will also attend Park Board Meetings on at least a quarterly basis. Discussion followed regarding the necessity of increasing the amount of money budgeted for community activities. The consensus to include a line item in the budget, increasing the amount budgeted from $5,000 to $10,000, for special events. NE 7th Street Storm Sewer Bid Councilmember Demitriades reported that the Public Works Committee had agreed to propose to the City Council that they proceed with action to award the NE 7th Street Storm Sewer Bid. City Engineer Greg Hill gave a brief description of the project, which involves upgrading to provide capacity for a home being reconstructed on NE 7th Street. He explained that it was not a weather -sensitive project. Councilmember Demitriades moved that the City proceed with the NE 7th Street Storm Sewer Bid award to Kemper Construction, in the amount of $27,741.25. Seconded by Preston, all were in favor and the bid was awarded. City Council Study Session November 22, 1999 Page 3 Medina Stream Scope of Work Councilmember Demitriades related that the Public Works Committee's recommendation was to approve the scope of work proposed by Springwood Associates, through the oportunities and constraints task. He said that the Committee had discussed the need to take action now, to move forward with the fisheries analysis, because of the current Chinook spawning window of November through January. There was discussion as to where Hunts Point stood in the process. City Manager Schulze explained that his understanding was that they understood what was being planned but that they had not yet made a budgetary commitment. City Engineer Hill said that regardless of whether or not the stream can be restored, there were hydraulic issues and work that may need to be done there in the future. Councilmember Cohen moved that the study proceed, with the cost not to exceed $125,000. Seconded by Councilmember Demitriades, all were in favor. APPOINTMENT OF COUNCILMEMBER — POSITION NO. 5 Mayor Becker announced that if there were no objections, he would like to appoint Mary Odermat to vacant Council Position No. 5. Councilmember Cohen moved to appoint Mary Odermat to Council Position No. 5. Seconded by Councilmember Lawrence, the motion passed. TREE PRESERVATION At 5:10 p.m., Councilmember Morgan joined the Study Session via conference call, at the beginning of the discussion on Tree Preservation. City Landscape Consultant Bates expressed his thoughts that he believes that there is a need for study of the issue. Concern was expressed as to the fact that the issue is addressed primarily during development and that replacement requirements were not adequate. The effect that tree cutting may be having upon the community was considered, including the threat to the rural feel and character of the city. Environmental considerations were addressed. Questions were raised as to if the City has ordinances/regulations regarding tree preservation and are these enforced. City Planner Schwamberger said that there are many model ordinances from other communities, which are available for study. The need to focus on safety was stressed, particularly on hillsides, with the possibility of severe penalties for violations.
