MINUTES
CALL TO ORDER

The Study Session of the Medina City Council was called to order at 4:07 p.m. by Mayor
Becker.
ROLL CALL
Present: Councilmembers Suzanne Cohen, Paul Demitriades, Thomas
Morgan, Mary Odermat, Steve Preston, and Mayor Daniel Becker.
Staff Present: City Manager Doug Schulze, City Attorney Kirk Wines, Police
Chief Michael Knapp, Building Official Lowell Erickson, City
Planner Christine Schwamberger, and Deputy City Clerk Craig
Fischer.
ANNOUNCEMENTS
Councilmember Morgan reported on the results of the Public Safety Committee meeting
which was held earlier in the afternoon. Morgan outlined the topics that were discussed
at the meeting and they were as follows:
1. Councilmember Morgan was appointed Chairman of the Committee for the year
2000.
2. Police Chief Knapp reported on the progress of the False Alarm Ordinance draft.
3. Solicitation Ordinance
4. Variance Extension Ordinance*
5. Building Permit Extension*
6. Satellite Dish Discussion*
7. SR-520 Emissions Report Findings
* - Chairman Morgan stated that the Committee was prepared to provide a
recommendation to the Council.

DISCUSSION
ORDINANCE NO. 676 — VARIANCE EXTENSIONS
After some discussion, the Council agreed upon some revisions to MMC section
2.32.080. Proposed changes read as follows:
2.32.080 Decisions effective when. Any decision of the board shall not become
effective until the expiration of ten days from entry of such decision in the official records
of the board and the mailing or other delivery of copies thereof to the Mayor and
Chairman of the Planning Commission, unless the board finds that the making of the
decision effective immediately is necessary for the preservation of property or personal
rights and so shall certify on the record of the application. If a special use or variance is
granted and the applicant does not avail himself of the rights conferred thereby within
one yeas eighteen (18) months from the date of the board's decision, then such decision
shall cease to be effective and a new application for a building permit and/or certificate
of occupancy or special use or variance or review of a decision of the Building Official or
City Planner is required. The decision of the board shall be final, subject to review by the
Superior Court. Any time during which the decision is subjected to judicial review shall
not be counted in calculating the expiration date for the decision.
The Council decided to hold a public hearing at their next regular meeting on January
10, 2000 to consider adoption of this proposed ordinance.
ORDINANCE NO. 675 — SOLICITATION
City Attorney Wines reported that the ACLU had agreed to solicitation hours of 9:00 a.m.
to 9:00 p.m. Councilmember Cohen stated that she felt 9:00 p.m. was far too late to be
having unknown persons entering onto private property. City Attorney Wines will check
with Steve Dijulio on the progress of his opinion and report back to Council at the
January meeting. After further discussion, the Council agreed a vote on this ordinance
could be taken at that time.
BUILDING PERMIT ISSUES
Councilmember Demitriades explained the recommendations for an extension to a
building permit, stating that an original permit would be good for twelve months with an
automatic extension of six months. After that, the first extension would be for twelve
months at the cost of the original permit. A second and final extension would cost two
times the original permit fee amount. Building Official Erickson reminded the Council that
these proposed extensions could only be allowed assuming that there are no revisions
to the originally approved permit plans pursuant to the Uniform Building Code (UBC). He
also suggested that certain conditions and/or very hard criteria should be attached at the
second extension to ensure timely project completion. Councilmember Morgan
suggested the number of trades or subcontractors working on site could be closely
monitored. He also asked Erickson if the provisions of the UBC for building permit
extensions should be referenced. Erickson suggested that they should indeed.

After further discussion, Mayor Becker asked Erickson to locate some possible criteria
and report back to the Council at their January study session.
RECONSTRUCTION
City Planner Schwamberger recommended some options to the Council for defining the
"True Value" of a structure. She also discussed some of the pros and cons of her
recommendations.
Discussion took place amongst the Council. Morgan stated that they should not allow
reconstruction without achieving conformity. Planner Schwamberger stated that she
does not agree with what the MMC allows for reconstruction and the Councilmembers
agreed.
Councilmember Morgan stated that perhaps the Building Official and City Planner could
research sample costs of new construction for wood framed homes as well as brick and
stone. The results of their findings will be discussed at the January committee meeting.
EMERGENCY PREPAREDNESS
City Manager Schulze reported that he and Police Chief Knapp have interviewed six
different firms who develop emergency preparedness plans and were suggested by
Barbara Graff at the City of Bellevue. Each firm has been asked to submit a proposal
after which, two will be selected for consideration. Schulze assured the Council that
Medina's certain uniqueness was communicated in detail to each firm so that it can be
adequately addressed in their proposals.
Councilmember Morgan suggested that some preliminary figures are attained from the
consultants and brought back to the committee in January or as soon as they are
available.
SR-520 EMISSIONS STUDY
Councilmember Morgan reported on a proposal to study air pollution from bridge traffic.
Aerotech Environmental Inc. has submitted a proposal to sample four gases during the
course of one year from two different monitoring stations. Each monitoring station would
cost $30,000. Morgan recommended that the City pursue a six month study beginning
March 15, 2000 and that City Manager Schulze continue talks with the consultant in
hopes of negotiating a shorter study period than one year. Councilmember Demitriades
stated that timing of the study results is important with SR-520 scoping statements due
in 2000, Medina should have baseline information to take to the Washington State Dept.
of Transportation. The Council agreed that the City Manager should inquire about a six
month study to take place from March 15, 2000 to September 15, 2000.
