STUDY SESSION
MINUTES
May 22, 2000 Medina City Hall

CALL TO ORDER
Mayor Becker called the Study Session of the Medina City Council to order at
4:04 p.m.
Present: Councilmembers Suzanne Cohen, Paul Demitriades, Jim
Lawrence, Thomas Morgan, Steve Preston and Mayor Daniel
Becker.
Absent: Councilmember Mary Odermat
Staff Present: City Manager Doug Schulze, City Attorney Kirk Wines, City
Planner Jenny Schultz, Building Official Lowell Erickson, City
Engineering Consultants Greg Hill, Bill Holladay and Kevin
Goss, and City Clerk Kristen Finnigan.
ANNOUNCEMENTS
Mayor Becker announced that elected representatives of eastside cities had
been asked to volunteer for the jail services study group. He said that full
information had been included in the activity report for the week of May 13, 2000.
Councilmember Demitriades reported that Mayor George Martin, Dr. Bob
Rudolph, City Attorney Kirk Wines and he had testified at the recent Port of
Seattle Meeting regarding jet noise. He said that the Commissioners had
listened intently, but that it was not apparent how they were leaning.
Councilmember Demitriades also mentioned a report produced by the National
Academy of Sciences, in which they critiqued the EPA Air Quality Model as not
being reflective of real conditions. He said that this was important information, in

that the Puget Sound Air Quality Agency uses this model for compliance with the
Air Quality Act.
City Manager Schulze commented that the first preliminary report relative to air
quality had originally been expected on May 15th, but that there would be a two -
week delay, due to a problem with the monitors.
City Manager Schulze announced that there were items for discussion in
Executive Session.
EXECUTIVE SESSION
At 4:10 p.m., and under authority of RCW 42.30.110, Mayor Becker announced
that the Council would hold an Executive Session to discuss potential acquisition
of real estate and matters of potential litigation, prior to the Study Session. At
4:55 p.m. the Council returned to the Study Session.
ORDINANCES/RESOLUTIONS
Ordinance No. 670 — AN ORDINANCE REGULATING PLACEMENT HAVE
GATES
Section 12.40.020, regarding lighting wattage was discussed and it was
determined that the focus of the ordinance was to enable emergency access.
Section 12.40.010 was changed from "access to one or more residences" to
"access to a residence". It was also determined that Section 12.40.020 would
be reworded so that it would be clear that a residence on a private lane may
have a gate, provided that it is located outside of the private lane easement.
Following discussion, the consensus was to move the ordinance forward to the
June 12 City Council Meeting, with changes to be incorporated.
Ordinance No. 677 — AN ORDINANCE AMENDING ORDINANCE NO 407,
REGULATING SATELLITE RECEIVING SYSTEMS LARGER THAN 39
INCHES IN ANY DIMENSION
Ordinance No. 678 — AN ORDINANCE REGULATING TELEVISION
SATELLITE RECEIVING SYSTEMS LESS THAN 39 INCHES IN ANY
DIMENSION

Ordinances No. 677 and 678 were discussed. City Attorney Wines explained
that it was possible to impose more restrictions upon those systems over 39".
He said that the proposed Ordinance No. 678 seemed to do all that is possible
under the FCC Rule.
Following discussion and consideration, both ordinances were sent back to
Committee for correction of height discrepancies and prohibition of transmitting
for larger than 39" antennae.
Ordinance No. 679 — AN ORDINANCE AMENDING MEDINA MUNICIPAL
CODE 15.04.040 TO EXTEND THE EFFECTIVE TIME FOR BUILDING
PERMITS FROM ONE YEAR TO EIGHTEEN MONTHS
City Manager Schulze explained that Ordinance No 679 would extend the
effective time for building permits from one year to eighteen months. In
explaining the background of the ordinance, he said that it had evolved as a
result of complaints received from building permit holders whose permits had
expired prior to completion of their project. These permit holders had failed to
request extensions prior to the expiration of their original permit.
Discussion of the draft ordinance followed. The possibility of assigning all cases
other than land use and long-range planning to the Board of Adjustment was
considered.
The consensus was to move Ordinance No. 679 forward to the June 12th City
Council Meeting, removing language that required the property owner to appear
before the Planning Commission during a public hearing prior to obtaining a new
permit for projects that have exceeded the twenty-four months. It was also
decided that current permit holders would be notified of the option to extend,
through a newsletter article and postings. It was also discussed and it was
unanimously agreed that there would be no retroactive refunds.
Ordinance No. 687 — AN ORDINANCE RELATING TO STRUCTURES AND
OBJECTS IN UNIMPROVED PORTIONS OF PUBLIC RIGHTS -OF -WAY
PROVIDING FOR A PENALTY FOR VIOLATION AND REMOVAL AT THE
ADJOINING PROPERTY OWNER'S EXPENSE
City Manager Schulze explained that in a recent risk assessment, Washington
Cities Insurance Authority (WCIA) recommended action by the City of Medina to
improve regulation of structures and objects in public rights -of -way.

The consensus was that no Councilmembers were interested in going forward
with the ordinance at the present time and it was sent back to the Public Safety
Committee for further study.
NEW BUSINESS
GOOSE CONTROL
Councilmember Morgan asked if there was any interest in a resolution related to
control of the geese. The consensus was that there was not.
ARCH PARITY CONTRIBUTIONS
City Manager Schulze explained that he is the City of Medina representative on
the Executive Board, for A Regional Coalition for Housing (ARCH). He stated
that the Council had approved the ARCH 2O00 Work Program and Administrative
Budget, in the amount of $16,500. The City Manager said that the Executive
Board had identified projects for the coming year. The consensus was that the
Council would commit funds previously budgeted, to ARCH for Archdiocesan
Housing Authority — Eastside Maternity Home, Habitat for Humanity — Coal
Creek Terrace, DASH — Woodinville. It was decided that this matter would be
brought forward to the City Council Meeting on June 12, 2000, for approval.
EXECUTIVE SESSION
At 6:17 p.m. and under authority of RCW 42.30.110, Mayor Becker announced
that the Council would return to Executive Session, for discussion of potential
acquisition of real estate and matters of potential litigation.
ADJOURNMENT
At 6:55 p.m. the Council reconvened the Regular Session. Councilmember
Cohen moved to adjourn the May City Council Meeting. Seconded by
Councilmember Demitriades, all were in favor and the meeting was adjourned at
6:55 p.m.
