PUBLIC HEARING AND REGULAR MEETING MINUTES
March 12, 2001 Medina City Hall

Mayor Becker called the public hearing and regular meeting of the Medina City Council to order at 7:00
p.m. Action items only were recorded on audiotape.
ROLL CALL
Present: Council Members Paul Demitriades, Suzanne Cohen, Jim Lawrence, Thomas Morgan, Mary
Odermat, Steve Preston and Mayor Daniel Becker
Absent: Council Member Mary Odermat

ANNOUNCEMENTS
Mayor Becker announced a Technical Committee meeting on March 14, and an Executive Committee
meeting on March 26, 2001.
Council Member Demitriades indicated SB-6140 was a mechanism to put congestion relief board issues on
the ballot, after which the board would self-destruct. He noted the congestion relief board would be
_ comprised of members from 20 Puget Sound legislative districts.
Council Member Demitriades also relayed SB-1892, a new bill to coordinate the salmon recovery effort, not
only encouraged citizen volunteer efforts, but also gave the Department of Ecology more control over
salmon recovery.
CONSENT AGENDA
Council Member Demitriades moved, seconded by Council Member Preston, to approve the consent
agenda. Council Member Morgan requested items D, E and F of the Consent Agenda be moved to the
Business portion of the agenda. Mayor Becker suggested discussion of Ordinance No. 698 Relating to the
Protection and Preservation of Landmarks in the City of Medina, and Resolution No. 276 Nominating
Properties to the Medina Historical Landmark Register, be tabled to the April, 2001 Council meeting, to
make room for discussion of items D, E and F. It was also requested that the warrant report and agenda
be changed to "checks" rather than "warrants", and more expenditure information be on the check register.
The motion was amended as requested, and was passed by unanimous consensus.
STAFF REPORTS
PUBLIC SAFETY REPORT
Police Chief Knapp updated the Council regarding Police Department activity during the past month, noting
an average of a little more than one burglary per month. He also relayed the drive -by shooting reported
last month had not been intended to harm the security people sitting inside the parked vehicle.
Chief Knapp reported
Chief Knapp reported roadway sensors on 82nd Avenue NE showed compliance with the speed limit for
_ approximately 50 percent of the motorists, and those who exceeded it were in the one to ten miles per hour
over range. Chief Knapp reported enforcement had been increased in that area as a result.

Chief Knapp thanked the City Clerk for her efforts in completing the Police Captain examination process.
He reported Mark Mann, the successful candidate, would report aboard May 1, 2001, and was slated to
attend the FBI Academy next year.
Chief Knapp announced two citizens had volunteered for photography duty, in response to an
advertisement in the Medina Newsletter.
Citizen Henry Paulman voiced an interest in assisting with the traffic study.
Council Member Demitriades inquired about Medina's emergency preparedness. Chief Knapp responded
the plan was important to implement emergency preparedness through community education. He pointed
out the 800-megahertz radio system failed during the recent earthquake, and the city was now reviewing
other alternatives.
PUBLIC WORKS DEPARTMENT
Public Works Superintendent Burris announced the fencing for the air pollution monitoring system had been
moved for testing. He relayed several of the replacement trees still remained to be planted on NE 241h
Street. Public Works Superintendent Burris also reported Public Works personnel were continuing with
trimming vegetation overhanging the sidewalks as well as clearing Medina intersection sight lines. Council
Member Morgan requested Public Works Superintendent Burris check the vegetation on Evergreen Point
Road south of 781h Place NE for visibility, and to trim as much as possible from the right-of-way.
PLANNING DEPARTMENT REPORT
Planning Manager Schultz announced the Medina store conditional use permit and variance applications
would be heard by the hearing examiner on March 20, 2001. She also relayed hearing examiner interviews
would be held on March 22 and 23. Council Members requested one person from the Council and one
Planning Commissioner be invited to the hearing examiner interviews. They also asked the City Manager
to discuss issues of concern with hearing examiner Jim Driscoll, and that Planning Manager Schultz assure
Mr. Driscoll had read the Comprehensive Plan.
Planning Manager Schultz relayed the Planning Commission held a special hearing on March 5, 2001 to
review the Shirley project construction mitigation plan amendments. She continued the Planning
Commission would deliberate in executive session on March 14, 2001, and intended to issue a decision at
their regular March 27, 2001 meeting.
Planning Manager Schultz indicated the tree preservation ordinance was pending comments from Tree
Preservation Committee members and staff, after which it would be forwarded to the Council for review.

Mayor Becker opened the meeting to the audience for non -agenda items.

Dr. Rudolph updated the Council regarding the over flight issue.
OTHER BUSINESS
DISCUSSION OF BUDGET AMOUNT AND RECOMMENDATION FOR ENGINEER
City Manager Schulze announced Otak was the successful applicant of the 12 submittals for the NE 8th
Street Improvement Project, with their civil engineer serving as the project manager and Landscape
Consultant Keith Bates handling the landscaping portion. He pointed out Otak's broad range of experience
with pedestrian improvements, and their familiarity with the Medina neighborhood. City Manager Schulze
added the $25,000 scoping funding for this project was included in the 2001 budget, that the preliminary

design of alternatives would involve the community, and that alternatives would be presented to the
Council. City Manager Schulze explained Otak was prepared to quickly move forward with this project,
which might involve both a short-term and a long-term solution, due to the complex engineering design. He
pointed out the June or July projected start time, with design alternatives completed within 30 days.
Council Member Morgan urged inviting a Medina Elementary School teacher to the initial meeting.

Mr. Maxwell indicated the street on which he lived was a natural speedway.
Chris Lanzinger, 8058 NE 8`h, Medina
Mr. Lanzinger asked about the time frame and budget for a permanent solution, to which City Manager
Schulze replied the neighbors wished to see something in place, and the city wanted something
constructed by the next school year. He stated the permanent plan would be incorporated with the
temporary plan. Mr. Lanzinger emphasized gravel paths did not work well with strollers, and requested this
be taken into consideration.
Mr. Lanzinger complained that street drainage ran down his driveway. Council Member Morgan indicated
the storm drainage system had been discussed at the last Public Works Committee meeting. Due to the
city having problems with similar projects twice before, they did not want a repeat due to an inadequate
study, so he anticipated a final solution within two years.
DISCUSSION OF ORDINANCE NO. 709 REGULATING STREET EXCAVATION
Council Member Demitriades suggested public utility and telecommunications providers be further defined
in the Definitions section. Ordinance No. 709 was tabled to the April Council meeting, to give members
more time for review.
DISCUSSION OF ORDINANCE NO. 711 ADOPTING A SYSTEM FOR ISSUANCE, USE AND CONTROL
OF CREDIT CARDS
City Manager Schulze stated the auditor required established procedures and policies regarding use of
credit cards. He noted Ordinance No. 711 would protect the city with a record of expenditures, and the
card would only be issued to the department head for specific travel or to make travel arrangements.
However, personal cards could be used for meals or auto rental. City Manager Schulze also stated if an
advance was obtained, the recipient would be required to keep track of his/her expenses. Following
discussion, Council Member Lawrence moved, seconded by Council Member Demitriades, to adopt
Ordinance No. 711, with a change from Finance Officer to City Manager in the Authorization and Control
section. The motion carried unanimously.
DISCUSSION OF ORDINANCE NO. 712 RELATING TO REIMBURSEMENT FOR MEAL EXPENSES
Council member Cohen moved, seconded by Council Member Demitriades, to approve Ordinance No. 712,
which was adopted as written, with Council Member Morgan abstaining.
ORDINANCE NO. 692 RELATING TO TELECOMMUNICATIONS
Council Member Morgan moved that Ordinance No. 692 be approved, seconded by Council Member
Demitriades. City Attorney Wines warned citizens would apply for franchises, and the city did not have the
framework to deal with it, which would delay the process. Ordinance No. 692 was adopted, for review in
May for possible amendments.
DISCUSSION OF ORDINANCE NO. 713 REPEALING TERM LIMITS
City Attorney Wines explained both the Supreme Court and Federal Court had declared term limits
unconstitutional.

Mr. Paulman took exception to the unconstitutionality of term limits, stressing a person running for a third
term would have to pay for their own campaign or would be required to be a write-in. He emphasized both
denying an incumbent access to the ballot and demanding a higher filing fee were unconstitutional.
Following discussion, the Council voted to approve Ordinance No. 713, with Council Member Morgan
abstaining.
DISCUSSION OF VOICE STREAM PROPOSAL
City Manager Schulze explained Voice Stream representatives had contacted the City of Medina to discuss
a proposal to install a Nokia micro cell in the garage of a Voice Stream executive living in Medina. He
pointed out it was a geographical rather than a broad coverage issue, similar in function to a cordless
phone. Both Council Member Preston and City Attorney Wines agreed to work together for a presentation
at the April Council meeting. The Council directed a letter to be sent to Voice Stream explaining the permit
requirement.
DISCUSSION OF BELLEVUE CHRISTIAN SCHOOL FIELD FOR BASEBALL AND SOCCER USE
Council Member Morgan gave background information regarding public use of the Bellevue Christian
School field for baseball and soccer. He emphasized vehicle parking accommodations might present a
problem, and requested additional information regarding parking and traffic, the number and ages of
Medina children who would potentially be using the field, as well as resident use when no other activities
were scheduled. City Manager Schulze indicated he would include the above issues in a response to the
Park Board. The Council decided to defer any decisions for the present, but they were not closing the door
to further discussion.
DISCUSSION OF LARGE HOUSES AT MARCH 26, 2001 COUNCIL STUDY SESSION
The Council decided to study the large house mitigation issue at the March 26, 2001 Study Session, which
would begin at 6:00 p.m.
