PUBLIC HEARING AND REGULAR MEETING MINUTES
August 13, 2001 Medina City Hall

Mayor Becker called the public hearing and regular meeting of the Medina City Council to order at T05 p.m.

ANNOUNCEMENTS
Mayor Becker reported the following:
• Medina Days was a very successful event, attended and enjoyed by many citizens.
• Alternative technology vehicles will be on exhibit at Green Lake Park on August 19, 2001.
• St. Thomas School is commemorating its 50'h year, and wishes to receive a congratulatory letter from the city.
Mayor Becker referred to a handout entitled "10 Year Look for Fiscal Years 1994 — 2003", which identified contributions and
benefits by county to the state transportation fund. He noted those counties receiving benefits and contributing little to the
transportation system could have their funding cut.
Council Member Demitriades reported Eastside Citizens Against Aircraft Noise (ECAAN) members and several others had
met with Senator Patty Murray during the August recess, and as a result, she was willing to approach the FAA regarding jet
noise. He noted Representative Jennifer Dunn had also expressed interest in increasing Duwamish aircraft departures.
noting Representative John Mica, Chair of the Aviation Subcommittee, would be present at an August 21 event hosted by
her to review the third runway option.
CONSENT AGENDA
Council Member Morgan moved, seconded by Council Member Odermat, to approve the consent agenda, which passed by
unanimous consensus.
PUBLIC SAFETY REPORT STAFF REPORTS
Chief Knapp announced another burglary had occurred, which tied in with his latest Medina Newsletter article alerting
residents about a disturbing trend in home -occupied burglaries. He noted on two occasions, property had been removed
while residents were at home, including one of identity theft. Chief Knapp stated the 41 car prowls occurring since last year
had all been unlocked. He urged residents to lock their cars, their homes, and to turn on alarms when retiring at night.
PUBLIC WORKS REPORT
Public Works Superintendent Burris relayed part of the Medina Days celebration involved depositing fish in the Medina Park
pond, and five were caught on Saturday, August 11. He also reported the swim float had been anchored. Public Works
Superintendent Burris announced the air pollution monitor equipment would be delivered within the next week or so. He
also noted significant progress with computer installation in police vehicles.
Council Member Demitriades expressed appreciation for a job well done by both the Public Works and Police Departments
during Medina Days. Mayor Becker relayed Joseph Brazen had suggested the city might consider purchasing equipment
for Medina Days, in order to eliminate the need for rental each year.
AUDIENCE PARTICIPATION
Mayor Becker opened the meeting to the audience for non -agenda items.
Bill Kinzel, 802 — 801h Avenue NE referred to his request for reconsideration of the NE 81h Street project, and suggested it
be reviewed again.

2002 — 2007 CAPITAL IMPROVEMENT PLAN OTHER BUSINESS
City Manager Schulze explained the purpose of the 2002 — 2007 Capital Improvement Plan (CIP), and pointed out the
differences between a CIP and a Transportation Improvement Plan (TIP). He distributed a color -coded street condition
chart, and suggested setting up a schedule of all Medina streets, based on the level of deterioration, for next year's TIP
consideration. He briefed the Council regarding future street needs, as well as design fixes for the anticipated traffic loads.
City Manager Schulze explained what adoption of the CIP meant, as well as the included control, and emphasized adoption
of the CIP did not mean authorization of project construction, but rather established a plan for future capital improvements.
City Manager Schulze reported the Park Board had requested Medina Beach Park improvements last year, noting the
bulkhead erosion had resulted in losing part of the shoreline. He pointed out the beach area retaining wall, installed five to
ten years ago, was falling apart and should be replaced. City Manager Schulze noted the Park Board had also proposed
some minor landscaping throughout the park, and benches as well as picnic tables also needed improvement. City
Manager Schulze relayed the Park Board was reviewing the Medina Beach Park Master Plan, and as part of the 2002
budget process, the Council would be receiving more information in the future.
City Manager Schulze turned to Phase II of Fairweather Nature Preserve, noting it included both the wetland and
gymnasium areas. Mayor Becker suggested the city purchase the remaining Fairweather property, in order to keep it whole,
as it was presently land that could potentially be developed for expansion of SR-520.
With regard to a cost estimate for the police facility, City Manager stated more detail would be forthcoming. He noted an
architect had been hired to conduct a needs assessment and feasibility study, and that report would soon be complete. The
Council decided to set aside the police facility until they had received this report, after which they could amend the CIP.
City Manager Schulze referred to the Anderson and Ray Medina Stream Restoration report in the Council packet, noting it
was the second one, the first of which had been prepared by Springwood and Associates for Anderson and Ray.
City Manager Schulze briefed the Council regarding the Beach Park west boat dock, noting the Mercer Island Marine Patrol
and the Medina Days sightseeing vessel primarily used it. He pointed out the need for significant dock repair, adding the
Park Board Master Plan addressed both Beach Park docks, and more information would be forthcoming from the Park
Board. He also explained the 84`h Avenue NE public dock needed repair, as well as some minor landscaping and benches in
the surrounding area. Council Member Odermat suggested Waterfront Construction inspect all of the city docks for an
estimate of necessary repairs and prices.
Following discussion, the Council suggested the CIP be completed in more detail and moved to the September 10, 2001
agenda. They also recommended Waterfront Construction inspect the Medina Beach Park docks, with an estimate of the
amount needed for improvements. Both Mayor Becker and Council Member Demitriades volunteered to attend the August
20, 2001 Park Board meeting.
JOINT AUGUST STUDY SESSION WITH PLANNING COMMISSION ON AUGUST 28 2001
The Council decided to move the August study session to August 28, in order to meet jointly with the Planning Commission.
The joint study session agenda will include discussion of Ordinance Nos. 714, Establishing a Construction Code of Conduct,
and Ordinance No. 720, Regarding Nuisance. as well as dialog concerning R-16 recommendations.
RESOLUTION NO. 278 FILING PROCEDURES FOR CLAIMS FOR DAMAGES
City Manager Schulze explained as a result of state statute amendment, the Council must appoint someone to receive
claims for damages. Council Member Demitriades moved, seconded by Council Member Odermat, to adopt Resolution No.
278. Following a vote the Council unanimously adopted Resolution No. 278, Filing Procedures for Damage Claims.
SET PROCESS AND DATE FOR PUBLIC HEARING ON COMPREHENSIVE PLAN AMENDMENTS
City Attorney Wines explained state law required the Council to annually consider amendments to the Comprehensive Plan,
and recommended it be forwarded to the Planning Commission for review, public hearings for citizen input, and to make
amendment recommendations. Following discussion, the Council requested the Planning Commission follow through to
obtain citizen input and report back to them with suggested amendments.
DISCUSSION OF AMENDMENTS TO PARKING REGULATIONS/EVENT PARKING
Following discussion, the Council decided to move the issue of parking regulations amendments, including special event
parking, to a future study session. They also requested the services of a land use specialist to advise them, in order to take
the proper steps for implementation.

RESOLUTION NO. 279, 4-POST PLAN ENFORCEMENT
Mayor Becker excused himself from the meeting, due to the possible appearance of conflict of interest. Mayor Pro Tern
Morgan noted through the Freedom of Information Act, Barbara Lichman had submitted a request to the FAA regarding 4-
Post Plan enforcement, and City Attorney Wines was in the process of presenting one to the Port of Seattle as well. Council
Member Demitriades moved, seconded by Council Member Lawrence; to approve Resolution No. 279. The vote was
unanimous for those present. Mayor Becker rejoined the meeting.
NEW BUSINESS
COUNCIL REVIEW OF HEARING EXAMINER PROCESS
Council Member Lawrence referred to a letter from resident Rod Bindon regarding the hearing examiner process. Mayor
Becker noted the letter stated three of five citizen comment letters for a recent case had not been taken into consideration at
the hearing. He asked if any information was not given to the hearing examiner, whether or not the Council could ask for
reconsideration, to which City Attorney Wines replied affirmatively. Mayor Becker suggested the Council assemble an ad
hoc committee to analyze the hearing examiner process. Council Member Odermat recommended members from the
former Board of Adjustment participate as well. City Attorney Wines volunteered to review the case to determine whether or
not reconsideration was warranted. City Manager Schulze indicated Planning Manager Schultz had been in contact with
former Board of Adjustment members, and would call Mayor Becker to recommend two people for review process
participation. The Council expressed interest in discussing the hearing examiner procedure and in evaluating the first six
months of this process. Council Members Lawrence, Cohen and Odermat volunteered to assess the results. City Manager
Schulze stated he would draft a response to the Bindon letter for Mayor Becker's signature.
ADJOURNMENT
Council Member Lawrence moved to adjourn, seconded by Council Member Demitriades. All were in favor, and the meeting
was adjourned at 9:36 p.m.
