Mayor Becker called the Study Session of the Medina City Council to order at 4:00 p.m.
ROLL CALL
Present: Council Members Paul Demitriades, Suzanne Cohen, Mary Odermat, and Mayor Pro Tern Tom Morgan
Absent: Council Members Steve Preston, Jim Lawrence and Mayor Dan Becker

ANNOUNCEMENTS
Mayor Pro Tern Morgan announced an executive session would be held to consider potential legal action regarding
Eastside Citizens Against Aircraft Noise (ECAAN) and the Port of Seattle.
OTHER BUSINESS
Discussion of Ordinance No. 721 Establishing a Park Preservation Program
Mayor Pro Tern Morgan announced Ordinance No. 721, arising from Seattle's Initiative 42, was proactive so no taking of
Fairweather Park could occur without exchange. City Attorney Wines explained Initiative 42 was designed to finance
additional parks and also prohibited parkland removal unless there was no other alternative. He noted this included state
condemnation proceedings, and it would establish a basis for the city's resistance against such action. Following
discussion, the Council decided Ordinance No. 721 should be part of the August 13, 2001 consent agenda.
Discussion of 2002 — 2007 Capital Improvement Plan
City Manager Schulze explained the draft 2002 — 2007 Capital Improvement Program (CIP) included projects from the
2001 — 2006 CIP as well as projects proposed by city staff, the Park Board and Council Members. He noted the CIP was
a useful budgeting tool and projects planned during 2002, 2003 and 2004 should be included in the 2002 annual budget
for preliminary design, final design and construction, based on the CIP programming. City Manager Schulze emphasized
the TIP portion must be submitted by the end of July; however, the CIP could be discussed at the August Council
meeting. The Council requested additional information for all CIP projects, Park Board input for park projects, modified
recommendations for Fairweather Preserve, identification of preliminary cost estimates, current status of projects, and
Council approval dates. They also decided the 2002 — 2007 CIP should be discussed at the August Council meeting.
Discussion of Ordinance No. 714 Establishing a Construction Code of Conduct and Providing Penalties for
Violation; Discussion of Ordinance No 720 Adopting MMC Chapter 8 45 Civil Violations and Nuisances and
Repealing MMC Chapter 8.04, Nuisance
Council Member Morgan inquired about the Mitigation Plan. City Planning Manager Schultz replied it was being
incorporated into a nuisance ordinance regulation, rather than as currently written.
City Manager Schulze referred to Ordinance 714 establishing a construction code of conduct, noting it provided penalties
for violation. He stated Ordinance No. 720 established the mechanism for dealing with nuisances and violations of land
use regulations and the Construction Code of Conduct. City Manager Schulze noted both proposed ordinances had been
included in the Council's weekly mail packets. City Attorney Wines added Ordinance No. 720 rewrote the nuisance
ordinance and eliminated the current one. He added both Ordinance Numbers 714 and 720 should be handled together.
City Attorney Wines emphasized the Mitigation Plan would still kick in to require further review by the Planning
Commission and mitigation of site -specific measures. City Planning Manager Schultz announced the Planning
Commission had not yet reviewed the construction mitigation ordinance. Following discussion, the Council decided
Ordinance Numbers 714, 720 and the construction mitigation ordinance limiting maximum house size should be
discussed simultaneously at a future joint public hearing with the Planning Commission.
ANNOUNCEMENTS
WRIA
Council Member Demitriades announced he had recently attended a WRIA meeting, and a $500,000 budget had been
approved for salmon restoration for Lake Washington and Lake Sammamish. He added grant money might be available,
and suggested the city might apply for funding. The Council requested review and a report regarding WRIA grant funding
for salmon -related restoration projects.
Discussion of Resolution No. 279, 4-Post Plan Enforcement
_ Council member Demitriades stated he had been working with Eastside Citizens Against Aircraft Noise (ECAAN). Council
Member Morgan commented jet arrival delays were caused by departure delays from other airports.
Air Quality Reports
Council Member Morgan inquired about the final Air Quality Reports. Public Works Superintendent Burris responded
these reports should have been sent a month ago and he would contact Engineering, Health and Safety Consultants
International (EHS) to obtain them.
ADJOURNMENT
Council Members agreed by consensus to adjourn the study session at 5_35 p,.m,
