HomeMy WebLinkAbout01-10-2005 - MinutesMEDINA CITY COUNCIL REGULAR MEETING MINUTES January 10, 2005 7:00 p.m. CALL TO ORDER Medina City Hall 501 Evergreen Point Road Mayor Odermat called the January 10, 2005 meeting of the Medina City Council to order at 7:13 p.m. ROLL CALL Present: Mayor Mary Odermat, Deputy Mayor Todd Nunn Council members Miles Adam, Drew Blazey, Katie Phelps, Bob Rudolph (via conference call), and Pete Vall-Spinosa City Staff Present: Douglas Schulze, City Manager; Kirk Wines, City Attorney; Jeff Chen, Chief of Police; Rachel Baker, Administrative Assistant APPROVAL OF MEETING AGENDA • MAYOR REQUESTED TO DISCUSS "NEW BUSINESS" PRIOR TO AGENDA CALENDAR DISCUSSION • MAYOR CONFIRMED AN EXECUTIVE SESSION WOULD BE HELD MEETING AGENDA APPROVED BY COUNCIL CONSENSUS, 7:15 P.M. AWARDS AND PRESENTATIONS Mayor awarded Officer, John Kane, "Medina Police Officer of the Year" and presented him with a certificate of merit. Chen commended Kane for his attributes, experience, leadership in project design work for mobile command post information, leadership during the department's software transition and the willingness to absorb administrative tasks, which increased efficiency in the department. ANNOUNCEMENTS Mayor ( 7:' 9 p.m.) Mayor made the following announcements: • 2005 Legislative Session opened at 12:00 p.m., January 10, 2005 and will conclude on April 24t", 2005 • Medina is represented by Lou Guesser, Senator; and Representatives, Ross Hunter, Democrat and Rodney Tom, Republican (both Medina residents) • SR-520 Bridge Replacement and HOV Project Executive Committee will meet at MOHAI (Museum of History and Industry) from 1:00 to 4:00 p.m., Tuesday, January 11, 2005; meeting will be opened to the public. • Eastside Transportation Partners (ETP) meeting scheduled for Friday, January 14, 2005, 7:30 a.m., at Unigard facility in Bellevue. • The ETP members will meet with legislators in Olympia, Wednesday, January 26, 2005, from 11:30 a.m. to 1:00 p.m. • Sound Transit will hold a series of community meetings during January to acknowledge its tenth anniversary. Eastside meetings dates, times and locations are as follows: January 12, 2005, at Bellevue First Congregational Church and January 26, 2005, at Issaquah King County Library Service Center. Both meetings begin at 5:00 p.m., and are scheduled to end at 8:00 p.m. • Registration began last week for the Association of Washington Cities (AWC) City Legislative Action Conference, scheduled for February 16 and 17, 2005, in Olympia. • Medina Emergency Committee (formerly Emergency Services Committee) will meet Wednesday, January 19, 2005, 4:00 p.m., at City Hall. • January Park Board meeting has been rescheduled to Wednesday, January 19, 2005, 7:00 p.m., at City Hall. The regular meeting night falls on Martin Luther King Jr. Day, a legal holiday. • The Planning Commission will hold a special Public Hearing on the revised Comprehensive Plan and Critical Areas Ordinance, Tuesday, January 25, 2005, 7:00 p.m., at City Hall. Council No announcements Staff No announcements City Council Minutes January 10, 2005 Page 2 CONSENT AGENDA MOTION VALL-SPINOSA, SECOND ADAM TO PASS CONSENT AGENDA WITH THE FOLLOWING CHANGES: • FINANCIAL REPORT (J2) MOVED TO NEW BUSINESS • RESOLUTION SETTING DATES FOR 2005 STUDY SESSIONS (J3) MOVED TO NEW BUSINESS • CORRECTION TO DECEMBER 13, 2004 MINUTES; PREFACING BUDGET REVIEW COMMITTEE, WITH WORD "CITIZEN" MOTION PASSED UNANIMOUSLY, 7:25 P.M. AUDIENCE PARTICIPATION None REPORTS Police Department (7:25 p.m.) Chen introduced Commander Ed Holmes, Mercer Island Operations Bureau, Sergeant Mark Crofton, and Sergeant Dave Jokinen, Mercer Island Marine Patrol. Crofton provided summary of Marine Patrol statistics and services provided during 2004. Crofton announced City of Mercer Island now contracts dispatch services with the Kirkland Dispatch Center. Crofton extended congratulations to Chen and Linda Crum (Records Manager, Medina Police Department) for providing an exceptional and unique lifeguard and swim lesson program in Medina. Crofton conveyed Medina's program is discussed widely and used as an example throughout the state. Chen provided December and year to date crime totals for department and answered councilmember questions. Chen updated Council of trend involving mail thefts and forced residential burglaries. Chief warned residents to look out for each other and to contact the department when suspicious activity is witnessed. Development Services (7:51 p.m.) Joseph Gellings, Director of Development Services, was on vacation and unable to attend meeting. City Council Minutes January 10, 2005 Page 3 Planning Commission Chair, Mark Lostrom, commented on the progress of Comprehensive Plan and Critical Areas Ordinance review and announced an updated draft should be available for review, Thursday, January 13. Discussion followed regarding conservancy properties. Public Works Department (8:09 p.m.) Schulze commented the employees have been performing maintenance work, including refurbishing picnic tables at Medina Beach Park, and other general park maintenance. Mayor conveyed resident, Charles Pigott, has contacted her with concerns about signs installed identifying dock at end of 84t" and has requested an official complaint be logged with the City. Emergency Preparedness Committee (8:08 p.m.) Mayor requested Council permission to send a letter to each committee head to thank them for assuming responsibility on behalf of the City for monumental work and progress made. Councilmembers granted permission. City Manager (8: 09 p.m.) Schulze provided update on jurisdictional court case, indicating City received positive responses from Hunt's Point, Mercer Island, Newcastle, Marysville and Tenino, in response to letter from Point's communities. Schulze conveyed City should know if the case would be accepted or dismissed by the court by January 14, 2005. Adam informed Schulze the City Hall phone number is not published in telephone directories. Schulze indicated he would follow up. Discussion followed concerning City's budget press release. PUBLIC HEARING None OTHER BUSINESS Discuss Procedures and Criteria for Review of Medina Park Dog Rules (8:16 p.m.) Schulze stated Council agreed to review Ordinance 774, nine to twelve months following July 2004 adoption. Schulze requested Council discuss review procedures and criteria and provided suggestions for obtaining information, such as polling citizens, monitoring use, and utilizing an unbiased subcommittee. Discussion followed. City Council Minutes January 10, 2005 Page 4 Mayor acknowledged Council consensus to conduct a professional survey. She further explained Park Board would assimilate park -related results and provide recommendations to Council. Schulze commented he would like a future citizen survey discussion. Discuss 50t" Anniversary Planning (8:38 p.m.) Schulze described City of Clyde Hill's celebration and suggested Medina consider a similar celebration when planning the City's event. Resident in attendance, Wilma Edmonds, offered to provide a history book written by Bernice Snowden and to speak to two long-term residents for information regarding Medina's history. Edmonds suggested contacting Michael Lewis, grandson of Medina's first mayor, or his mother, Elizabeth Lewis, who could provide information about Medina's history. Nunn informed councilmembers, Heija Nunn offered to volunteer with planning Medina Days. Schulze stated Thornton Thomas would be willing to provide historical information, scrapbooks and photographs. Blazey suggested Joe Meisenheimer indicated an interest in volunteering. Odermat suggested she, Schulze, Phelps and Heija Nunn meet to discuss forming a volunteer committee. Discussion followed regarding whether Medina Days and the anniversary should be celebrated as two separate or a single event. Council consensus determined events should be held separately, with some joint activities or events overlapping. Council discussed financing options and determined City will provide funding for 50t" anniversary celebration and expects volunteer committee to provide a budget proposal. Discuss Public Relations Policy (9:07 p.m.) Schulze requested direction and comments from Council regarding draft policy. Council discussion followed. Odermat conveyed Council consensus to implement a streamlined policy. Discuss Annual Retreat and Options for Citizen Participation (9:28 p.m.) Schulze identified survey options for City. Council discussed importance for implementation of a professional, unbiased survey. Discussion followed. Council majority expressed interest to explore options for a professional citizen survey. City Council Minutes January 10, 2005 Page 5 Odermat directed Schulze to present survey recommendations during January 24, 2005 Study Session. Schulze agreed and indicated he would attempt to provide a cost range for survey, but stated estimates could be difficult to determine until survey parameters are defined. Authorize Contract for City Attorney Services (9:45 p.m.) Council discussed City Attorney Services contract. Nunn proposed the following changes: • Identify and capitalize rules of professional conduct, such as "Washington Rules of Professional Conduct" (page two) • Identify "Attorney -Client Privilege" (page three, paragraph eight) • Elevate firm's professional liability insurance requirement (page five, 136) • Add page numbers to contract Discussion followed. MOTION NUNN, SECOND ADAM TO APPROVE PROPOSED CITY ATTORNEY SERVICES CONTRACT FOR SERVICES OF OGDEN, MURPHY, WALLACE AS CITY ATTORNEY, WITH SUGGESTED CHANGES, MOTION PASSED UNANIMOUSLY, 10:09 P.M. Council Agenda Calendar (10:45 p.m.) Discussion followed. NEW BUSINESS City Facilities (10:10 p.m.) Odermat suggested councilmembers commit time to collectively observe employee workspaces to distinguish positive and negative attributes before decision rendered regarding City facilities. Odermat further suggested councilmembers tour City of Clyde Hill police facility for comparison with Medina City Hall. Odermat clarified recommendation would be to purely gain information and is not a stand on the issue. Discussion followed. An informal poll resulted in a 4-3 vote against further discussion of City facilities, and item was removed from calendar. City Council Minutes January 10, 2005 Page 6 Financial Report (10:23 p.m.) Schulze summarized preliminary 2004 financial report and indicated final review and minor adjustments would be made prior to distribution of a final year-end report. Schulze stated he would follow up with playground item expense listed in check register. Discussion followed. MOTION VALL-SPINOSA, SECOND BLAZEY TO PASS FINANCE OFFICERS REPORT, MOTION PASSED UNANIMOUSLY, 10:35 P.M. Resolution Setting Dates for 2005 Study Sessions (10:35 p.m.) Council discussed positions for resolution. MOTION NUNN, SECOND PHELPS TO APPROVE RESOLUTION SETTING DATES FOR 2005 STUDY SESSIONS, MOTION PASSED 6-1, ADAM OPPOSED, 10:43 P.M. EXECUTIVE SESSION Purpose: Labor Negotiations Pending Litigation Schulze announced Executive Session would be approximately 20 minutes and no action was anticipated following Executive Session. Council convened in Executive Session, 10:49 p.m. ADJOURNMENT MOTION, SECOND TO ADJOURN JANUARY 10, 2005 CITY COUNCIL MEETING APPROVED.
