CALL TO ORDER
Mayor Bret Jordan called the June 13, 2011 Regular Meeting of the Medina City
Council to order at 6:34 pm.
ROLL CALL
Council Members Present: Patrick Boyd, Doug Dicharry, Bret Jordan, Janie Lee,
Mark Nelson, and Shawn Whitney
Council Members Absent: Katie Phelps (excused)
City Staff Present: Donna Hanson, City Manager; Bruce Disend, City
Attorney, Kenyon Disend; Dan Yourkoski, Acting Police
Chief; Robert Grumbach, Development Services Director;
Joe Willis, Public Works Director; Nancy, Adams, Finance
Director; and Rachel Baker, City Clerk
Motion Nelson and second Whitney to excuse council member Phelps’ absence and
motion carried 6-0 at 6:35 pm.
APPROVAL OF MEETING AGENDA
Motion Whitney and second Lee to add discussion item concerning employment
matter regarding former police chief Jeffrey Chen. Motion failed 2-4 (Lee and Whitney
in favor, Phelps absent) at 6:37 pm.
MOTION NELSON AND SECOND TO ADOPT AGENDA AS WRITTEN AND
MOTION CARRIED 5-1 (LEE OPPOSED, PHELPS ABSENT) AT 6:38 PM.
AWARDS & PRESENTATIONS
Recognition of Volunteer Service (6:38 pm)
Mayor Jordan recognized volunteer service provided by Molly Goudy to the Medina
Planning Commission in position number two from July 2007 through June 2011.
Washington Association of Sheriffs and Police Chiefs (6:39 pm)
Garry Anderson, Management Services Coordinator, provided a summary of the current
recruitment process for police chief.

PUBLIC COMMENT
Mayor read guidelines for public comment and said comment period may be divided
into two sections with the second section picking up following public hearings. Mayor
opened public comment period at 6:46 pm.
Seattle resident Jeffrey Chen addressed audience and council members concerning
police chief employment matter.
The following Medina residents provided public comment in regard to matter
concerning former police chief: Doug Epstein, Laura Weingaertner, Tim O’Brien,
Chuck Lyford, Steve Brustkern, Miriam Naini, Paul Major, Jim Gerardo, Scott Hannah,
Curtis Wong, Ching Pi-Wang, Cy Humphries, Diana Murray, Doug Hutson, Ally
Svenson, Marnix Bosch (represented by Heija Nunn), David Lee, Todd Nunn, Heija
Nunn, and (first name inaudible) Ewing.
Bellevue resident Jim McGraw provided comment related to police chief employment
matter.
The following Hunts Point residents provided public comment in regard to matter
concerning former police chief: Edward Furia, Doug (last name inaudible), Janet
Dailey, and Peter Henning.
Mayor closed public period at 7:47 pm and added another comment period between items
Proposed Ordinance for Minimum Maintenance Standards for Vacant Residential and
Abandoned Construction Sites and Council Agenda Calendar.
Motion Lee and second Whitney to continue public comment. Dicharry offered
amendment to limit comment period to ten minutes and Lee rejected amendment.
Motion failed 2-4 (Lee and Whitney in favor, Phelps absent) at 7:49 pm.
REPORTS AND ANNOUNCEMENTS
Council members Lee and Whitney commented on public records requests made by
Whitney for expense reports for police department gasoline receipts and three other
public records requests submitted by Whitney the night after Jeff Chen’s termination.
Planning commission chair Judie O’Brien reported the shoreline report presented to
council was an inaccurate reflection of the work of the shoreline committee,
suggested hiring a company to help the shoreline committee, and expressed her
disappointment in not being present during volunteer applicant interviews for planning
commission.
Park board chair Matt Kochel vocalized concerns regarding reconstruction of
Fairweather Park and relayed the park board has received requests for a field turf and
field lighting. He encouraged the public to attend a discussion before the park board
in coming months and summarized the park board’s open house held April 18. Kochel
called for Medina Days volunteers and donations and pointed supporters to go to
www.medinadays.org.

Emergency committee chair Kay Koelemay summarized May 18 Map Your
Neighborhood orientation and announced a second opportunity to hear about the
program will be held June 17 during the Train the Trainer program.
Grumbach briefly reported about the engineering services request for qualifications
process.

PUBLIC HEARINGS / OTHER BUSINESS
Public Hearing Concerning WSDOT/FHWA’s Proposed de minimis Section 4(f)
Determination for Fairweather Park (8:18 pm)
Willis provided summary of de minimus and responded to questions concerning lighting
and field construction.
Mayor opened public hearing at 8:24 pm.
Medina resident Diana Murray expressed concerns about impacts of construction and her
preference for a park and ride, excluding use by construction workers there and along
Evergreen Point Road.
Medina resident Tobey Bryant spoke about shortage of athletic fields in Bellevue area and
encouraged installation of a turf field in Medina.
Medina resident John Maffei supported Ms. Bryant for field in Medina. He commented
most park and ride users reside outside Medina and such a facility increases crime in
surrounding area.
Medina resident Cindy Adkins expressed desire to keep park as a park and strongly
opposed park and ride.

Medina resident Matt Kochel said Medina, not WSDOT, desires park and ride in Medina.
Mr. Kochel said the park board is in favor of a turf field and does not support lights at
Fairweather at this time, and as a citizen prefers the park to remain a park during
construction and not a park and ride.
Speaker (name not disclosed) commented about park use and did not support staging
area.
Medina resident Heija Nunn suggested Bellevue Christian may be an option for a turf field
and suggested openness to all creative possibilities, especially if on WSDOT’s dime.
Medina resident M3 Sweatt recommended council seek out more commentary on issue
before taking action since agenda did not clearly describe matter.
Mayor closed public comment period at 8:36 pm.
Concurrence with Determination of WSDOT/FHWA’s Proposed de minimis Section 4(f)
Determination for Fairweather Park (8:36 pm)
Willis further defined proposal and council discussed matter. Eastside Corridor
Constructors representatives were present and responded to questions regarding park
and ride and construction storage and staging area.
MOTION WHITNEY AND SECOND LEE TO TABLE MATTER UNTIL NEXT
MONTH, SCHEDULE AND PUBLICISE AN ADDITIONAL PUBLIC HEARING,
AND DIRECT STAFF TO PRESENT FINDINGS OF AVAILABLE OPTIONS AT
NEXT MEETING. MOTION CARRIED 6-0 (PHELPS ABSENT) AT 9:01 PM.
Council member Boyd offered amendment to motion to find out what options are available
and direct staff to present findings at next meeting. Whitney accepted amendment to
motion.
Motion Lee and second Whitney to recess into executive session pursuant to RCW
42.30.110 (1)(g) to discuss performance of a public employee. Motion carried 4-2 (Boyd
and Nelson opposed, Phelps absent) at 9:05 pm.
Mayor called for a break at 9:07 pm in order to clear the meeting space for executive
session.
EXECUTIVE SESSION
Mayor Jordan recessed regular meeting into executive session at 9:25 pm pursuant to
RCW 42.30.110 (1)(g) to discuss performance of a public employee for an estimated time
of thirty minutes and announced action may be taken following executive session. Present
were city council members Patrick Boyd, Doug Dicharry, Bret Jordan, Janie Lee, Mark
Nelson, and Shawn Whitney; city manager Donna Hanson; and city attorney Bruce
Disend.

Executive session was extended twenty minutes at 9:55 pm. Executive session adjourned
at 10:15 pm and the regular meeting was called back to order. No action was taken.
PUBLIC HEARINGS / OTHER BUSINESS
Public Hearing Concerning Proposed Ordinance for Code Amendment Relating to Off-Site
Accessory Buildings and Uses (10:17 pm)
Grumbach summarized proposed ordinance.
Mayor opened public hearing at 10:19 pm. No public comment was presented and the
hearing was subsequently closed.
Consideration of Proposed Ordinance for Code Amendment Relating to Off Site
Accessory Buildings and Uses (10:19 pm)
MOTION WHITNEY AND SECOND DICHARRY TO APPROVE ADOPTING AN
ORDINANCE AMENDING CHAPTER 17.48 OF THE MEDINA MUNICIPAL CODE TO
ALLOW OFF-SITE ACCESSORY USES AND BUILDINGS. MOTION CARRIED 6-0
(PHELPS ABSENT) AT 10:22 PM.
PUBLIC HEARING
Public Hearing Concerning Draft Six-Year Capital Improvement and Transportation
Improvement Plans, 2012-2017 (10:23 pm)
Willis summarized proposed plan and responded to questions about planned projects
from council members.
Mayor opened public hearing at 10:29 pm. No public comment was presented and the
hearing was subsequently closed.
MOTION DICHARRY AND SECOND BOYD TO SCHEDULE APPROVAL OF THE 2012
THROUGH 2017 CAPITAL IMPROVEMENT/TRANSPORTATION IMPROVEMENT PLAN
FOR THE JULY 11, 2011 CITY COUNCIL MEETING. MOTION CARRIED 6-0 (PHELPS
ABSENT) AT 10:30 PM.
OTHER BUSINESS
Design Selection for Independent Towers’ Wireless Communication Support Structure at
Fairweather Park (10:30 pm)
Grumbach provided summary regarding installation of a wireless communication facility at
Fairweather Park and answered questions related to project. Council members discussed
public comment received to date.

LIGHT POLE, FOR THE WIRELESS COMMUNICATION TOWER AT
FAIRWEATHER PARK. MOTION CARRIED 5-1 (NELSON OPPOSED, PHELPS
ABSENT) AT 10:42 PM.
Proposed Ordinance for Minimum Maintenance Standards for Vacant Residential and

Grumbach summarized proposed ordinance and council discussed viability of ordinance.
Dicharry invited planning commission chair O’Brien to speak on matter and she
summarized commission’s position on proposal.
MOTION WHITNEY AND SECOND DICHARRY TO APPROVE ADOPTING AN
ORDINANCE ADDING A NEW CHAPTER 20.44 TO THE MEDINA MUNICIPAL
CODE RELATING TO MINIMUM MAINTENANCE STANDARDS FOR VACANT
RESIDENCES AND ABANDONED CONSTRUCTION SITES. MOTION CARRIED
6-0 (PHELPS ABSENT) AT 11:03 PM.
PUBLIC COMMENT
Mayor Jordan reopened public comment period at 11:03 pm.
The following Medina residents provided public comment in regard to matter
concerning former police chief: Jeff Price, M3 Sweatt, Miranda Lee, Joe
Meisenheimer, Jim Gerardo, Anne Rudden, and Haleh Clapp
The following Hunts Point residents provided public comment in regard to matter
concerning former police chief: Jeanne Claypool, Annie Otteson, and Jon Rudolf.

The Medina City Council will hold its next Regular Monday, July 11, 2011, at 6:30 pm in
the Commons Room at St. Thomas School, 8300 Northeast 12 Street, Medina.
