HomeMy WebLinkAbout08-08-2011 - MinutesMEDINA CITY COUNCIL SPECIAL AND REGULAR MEETING MINUTES Medina City Hall, Council Chambers 501 Evergreen Point Road, Medina Monday, August 8, 2011; 5:00 pm SPECIAL MEETING The August 8, 2011 Special Meeting of the Medina City Council was noticed pursuant to RCW 42.30.080. The Special Meeting began at 5:00 pm and concluded at 6:30 pm. The meeting agenda included: 1. Community Meet and Greet: Police Chief Candidate Finalists, and 2. Medina City Hall Open House. CALL TO ORDER Mayor Bret Jordan called the August 8, 2011 Regular Meeting of the Medina City Council to order at 6:35 pm. ROLL CALL Council Members Present: Patrick Boyd, Doug Dicharry, Bret Jordan, Katie Phelps, Janie Lee, Mark Nelson, and Shawn Whitney City Staff Present: Donna Hanson, City Manager; Bruce Disend, City Attorney, Kenyon Disend; Dan Yourkoski, Acting Police Chief; Robert Grumbach, Development Services Director; Joe Willis, Public Works Director; Nancy, Adams, Finance Director; and Rachel Baker, City Clerk Mayor led members of the audience, council members, and City staff in the Pledge of Allegiance. APPROVAL OF MEETING AGENDA Council member Whitney requested postponement of approval of the July Check Register until September 12 because the finance committee has not yet reviewed the report. MOTION BOYD AND SECOND NELSON TO ADOPT AGENDA AS AMENDED AND MOTION CARRIED 7-0 AT 6:37 PM. PRESENTATION Medina City Hall construction manager Dave Clark presented the City with a plaque to memorialize completion of the project. Mayor thanked Mr. Clark for his efforts and the public and staff for flexibility and patience during construction of the project. City Council Minutes Page 2 August 8, 2011 PUBLIC COMMENT Mayor read guidelines concerning public comment period and opened floor to public comments at 6:41 pm. Medina resident Wilma Edmonds spoke on behalf of her neighbors on Northeast 24 Street and thanked public works director and city manager for interfacing with WSDOT concerning construction parking violations associated with the SR 520 project and thanked the city manager for communicating with Allied Waste regarding recent pick up schedule changes. Mayor closed public comment period at 6:43 pm. REPORTS AND ANNOUNCEMENTS Mayor reported he requested Hunts Point mayor send Medina City Council members a copy of the Transpo traffic study results for use of roundabout on 84 Avenue Northeast and announced addition of a ten-minute comment period at end of agenda. Mayor read proclamation presented to St. Thomas Episcopal Church and St. Thomas School. Council member Phelps promoted Medina Days, conveying it begins tomorrow night with the concert in the park and events continue through Saturday night. Council member Lee voiced donations are still needed. Development services director announced notice of application for Puget Sound Energy tree trimming permit will be mailed this week to approximately 1,000 parcels and responded to council member Boyd’s questions regarding SR 520 nighttime noise threshold. In response to council member Phelps, city manager responded City is investigating resources to assist with uptick in public records requests and city clerk confirmed number of Govdelivery subscription profiles questioned by council member Lee. CONSENT AGENDA MOTION DICHARRY AND SECOND NELSON TO ADOPT CONSENT AGENDA AS AMENDED AND MOTION 7-0 AT 6:53 PM. - Approval of July 11, 2011 City Council Regular Meeting Minutes - Approval of July 25, 2011 City Council Special Meeting Minutes - Receipt of Approved May 18, 2011 Emergency Committee Meeting Minutes - Receipt of Approved June 20, 2011 Park Board Meeting Minutes - Receipt of Approved June 28, 2011 Planning Commission Meeting Minutes - Adoption of Proposed Ordinance Related to Petty Cash City Council Minutes Page 3 August 8, 2011 PUBLIC HEARING 2012 Annual Budget Preparation (6:54 pm) Finance director provided brief overview of revenues, expenditures, and city council and finance department strategic goals. Mayor opened public hearing at 7:04 pm. Medina resident Miles Adam expressed his concerns related to the 2011 Budget, specifically implementation of utility taxes and franchise fees and moving money out of reserve fund expressing neither needed to be done and hoped the council would reconsider actions before repeating in 2012. Mr. Adam requested council retain funding in 2012 Budget to extend installation of public safety cameras to all City entrances. Resident Mark Parry requested council consider financial provisions for cameras near SR 520 to capture foot and public transportation traffic near park and ride area. Mr. Parry also requested funding to enhance Fairweather Park in order to blend future lid with the park. Resident urged council to prioritize funding allocations for expenses, such as low income housing versus capital projects. He thanked council and staff for completion of city hall project. Mayor closed public hearing at 7:11 pm. OTHER BUSINESS Approval of Points Loop Trail De Minimus Agreement (7:11 pm) Public works director summarized proposal and responded to questions concerning trail maintenance, trail placement, new sidewalk location, and public notification process. MOTION PHELPS AND SECOND BOYD TO APPROVE CONCURRENCY REQUEST FOR A DE MINIMIS IMPACT TO RELOCATE THE POINTS LOOP TRAIL TO THE SOUTH SIDE OF SR 520 AND NE 28TH STREET AND AUTHORIZE MAYOR/CITY MANAGER TO SIGN THE CONCURRENCY STATEMENT. MOTION CARRIED 7-0 AT 7:21 PM. Council member Phelps amended motion and council member Boyd seconded amendment to authorize city manager, in addition to mayor, to sign the concurrency statement. Proposed Ordinance Amending Chapters 1.15 and 12.08 MMC Adding Enforcement and Clarification for Construction in Streets (7:21 pm) Development services director briefed council on proposed ordinance and responded to questions related to penalties and appeals. City Council Minutes Page 4 August 8, 2011 MOTION BOYD AND SECOND DICHARRY TO APPROVE ADOPTING AN ORDINANCE OF THE CITY OF MEDINA AMENDING MEDINA MUNICIPAL CODE SECTIONS 1.15.030, 1.15.100, 1.15.330, 12.08.005 AND 12.08.010 ADDING CIVIL ENFORCEMENT PROVISIONS AND CLARIFYING CONSTRUCTION MITIGATION MEASURES FOR CONSTRUCTION IN STREETS. MOTION CARRIED 7-0 AT 7:25 PM. Council Agenda Calendar (7:26 pm) Mayor confirmed September 12 discussion of draft 2012 preliminary annual budget. PUBLIC COMMENT Mayor opened public comment period at 7:29 pm. Medina resident Connie Gerlitz expressed frustration about not having access to proposed budget prior to council discussion. Comment period expired at 7:31 pm since no additional comments were presented. EXECUTIVE SESSION The Medina City Council recessed into Executive Session at 7:37 pm pursuant to RCW 42.30.110 (1)(i) to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party and RCW 42.30.140(4)(a) related to collective bargaining sessions with employee organizations, including contract negotiations, grievance meetings, and discussions relating to the interpretation or application of a labor agreement; or (b) that portion of a meeting during which the governing body is planning or adopting the strategy or position to be taken by the governing body during the course of any collective bargaining, professional negotiations, or grievance or mediation proceedings, or reviewing the proposals made in the negotiations or proceedings while in progress. City council members Patrick Boyd, Doug Dicharry, Bret Jordan, Janie Lee, Mark Nelson, Katie Phelps, and Shawn Whitney; city manager; city clerk; city attorney Bruce Disend, Kenyon Disend, PLLC; and special counsel Chris Bacha, Kenyon Disend; and Cabot Dow, Cabot Dow Associates were in attendance. Cabot Dow and city clerk departed meeting at 8:37 pm and council member Whitney departed meeting at 9:07 pm. Mayor estimated 60 minutes for executive session and extended executive session 60 minutes at 8:37 pm. Executive Session adjourned and council reconvened in its Regular Meeting at 9:37 pm. City Council Minutes Page 5 August 8, 2011 ADJOURNMENT MOTION BOYD AND SECOND DICARRY TO ADJOURN THE AUGUST 8, 2011 REGULAR MEETING OF THE MEDINA CITY COUNCIL AND MOTION CARRIED 6-0 (WHITNEY ABSENT) AT 9:37 PM. The August 8, 2011, Regular Meeting of the Medina City Council adjourned at 9:37 pm. The Medina City Council will hold its next Regular Meeting on Monday, September 12, 2011, at 6:30 pm in the Council Chambers at Medina City Hall, 501 Evergreen Point Road, Medina.
